55 AN ACT
66 relating to energy efficiency goals for electric utilities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 39.905, Utilities Code, is amended by
99 adding Subsections (a-1) and (a-2) to read as follows:
1010 (a-1) In addition to meeting the demand goals provided by
1111 Subsection (a), each electric utility shall also meet an annual
1212 energy savings goal of:
1313 (1) one-fourth of one percent annual energy savings in
1414 the 2022 calendar year;
1515 (2) one-half of one percent annual energy savings in
1616 the 2023 calendar year;
1717 (3) three-fourths of one percent annual energy savings
1818 in the 2024 calendar year; and
1919 (4) one percent annual energy savings beginning with
2020 the 2025 calendar year.
2121 (a-2) The commission by rule shall provide a method to
2222 establish each utility's annual savings goal under Subsection
2323 (a-1). The method must be based on the existing and expected usage
2424 of electricity delivered in a utility's service area that is
2525 required to pay the annual energy efficiency cost recovery fee. In
2626 adopting rules, the commission may provide for cost caps for the
2727 implementation of Subsection (a-1) and provide good cause
2828 exceptions for a utility that is unable to meet the goal in a
2929 cost-effective manner.
3030 SECTION 2. The Public Utility Commission of Texas shall
3131 adopt rules to implement the changes made by this Act to Section
3232 39.905, Utilities Code, not later than the 120th day after the
3333 effective date of this Act.
3434 SECTION 3. This Act takes effect on the 91st day after the
3535 last day of the legislative session.
