44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a prohibition on certain companies and hospitals from
77 requiring employees to receive a COVID-19 vaccination; creating a
88 criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 2, Labor Code, is amended by
1111 adding Chapter 24 to read as follows:
1212 CHAPTER 24. CERTAIN EMPLOYER-REQUIRED VACCINATIONS PROHIBITED
1313 Sec. 24.001. DEFINITIONS. In this chapter:
1414 (1) "Company" has the meaning assigned by Section
1515 808.001, Government Code.
1616 (2) "COVID-19" means the 2019 novel coronavirus
1717 disease.
1818 (3) "Hospital" means a health facility that is
1919 licensed under Chapter 241, Health and Safety Code.
2020 (4) "License" means a license, certificate,
2121 registration, permit, or other authorization that:
2222 (A) is issued by a state agency or political
2323 subdivision; and
2424 (B) a company must obtain to engage in a
2525 particular business or occupation.
2626 (5) "Political subdivision" means a county,
2727 municipality, school district, special purpose district, or other
2828 subdivision of state government that has jurisdiction limited to a
2929 geographic portion of the state.
3030 (6) "State agency" has the meaning assigned by Section
3131 609.001, Government Code.
3232 Sec. 24.002. OFFENSE; PENALTIES. (a) A company or hospital
3333 commits an offense if the company or hospital requires, as a
3434 condition of employment, an employee to receive a COVID-19
3535 vaccination.
3636 (b) Each employee required to receive a vaccination is a
3737 separate offense under Subsection (a).
3838 (c) An offense under this section is a Class B misdemeanor.
3939 (d) Notwithstanding any other law, a company that is
4040 convicted of an offense under this section is not eligible to hold a
4141 license until the fifth anniversary of the date of the conviction.
4242 A state agency or political subdivision shall revoke a license
4343 issued to a company that is ineligible to hold the license under
4444 this subsection.
4545 SECTION 2. This Act takes effect on the 91st day after the
4646 last day of the legislative session.
