55 AN ACT
66 relating to requirements for beneficial tax treatment related to a
77 leasehold or other possessory interest in a public facility being
88 developed or used to provide multifamily housing.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 303.042(f), Local Government Code, is
1111 amended to read as follows:
1212 (f) Notwithstanding Subsections (a) and (b) and except as
1313 provided by Section 303.0425, during the period of time that a
1414 corporation owns a particular public facility, a leasehold or other
1515 possessory interest in the real property of the public facility
1616 granted by the corporation shall be treated in the same manner as a
1717 leasehold or other possessory interest in real property granted by
1818 an authority under Section 379B.011(b).
1919 SECTION 2. Subchapter B, Chapter 303, Local Government
2020 Code, is amended by adding Section 303.0425 to read as follows:
2121 Sec. 303.0425. REQUIREMENTS FOR BENEFICIAL TAX TREATMENT
2222 RELATING TO CERTAIN PUBLIC FACILITIES. (a) In this section:
2323 (1) "Housing choice voucher program" means the housing
2424 choice voucher program under Section 8, United States Housing Act
2525 of 1937 (42 U.S.C. Section 1437f).
2626 (2) "Housing facility" means a public facility being
2727 developed or used to provide multifamily housing.
2828 (3) "Housing facility user" means a private developer
2929 or other private entity that has a leasehold or other possessory
3030 interest in a housing facility.
3131 (b) Section 303.042(f) applies to a leasehold or other
3232 possessory interest in a housing facility granted to a housing
3333 facility user only if the housing facility user meets the
3434 requirements of this section.
3535 (c) Section 303.042(f) does not apply to ad valorem taxes
3636 imposed by a school district on a leasehold or other possessory
3737 interest in a housing facility granted to a housing facility user.
3838 (d) A housing facility user may not:
3939 (1) refuse to rent a residential unit in the housing
4040 facility to an individual or family because the individual or
4141 family participates in the housing choice voucher program; or
4242 (2) use a financial or minimum income standard that
4343 requires an individual or family participating in the housing
4444 choice voucher program to have a monthly income of more than 250
4545 percent of the individual's or family's share of the total monthly
4646 rent payable for a residential unit.
4747 SECTION 3. Section 303.0425, Local Government Code, as
4848 added by this Act, applies only to a leasehold or other possessory
4949 interest in a housing facility granted by a public facility
5050 corporation to a housing facility user on or after the effective
5151 date of this Act.
5252 SECTION 4. This Act takes effect on the 91st day after the
5353 last day of the legislative session.
