44 A JOINT RESOLUTION
55 proposing a constitutional amendment to authorize the legislature
66 to provide for a credit against the ad valorem taxes imposed on
77 property owned by a person who makes a donation to the state for the
88 purpose of border security and to provide for the reimbursement of
99 political subdivisions for the revenue loss incurred as a result of
1010 the credit.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article VIII, Texas Constitution, is amended by
1313 adding Section 1-q to read as follows:
1414 Sec. 1-q. (a) The legislature by general law may provide
1515 that a person who makes a donation to the state for the purpose of
1616 border security is entitled to a credit against the ad valorem taxes
1717 imposed on property that the person owns in an amount equal to the
1818 lesser of the amount of the donation or the amount of taxes imposed.
1919 (b) The legislature by general law may prescribe
2020 eligibility requirements for the tax credit authorized by this
2121 section and may provide formulas for determining the manner in
2222 which the credit is allocated among the political subdivisions that
2323 impose a tax on the person's property.
2424 (c) Notwithstanding any other provision of this
2525 constitution, the legislature by general law may authorize the use
2626 of state money to reimburse a political subdivision for the revenue
2727 loss incurred as a result of the tax credit authorized by this
2828 section and shall provide a procedure for distributing the money
2929 appropriated for that purpose.
3030 SECTION 2. This proposed constitutional amendment shall be
3131 submitted to the voters at an election to be held November 8, 2022.
3232 The ballot shall be printed to permit voting for or against the
3333 proposition: "The constitutional amendment to authorize the
3434 legislature to provide for a credit against the ad valorem taxes
3535 imposed on property owned by a person who makes a donation to the
3636 state for the purpose of border security and to provide for the
3737 reimbursement of political subdivisions for the revenue loss
3838 incurred as a result of the credit."
