8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 38.001(f), Education Code, is amended to | |
10 | 10 | read as follows: | |
11 | 11 | (f) A person who has not received the immunizations required | |
12 | 12 | by this section for reasons of conscience, including because of the | |
13 | 13 | person's religious beliefs, may be excluded from school in times of | |
14 | 14 | emergency or epidemic declared by the commissioner of public | |
15 | 15 | health, except if the immunization is required for the prevention | |
16 | 16 | of COVID-19. | |
17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
21 | 21 | Act takes effect on the 91st day after the last day of the | |
22 | 22 | legislative session. |
