55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a prohibition on COVID-19 vaccine mandates.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. This Act shall be known as the Pelosi
1010 Congressional Vaccination Doctrine Act.
1111 SECTION 2. Subchapter A, Chapter 161, Health and Safety
1212 Code, is amended by adding Section 161.0015 to read as follows:
1313 Sec. 161.0015. COVID-19 VACCINE MANDATES PROHIBITED. (a)
1414 In this section, "governmental entity" means this state, a local
1515 government entity as defined by Section 418.004, Government Code,
1616 or an agency of this state or a local government entity.
1717 (b) A governmental entity may not implement, order, or
1818 otherwise impose a mandate requiring an individual to be vaccinated
1919 against COVID-19.
2020 SECTION 3. Section 161.0085(c), Health and Safety Code, is
2121 amended to read as follows:
2222 (c) A business in this state may not require a customer or an
2323 employee of the business to provide any documentation certifying
2424 the customer's or employee's COVID-19 vaccination or
2525 post-transmission recovery on entry to, to gain access to, [or] to
2626 receive service from, or to be employed by the business. A business
2727 that fails to comply with this subsection is not eligible to receive
2828 a grant or enter into a contract payable with state funds.
2929 SECTION 4. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect on the 91st day after the last day of the
3434 legislative session.
