55 AN ACT
66 relating to demand response programs.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 17.003(d-1), Utilities Code, as added by
99 S.B. No. 3, Acts of the 87th Legislature, Regular Session, 2021, is
1010 amended to read as follows:
1111 (d-1) An electric utility providing electric delivery
1212 service for a retail electric provider, as defined by Section
1313 31.002, shall provide to the retail electric provider, and the
1414 retail electric provider shall periodically provide to the retail
1515 electric provider's retail customers together with bills sent to
1616 the customers, information about:
1717 (1) the electric utility's procedures for implementing
1818 involuntary load shedding initiated by the independent
1919 organization certified under Section 39.151 for the ERCOT power
2020 region;
2121 (2) the types of customers who may be considered
2222 critical care residential customers, critical load industrial
2323 customers, or critical load according to commission rules adopted
2424 under Section 38.076;
2525 (3) the procedure for a customer to apply to be
2626 considered a critical care residential customer, a critical load
2727 industrial customer, or critical load according to commission rules
2828 adopted under Section 38.076; [and]
2929 (4) reducing electricity use at times when involuntary
3030 load shedding events may be implemented; and
3131 (5) the procedure for a residential or commercial
3232 customer to participate in a voluntary demand response program
3333 through the electric utility or a demand response provider to
3434 reduce electricity use during times of peak demand, including
3535 during an involuntary load shedding event.
3636 SECTION 2. Section 17.005(f), Utilities Code, as added by
3737 S.B. No. 3, Acts of the 87th Legislature, Regular Session, 2021, is
3838 amended to read as follows:
3939 (f) A municipally owned utility shall periodically provide
4040 with bills sent to retail customers of the utility information
4141 about:
4242 (1) the utility's procedure for implementing
4343 involuntary load shedding;
4444 (2) the types of customers who may be considered
4545 critical care residential customers, critical load industrial
4646 customers, or critical load according to commission rules adopted
4747 under Section 38.076;
4848 (3) the procedure for a customer to apply to be
4949 considered a critical care residential customer, a critical load
5050 industrial customer, or critical load according to commission rules
5151 adopted under Section 38.076; [and]
5252 (4) reducing electricity use at times when involuntary
5353 load shedding events may be implemented; and
5454 (5) the procedure for a residential or commercial
5555 customer to participate in a voluntary demand response program
5656 through the utility or a demand response provider to reduce
5757 electricity use during times of peak demand, including during an
5858 involuntary load shedding event.
5959 SECTION 3. Section 17.006(f), Utilities Code, as added by
6060 S.B. No. 3, Acts of the 87th Legislature, Regular Session, 2021, is
6161 amended to read as follows:
6262 (f) An electric cooperative shall periodically provide with
6363 bills sent to retail customers of the cooperative information
6464 about:
6565 (1) the cooperative's procedure for implementing
6666 involuntary load shedding;
6767 (2) the types of customers who may be considered
6868 critical care residential customers, critical load industrial
6969 customers, or critical load according to commission rules adopted
7070 under Section 38.076;
7171 (3) the procedure for a customer to apply to be
7272 considered a critical care residential customer, a critical load
7373 industrial customer, or critical load according to commission rules
7474 adopted under Section 38.076; [and]
7575 (4) reducing electricity use at times when involuntary
7676 load shedding events may be implemented; and
7777 (5) the procedure for a residential or commercial
7878 customer to participate in a voluntary demand response program
7979 through the cooperative or a demand response provider to reduce
8080 electricity use during times of peak demand, including during an
8181 involuntary load shedding event.
8282 SECTION 4. Section 39.101(b), Utilities Code, is amended to
8383 read as follows:
8484 (b) A customer is entitled:
8585 (1) to be informed about rights and opportunities in
8686 the transition to a competitive electric industry;
8787 (2) to choose the customer's retail electric provider
8888 consistent with this chapter, to have that choice honored, and to
8989 assume that the customer's chosen provider will not be changed
9090 without the customer's informed consent;
9191 (3) to have access to providers of energy efficiency
9292 services, to on-site distributed generation, and to providers of
9393 energy generated by renewable energy resources;
9494 (4) to be served by a provider of last resort that
9595 offers a commission-approved standard service package;
9696 (5) to receive sufficient information to make an
9797 informed choice of service provider;
9898 (6) to be protected from unfair, misleading, or
9999 deceptive practices, including protection from being billed for
100100 services that were not authorized or provided; [and]
101101 (7) to have an impartial and prompt resolution of
102102 disputes with its chosen retail electric provider and transmission
103103 and distribution utility; and
104104 (8) to participate in demand response programs
105105 through:
106106 (A) retail electric providers; and
107107 (B) demand response providers.
108108 SECTION 5. This Act takes effect on the 91st day after the
109109 last day of the legislative session.
