| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter D, Chapter 39, Utilities Code, is |
|---|
| 10 | 10 | | amended by adding Section 39.166 to read as follows: |
|---|
| 11 | 11 | | Sec. 39.166. REQUIRED INTERCONNECTION WITH TRANSMISSION |
|---|
| 12 | 12 | | FACILITIES OUTSIDE OF ERCOT. (a) The commission shall identify |
|---|
| 13 | 13 | | transmission facilities in ERCOT that may be interconnected with |
|---|
| 14 | 14 | | transmission facilities outside of ERCOT for the purpose of |
|---|
| 15 | 15 | | allowing federal regulation of transmission service and wholesale |
|---|
| 16 | 16 | | power sales in ERCOT. |
|---|
| 17 | 17 | | (b) Notwithstanding any other law, the commission shall |
|---|
| 18 | 18 | | require an electric utility, municipally owned utility, or electric |
|---|
| 19 | 19 | | cooperative that owns a transmission facility identified by the |
|---|
| 20 | 20 | | commission under Subsection (a) to make requests, obtain approvals, |
|---|
| 21 | 21 | | enter into contracts, and construct facilities as necessary to |
|---|
| 22 | 22 | | interconnect the facility with a transmission facility outside of |
|---|
| 23 | 23 | | ERCOT. |

| 24 | 24 | | SECTION 2. Not later than November 1, 2022, the Public |
|---|
| 25 | 25 | | Utility Commission of Texas shall examine the laws and rules |
|---|
| 26 | 26 | | governing electric utilities in this state to determine how Section |
|---|
| 27 | 27 | | 39.166, Utilities Code, as added by this Act, may affect the |
|---|
| 28 | 28 | | application of those laws and rules and shall adopt recommendations |
|---|
| 29 | 29 | | for legislative and administrative action as necessary to implement |
|---|
| 30 | 30 | | that section as effectively as practicable. |
|---|
| 31 | 31 | | SECTION 3. (a) Section 39.166, Utilities Code, as added by |
|---|
| 32 | 32 | | this Act, takes effect September 1, 2023. |
|---|
| 33 | 33 | | (b) Section 2 of this Act takes effect on the 91st day after |
|---|
| 34 | 34 | | the last day of the legislative session. |
