55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of and professional liability insurance
88 coverage for gender transitioning or gender reassignment medical
99 procedures and treatments for certain children.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 161, Health and Safety Code, is amended
1212 by adding Subchapter X to read as follows:
1313 SUBCHAPTER X. GENDER TRANSITIONING AND GENDER REASSIGNMENT
1414 PROCEDURES AND TREATMENTS FOR CERTAIN CHILDREN
1515 Sec. 161.701. DEFINITIONS. In this subchapter:
1616 (1) "Child" means an individual who is younger than 18
1717 years of age.
1818 (2) "Health care provider" means a person other than a
1919 physician who is licensed, certified, or otherwise authorized by
2020 the laws of this state to provide or render health care or to
2121 dispense or prescribe a prescription drug in the ordinary course of
2222 business or practice of a profession.
2323 (3) "Physician" means a person licensed to practice
2424 medicine in this state.
2525 Sec. 161.702. PROHIBITED PROVISION OF GENDER TRANSITIONING
2626 OR GENDER REASSIGNMENT PROCEDURES AND TREATMENTS TO CERTAIN
2727 CHILDREN. For the purpose of transitioning a child's biological
2828 sex as determined by the sex organs, chromosomes, and endogenous
2929 profiles of the child or affirming the child's perception of the
3030 child's sex if that perception is inconsistent with the child's
3131 biological sex, a physician or health care provider may not:
3232 (1) perform a surgery that sterilizes the child,
3333 including:
3434 (A) castration;
3535 (B) vasectomy;
3636 (C) hysterectomy;
3737 (D) oophorectomy;
3838 (E) metoidioplasty;
3939 (F) orchiectomy;
4040 (G) penectomy;
4141 (H) phalloplasty; and
4242 (I) vaginoplasty;
4343 (2) perform a mastectomy;
4444 (3) prescribe, administer, or supply any of the
4545 following medications that induce transient or permanent
4646 infertility:
4747 (A) puberty-blocking medication to stop or delay
4848 normal puberty;
4949 (B) supraphysiologic doses of testosterone to
5050 females; or
5151 (C) supraphysiologic doses of estrogen to males;
5252 or
5353 (4) remove any otherwise healthy or non-diseased body
5454 part or tissue.
5555 Sec. 161.703. EXCEPTIONS. (a) Section 161.702 does not
5656 apply to a physician's or health care provider's provision, with the
5757 consent of the child's parent or legal guardian, of appropriate and
5858 medically necessary gender transitioning or gender reassignment
5959 procedures or treatments to a child who:
6060 (1) is born with a medically verifiable genetic
6161 disorder of sex development, including:
6262 (A) 46, XX chromosomes with virilization;
6363 (B) 46, XY chromosomes with undervirilization;
6464 or
6565 (C) both ovarian and testicular tissue; or
6666 (2) does not have the normal sex chromosome structure
6767 for male or female as determined by a physician through genetic
6868 testing.
6969 (b) Section 161.702 does not apply to a physician's or
7070 health care provider's provision of a puberty suppression or
7171 blocking prescription drug to a child experiencing precocious
7272 puberty for the purpose of normalizing puberty for the child.
7373 Sec. 161.704. DISCIPLINARY ACTION. The Texas Medical Board
7474 or another state regulatory agency with jurisdiction over a health
7575 care provider subject to Section 161.702 shall revoke the license,
7676 certification, or authorization of a physician or health care
7777 provider who the board or agency determines has violated that
7878 section.
7979 SECTION 2. Subchapter F, Chapter 1901, Insurance Code, is
8080 amended by adding Section 1901.256 to read as follows:
8181 Sec. 1901.256. PROHIBITED COVERAGE FOR PROVISION OF CERTAIN
8282 GENDER-RELATED PROCEDURES AND TREATMENTS TO CERTAIN CHILDREN. A
8383 professional liability insurance policy issued to a physician or
8484 health care provider may not include coverage for damages assessed
8585 against the physician or health care provider who provides to a
8686 child gender transitioning or gender reassignment procedures or
8787 treatments that are prohibited by Section 161.702, Health and
8888 Safety Code.
8989 SECTION 3. Section 1901.256, Insurance Code, as added by
9090 this Act, applies only to a medical professional liability
9191 insurance policy that is delivered, issued for delivery, or renewed
9292 on or after May 1, 2022. An insurance policy that is delivered,
9393 issued for delivery, or renewed before May 1, 2022, is governed by
9494 the law in effect immediately before the effective date of this Act,
9595 and that law is continued in effect for that purpose.
9696 SECTION 4. This Act takes effect immediately if it receives
9797 a vote of two-thirds of all the members elected to each house, as
9898 provided by Section 39, Article III, Texas Constitution. If this
9999 Act does not receive the vote necessary for immediate effect, this
100100 Act takes effect on the 91st day after the last day of the
101101 legislative session.
