44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to information on projected changes in weather, water
77 availability, and climate variability in strategic plans of certain
88 state agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2056.002(b), Government Code, is amended
1111 to read as follows:
1212 (b) The Legislative Budget Board and the governor's office
1313 shall determine the elements required to be included in each
1414 agency's strategic plan. Unless modified by the Legislative
1515 Budget Board and the governor's office, and except as provided by
1616 Subsection (c), a plan must include:
1717 (1) a statement of the mission and goals of the state
1818 agency;
1919 (2) a description of the indicators developed under
2020 this chapter and used to measure the output and outcome of the
2121 agency;
2222 (3) identification of the groups of people served by
2323 the agency, including those having service priorities, or other
2424 service measures established by law, and estimates of changes in
2525 those groups expected during the term of the plan;
2626 (4) an analysis of the use of the agency's resources to
2727 meet the agency's needs, including future needs, and an estimate of
2828 additional resources that may be necessary to meet future needs;
2929 (5) an analysis of expected changes in the services
3030 provided by the agency because of changes in state or federal law;
3131 (6) a description of the means and strategies for
3232 meeting the agency's needs, including future needs, and achieving
3333 the goals established under Section 2056.006 for each area of state
3434 government for which the agency provides services;
3535 (7) a description of the capital improvement needs of
3636 the agency during the term of the plan and a statement, if
3737 appropriate, of the priority of those needs;
3838 (8) identification of each geographic region of this
3939 state, including the Texas-Louisiana border region and the
4040 Texas-Mexico border region, served by the agency, and if
4141 appropriate the agency's means and strategies for serving each
4242 region;
4343 (9) a description of the training of the agency's
4444 contract managers under Section 656.052;
4545 (10) an analysis of the agency's expected expenditures
4646 that relate to federally owned or operated military installations
4747 or facilities, or communities where a federally owned or operated
4848 military installation or facility is located;
4949 (11) an analysis of the strategic use of information
5050 resources as provided by the instructions prepared under Section
5151 2054.095;
5252 (12) a written certification of the agency's
5353 compliance with the cybersecurity training required under Sections
5454 2054.5191 and 2054.5192; [and]
5555 (13) for the Department of Agriculture, Texas
5656 Commission on Environmental Quality, General Land Office, Texas
5757 Department of Housing and Community Affairs, Texas Department of
5858 Insurance, Parks and Wildlife Department, Department of Public
5959 Safety, Public Utility Commission of Texas, office of the
6060 comptroller, Texas A&M Forest Service, and Texas Water Development
6161 Board:
6262 (A) an analysis of expected changes, including
6363 adverse impacts, in the services provided by the agency because of
6464 projected changes in weather, water availability, and climate
6565 variability, as determined by the Texas state climatologist's
6666 report under Section 2056.005(c);
6767 (B) for each period described in Section
6868 2056.005(c), a description of the means and strategies for meeting
6969 the agency's needs and managing the risks associated with the
7070 projected changes in weather, water availability, and climate
7171 variability as determined by the report; and
7272 (C) for the means and strategies described by
7373 Paragraph (B):
7474 (i) identification of any financial
7575 resources that will be needed to carry out those means and
7676 strategies; and
7777 (ii) an analysis of partnerships and
7878 cooperation between the agency and other state, local, and federal
7979 governmental entities that will be needed to carry out those means
8080 and strategies; and
8181 (14) other information that may be required.
8282 SECTION 2. Section 2056.005, Government Code, is amended by
8383 adding Subsections (c), (d), (e), and (f) to read as follows:
8484 (c) Not later than February 1 of each even-numbered year,
8585 the Texas state climatologist shall provide to the Legislative
8686 Budget Board, for use in the strategic planning of a state agency
8787 listed in Section 2056.002(b)(13), a report on projected changes in
8888 weather, water availability, and climate variability across the
8989 state for a period of:
9090 (1) five years beginning with the next odd-numbered
9191 year; and
9292 (2) at least 20 years and not longer than 50 years
9393 beginning with the next odd-numbered year.
9494 (d) The report under Subsection (c) may include:
9595 (1) projections of precipitation;
9696 (2) projections of temperature;
9797 (3) projections of stream flow in Texas rivers;
9898 (4) projections of evaporation rates;
9999 (5) projections of soil moisture rates;
100100 (6) projections of sea level changes;
101101 (7) projections of coastal storm intensity;
102102 (8) projections of inland and coastal flood intensity;
103103 (9) likely ranges of variability for all projections;
104104 (10) any estimations of the likelihood of the
105105 forecasts, as considered appropriate by the Texas state
106106 climatologist; and
107107 (11) any additional factors that are considered useful
108108 for state agency strategic planning by the Texas state
109109 climatologist.
110110 (e) The Texas state climatologist may use a forecast created
111111 outside of the office of the state climatologist if the forecast is
112112 considered suitable by the climatologist for the requirements of
113113 the report.
114114 (f) Not later than March 1 of each even-numbered year, the
115115 Legislative Budget Board shall distribute the report provided under
116116 Subsection (c) to the state agencies listed in Section
117117 2056.002(b)(13) for use in each agency's strategic planning.
118118 SECTION 3. This Act takes effect on the 91st day after the
119119 last day of the legislative session.
