7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 17.003(d-1), Utilities Code, as added by |
---|
9 | 9 | | S.B. No. 3, Acts of the 87th Legislature, Regular Session, 2021, is |
---|
10 | 10 | | amended to read as follows: |
---|
11 | 11 | | (d-1) An electric utility providing electric delivery |
---|
12 | 12 | | service for a retail electric provider, as defined by Section |
---|
13 | 13 | | 31.002, shall provide to the retail electric provider, and the |
---|
14 | 14 | | retail electric provider shall periodically provide to the retail |
---|
15 | 15 | | electric provider's retail customers together with bills sent to |
---|
16 | 16 | | the customers, information about: |
---|
17 | 17 | | (1) the electric utility's procedures for implementing |
---|
18 | 18 | | involuntary load shedding initiated by the independent |
---|
19 | 19 | | organization certified under Section 39.151 for the ERCOT power |
---|
20 | 20 | | region; |
---|
21 | 21 | | (2) the types of customers who may be considered |
---|
22 | 22 | | critical care residential customers, critical load industrial |
---|
23 | 23 | | customers, or critical load according to commission rules adopted |
---|
24 | 24 | | under Section 38.076; |
---|
25 | 25 | | (3) the procedure for a customer to apply to be |
---|
26 | 26 | | considered a critical care residential customer, a critical load |
---|
27 | 27 | | industrial customer, or critical load according to commission rules |
---|
28 | 28 | | adopted under Section 38.076; [and] |
---|
29 | 29 | | (4) reducing electricity use at times when involuntary |
---|
30 | 30 | | load shedding events may be implemented; and |
---|
31 | 31 | | (5) the procedure for a residential or commercial |
---|
32 | 32 | | customer to participate in a voluntary demand response program |
---|
33 | 33 | | through the electric utility or a demand response provider to |
---|
34 | 34 | | reduce electricity use during times of peak demand, including |
---|
35 | 35 | | during an involuntary load shedding event. |

36 | 36 | | SECTION 2. Section 17.005(f), Utilities Code, as added by |
---|
37 | 37 | | S.B. No. 3, Acts of the 87th Legislature, Regular Session, 2021, is |
---|
38 | 38 | | amended to read as follows: |
---|
39 | 39 | | (f) A municipally owned utility shall periodically provide |
---|
40 | 40 | | with bills sent to retail customers of the utility information |
---|
41 | 41 | | about: |
---|
42 | 42 | | (1) the utility's procedure for implementing |
---|
43 | 43 | | involuntary load shedding; |
---|
44 | 44 | | (2) the types of customers who may be considered |
---|
45 | 45 | | critical care residential customers, critical load industrial |
---|
46 | 46 | | customers, or critical load according to commission rules adopted |
---|
47 | 47 | | under Section 38.076; |
---|
48 | 48 | | (3) the procedure for a customer to apply to be |
---|
49 | 49 | | considered a critical care residential customer, a critical load |
---|
50 | 50 | | industrial customer, or critical load according to commission rules |
---|
51 | 51 | | adopted under Section 38.076; [and] |
---|
52 | 52 | | (4) reducing electricity use at times when involuntary |

58 | 58 | | involuntary load shedding event. |

59 | 59 | | SECTION 3. Section 17.006(f), Utilities Code, as added by |

63 | 63 | | bills sent to retail customers of the cooperative information |

65 | 65 | | (1) the cooperative's procedure for implementing |

66 | 66 | | involuntary load shedding; |
---|
67 | 67 | | (2) the types of customers who may be considered |
---|
68 | 68 | | critical care residential customers, critical load industrial |
---|
69 | 69 | | customers, or critical load according to commission rules adopted |
---|
70 | 70 | | under Section 38.076; |
---|
71 | 71 | | (3) the procedure for a customer to apply to be |
---|
72 | 72 | | considered a critical care residential customer, a critical load |
---|
73 | 73 | | industrial customer, or critical load according to commission rules |
---|
74 | 74 | | adopted under Section 38.076; [and] |
---|
75 | 75 | | (4) reducing electricity use at times when involuntary |
---|
76 | 76 | | load shedding events may be implemented; and |
---|
77 | 77 | | (5) the procedure for a residential or commercial |
---|
78 | 78 | | customer to participate in a voluntary demand response program |
---|
79 | 79 | | through the cooperative or a demand response provider to reduce |
---|
80 | 80 | | electricity use during times of peak demand, including during an |
---|
81 | 81 | | involuntary load shedding event. |
---|
82 | 82 | | SECTION 4. Section 39.101(b), Utilities Code, is amended to |
---|
83 | 83 | | read as follows: |
---|
84 | 84 | | (b) A customer is entitled: |
---|
85 | 85 | | (1) to be informed about rights and opportunities in |
---|
86 | 86 | | the transition to a competitive electric industry; |
---|
87 | 87 | | (2) to choose the customer's retail electric provider |
---|
88 | 88 | | consistent with this chapter, to have that choice honored, and to |
---|
89 | 89 | | assume that the customer's chosen provider will not be changed |
---|
90 | 90 | | without the customer's informed consent; |
---|
91 | 91 | | (3) to have access to providers of energy efficiency |
---|
92 | 92 | | services, to on-site distributed generation, and to providers of |
---|
93 | 93 | | energy generated by renewable energy resources; |
---|
94 | 94 | | (4) to be served by a provider of last resort that |
---|
95 | 95 | | offers a commission-approved standard service package; |
---|
96 | 96 | | (5) to receive sufficient information to make an |
---|
97 | 97 | | informed choice of service provider; |
---|
98 | 98 | | (6) to be protected from unfair, misleading, or |
---|
99 | 99 | | deceptive practices, including protection from being billed for |
---|
100 | 100 | | services that were not authorized or provided; [and] |
---|
101 | 101 | | (7) to have an impartial and prompt resolution of |
---|
102 | 102 | | disputes with its chosen retail electric provider and transmission |
---|
103 | 103 | | and distribution utility; and |
---|
104 | 104 | | (8) to participate in demand response programs |
---|
105 | 105 | | through: |
---|
106 | 106 | | (A) retail electric providers; and |
---|
107 | 107 | | (B) demand response providers. |
---|
108 | 108 | | SECTION 5. This Act takes effect on the 91st day after the |
---|
109 | 109 | | last day of the legislative session. |
