44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to requiring public school and public institution of
77 higher education students to participate in interscholastic
88 athletic activities based on biological sex.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1111 amended by adding Section 33.0834 to read as follows:
1212 Sec. 33.0834. INTERSCHOLASTIC ATHLETIC PARTICIPATION BASED
1313 ON BIOLOGICAL SEX. (a) Except as provided by Subsection (b), an
1414 interscholastic athletic team sponsored or authorized by a school
1515 district or open-enrollment charter school may not allow a student
1616 to participate in an interscholastic athletic activity sponsored or
1717 authorized by the district or school that is designated for the
1818 biological sex opposite to the student's biological sex as
1919 determined at the student's birth and correctly stated on the
2020 student's official birth certificate.
2121 (b) An interscholastic athletic team described by
2222 Subsection (a) may allow a female student to participate in an
2323 interscholastic athletic activity that is designated for male
2424 students if a corresponding interscholastic athletic activity
2525 designated for female students is not offered or available.
2626 (c) For purposes of this section, a statement of a student's
2727 biological sex on the student's official birth certificate is
2828 considered to have correctly stated the student's biological sex as
2929 determined at the student's birth if the statement was:
3030 (1) entered at or near the time of the student's birth,
3131 as determined by University Interscholastic League rule; or
3232 (2) modified to correct a clerical error in the
3333 student's biological sex.
3434 SECTION 2. Subchapter Z, Chapter 51, Education Code, is
3535 amended by adding Section 51.980 to read as follows:
3636 Sec. 51.980. INTERSCHOLASTIC ATHLETIC PARTICIPATION BASED
3737 ON BIOLOGICAL SEX. (a) In this section, "institution of higher
3838 education" has the meaning assigned by Section 61.003.
3939 (b) Except as provided by Subsection (c), an
4040 interscholastic athletic team sponsored or authorized by an
4141 institution of higher education may not allow a student to
4242 participate in an interscholastic athletic activity sponsored or
4343 authorized by the institution that is designated for the biological
4444 sex opposite to the student's biological sex as determined at the
4545 student's birth and correctly stated on the student's official
4646 birth certificate.
4747 (c) An interscholastic athletic team described by
4848 Subsection (b) may allow a female student to participate in an
4949 interscholastic athletic activity that is designated for male
5050 students if a corresponding interscholastic athletic activity
5151 designated for female students is not offered or available.
5252 (d) For purposes of this section, a statement of a student's
5353 biological sex on the student's official birth certificate is
5454 considered to have correctly stated the student's biological sex as
5555 determined at the student's birth if the statement was:
5656 (1) entered at or near the time of the student's birth,
5757 as determined by Texas Higher Education Coordinating Board rule; or
5858 (2) modified to correct a clerical error in the
5959 student's biological sex.
6060 SECTION 3. (a) Section 33.0834, Education Code, as added by
6161 this Act, applies beginning with the 2021-2022 school year.
6262 (b) Section 51.980, Education Code, as added by this Act,
6363 applies beginning with the 2021-2022 academic year.
6464 SECTION 4. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect on the 91st day after the last day of the
6969 legislative session.
