| 9 | 9 | SECTION 1. Chapter 30, Penal Code, is amended by adding | |
| 10 | 10 | Section 30.055 to read as follows: | |
| 11 | 11 | Sec. 30.055. CRIMINAL TRESPASS BY ILLEGAL ALIEN. (a) A | |
| 12 | 12 | person commits an offense if the person: | |
| 13 | 13 | (1) is a citizen of any country other than the United | |
| 14 | 14 | States; and | |
| 15 | 15 | (2) enters or remains on or in any public or private | |
| 16 | 16 | property in this state in violation of 8 U.S.C. Section 1325 or | |
| 17 | 17 | 1326. | |
| 18 | 18 | (b) An offense under this section is a felony of the third | |
| 19 | 19 | degree. | |
| 20 | 20 | SECTION 2. This Act takes effect on the 91st day after the | |
| 21 | 21 | last day of the legislative session. |
