44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to climate control requirements at facilities operated by
77 the Texas Department of Criminal Justice.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 501, Government Code, is
1010 amended by adding Section 501.028 to read as follows:
1111 Sec. 501.028. CLIMATE CONTROL REQUIREMENTS AT DEPARTMENT
1212 FACILITIES. (a) In this section, "required temperature-controlled
1313 area" means the following areas of a facility operated by the
1414 department:
1515 (1) hospitals;
1616 (2) visiting areas;
1717 (3) housing or dormitory areas;
1818 (4) trustee areas;
1919 (5) areas used for medical treatment or care,
2020 including areas used for dispensing medication to inmates;
2121 (6) kitchens or dining areas;
2222 (7) food preparation areas;
2323 (8) community areas, including dayrooms;
2424 (9) laundry areas;
2525 (10) areas used for work stations;
2626 (11) indoor recreational areas, including gymnasiums;
2727 (12) restroom and shower areas and other areas related
2828 to inmate hygiene;
2929 (13) administrative areas;
3030 (14) correctional officer stations, including guard
3131 post areas;
3232 (15) commissary areas;
3333 (16) areas used for programmatic, educational, or
3434 vocational purposes;
3535 (17) chapels or churches;
3636 (18) libraries; and
3737 (19) maintenance areas.
3838 (b) The department shall ensure that:
3939 (1) the temperature in each required
4040 temperature-controlled area is maintained at not less than 65
4141 degrees Fahrenheit or more than 85 degrees Fahrenheit; and
4242 (2) each climate control system in use at a facility
4343 operated by the department includes virus-mitigation technology,
4444 such as air purifiers, for the purpose of reducing the spread of
4545 airborne viruses.
4646 SECTION 2. The Texas Department of Criminal Justice is not
4747 required to comply with the requirements of Section 501.028,
4848 Government Code, as added by this Act, until September 1, 2022.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect on the 91st day after the last day of the
5454 legislative session.
