55 AN ACT
66 relating to the authority of the Public Utility Commission of Texas
77 to ensure the independent organization certified for the ERCOT
88 power region has adequate reserve power to prevent blackout
99 conditions.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 39, Utilities Code, is
1212 amended by adding Section 39.166 to read as follows:
1313 Sec. 39.166. ENSURING RESERVE POWER CAPACITY. (a) The
1414 commission by rule shall develop a process for obtaining emergency
1515 reserve power generation capacity as appropriate to prevent
1616 blackout conditions caused by shortages of generated power in the
1717 ERCOT power region. The rules must provide:
1818 (1) parameters for estimating the amount of emergency
1919 reserve power generation capacity necessary to prevent blackout
2020 conditions; and
2121 (2) mechanisms for equitably sharing the costs of
2222 making the reserve capacity available and the costs of generated
2323 power provided to prevent blackout conditions.
2424 (b) In accordance with rules adopted under Subsection (a),
2525 an independent organization certified under Section 39.151 for the
2626 ERCOT power region shall adopt procedures and enter contracts as
2727 necessary to ensure the availability of a defined amount of
2828 emergency reserve power generation capacity the organization may
2929 call on to prevent blackouts caused by shortages of generated
3030 power.
3131 (c) Before the independent organization calls on the
3232 emergency reserve power generation capacity to prevent blackout
3333 conditions, the organization shall use all other sources of power
3434 and demand reduction available in accordance with commission rules
3535 adopted under this section.
3636 SECTION 2. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect on the 91st day after the last day of the
4141 legislative session.
