44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the identification of and prohibited cooperation by
77 state and local entities with certain federal acts that violate the
88 United States Constitution.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 7, Government Code, is amended by adding
1111 Chapter 794 to read as follows:
1212 CHAPTER 794. IDENTIFICATION OF AND PROHIBITED COOPERATION WITH
1313 CERTAIN UNCONSTITUTIONAL ACTS OF FEDERAL GOVERNMENT
1414 Sec. 794.001. DEFINITIONS. In this chapter:
1515 (1) "Political subdivision" has the meaning assigned
1616 by Section 791.003.
1717 (2) "State agency" has the meaning assigned by Section
1818 751.001.
1919 Sec. 794.002. REVIEW OF EXECUTIVE ORDERS. (a) On the last
2020 day of each month, the attorney general shall provide a written
2121 report to the governor, the lieutenant governor, the speaker of the
2222 house of representatives, and each member of the legislature that:
2323 (1) identifies each rule adopted by a federal
2424 government agency during the previous month that:
2525 (A) relates to:
2626 (i) border security;
2727 (ii) pandemics or other health emergencies;
2828 (iii) the regulation of natural resources,
2929 including coal and oil;
3030 (iv) the regulation of the agriculture
3131 industry;
3232 (v) the use of land;
3333 (vi) the regulation of the financial sector
3434 as it relates to environmental, social, or governance standards;
3535 (vii) the regulation of the constitutional
3636 right to keep and bear arms; or
3737 (viii) the free exercise of religion,
3838 including the congregating of religious practitioners;
3939 (B) was adopted in response to an executive order
4040 by the president of the United States; and
4141 (C) violates the rights guaranteed to the
4242 citizens of the United States by the United States Constitution;
4343 and
4444 (2) provides the status of any lawsuit filed against
4545 the federal government relating to a rule identified by any report
4646 prepared under this section, including whether a court has found
4747 the rule to violate the rights guaranteed to the citizens of the
4848 United States by the United States Constitution.
4949 (b) The attorney general shall publish any report prepared
5050 under this section on the attorney general's website and in the
5151 Texas Register.
5252 Sec. 794.003. COOPERATION WITH UNCONSTITUTIONAL ACTS.
5353 Notwithstanding any other law, a state agency or political
5454 subdivision may not cooperate with a federal government agency in
5555 implementing an agency rule that a report published under Section
5656 794.002 indicates has been found by a federal court in a decision
5757 that has not been stayed, reversed, or overruled to violate the
5858 rights guaranteed to the citizens of the United States by the United
5959 States Constitution.
6060 Sec. 794.004. INJUNCTIVE RELIEF. The attorney general may
6161 bring an action in a district court in Travis County or in a county
6262 in which the political subdivision is located to enjoin a violation
6363 of Section 794.003.
6464 SECTION 2. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect on the 91st day after the last day of the
6969 legislative session.
