| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 39.905, Utilities Code, is amended by |
|---|
| 9 | 9 | | adding Subsections (a-1) and (a-2) to read as follows: |
|---|
| 10 | 10 | | (a-1) In addition to meeting the demand goals provided by |
|---|
| 11 | 11 | | Subsection (a), each electric utility shall also meet an annual |
|---|
| 12 | 12 | | energy savings goal of: |
|---|
| 13 | 13 | | (1) one-fourth of one percent annual energy savings in |
|---|
| 14 | 14 | | the 2022 calendar year; |
|---|
| 15 | 15 | | (2) one-half of one percent annual energy savings in |
|---|
| 16 | 16 | | the 2023 calendar year; |
|---|
| 17 | 17 | | (3) three-fourths of one percent annual energy savings |
|---|
| 18 | 18 | | in the 2024 calendar year; and |
|---|
| 19 | 19 | | (4) one percent annual energy savings beginning with |
|---|
| 20 | 20 | | the 2025 calendar year. |
|---|
| 21 | 21 | | (a-2) The commission by rule shall provide a method to |
|---|
| 22 | 22 | | establish each utility's annual savings goal under Subsection |
|---|
| 23 | 23 | | (a-1). The method must be based on the existing and expected usage |
|---|
| 24 | 24 | | of electricity delivered in a utility's service area that is |
|---|
| 25 | 25 | | required to pay the annual energy efficiency cost recovery fee. In |
|---|
| 26 | 26 | | adopting rules, the commission may provide for cost caps for the |
|---|
| 27 | 27 | | implementation of Subsection (a-1) and provide good cause |
|---|
| 28 | 28 | | exceptions for a utility that is unable to meet the goal in a |
|---|
| 29 | 29 | | cost-effective manner. |
|---|
| 30 | 30 | | SECTION 2. The Public Utility Commission of Texas shall |
|---|
| 31 | 31 | | adopt rules to implement the changes made by this Act to Section |
|---|
| 32 | 32 | | 39.905, Utilities Code, not later than the 120th day after the |
|---|
| 33 | 33 | | effective date of this Act. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect on the 91st day after the |
|---|
| 35 | 35 | | last day of the legislative session. |
