| 6 | 6 | | relating to the entitlement of a member of the legislature to |

| 7 | 7 | | receive certain state funds following an absence without leave when |
|---|
| 8 | 8 | | the applicable house of the legislature lacks a quorum to do |
|---|
| 9 | 9 | | business. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter F, Chapter 301, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 301.073 to read as follows: |
|---|
| 13 | 13 | | Sec. 301.073. MEMBER NOT ENTITLED TO STATE FUNDS IF ABSENT |
|---|
| 14 | 14 | | WITHOUT LEAVE WHEN QUORUM NOT PRESENT. A member of the legislature |
|---|
| 15 | 15 | | is not entitled to receive any state funds that the member would |
|---|
| 16 | 16 | | otherwise be entitled to receive or manage as a member of the |
|---|
| 17 | 17 | | legislature, including funds provided to operate an office of the |
|---|
| 18 | 18 | | member, for the one-year period beginning on any date the member is |
|---|
| 19 | 19 | | absent without a leave of absence granted by the house of the |
|---|
| 20 | 20 | | legislature of which the person is a member if that house lacks a |
|---|
| 21 | 21 | | quorum to do business. This section does not apply to funds the |
|---|
| 22 | 22 | | member is entitled to receive under the constitution. |

| 23 | 23 | | SECTION 2. Section 301.073, Government Code, as added by |
|---|
| 24 | 24 | | this Act, applies only to an absence that occurs on or after the |
|---|
| 25 | 25 | | effective date of this Act. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect on the 91st day after the last day of the |
|---|
| 31 | 31 | | legislative session. |
