| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article XVI, Texas Constitution, is amended by |
|---|
| 11 | 11 | | adding Section 74 to read as follows: |
|---|
| 12 | 12 | | Sec. 74. (a) The legislature by general law may: |
|---|
| 13 | 13 | | (1) hold a statewide referendum that allows the voters |
|---|
| 14 | 14 | | to indicate a preference for either: |
|---|
| 15 | 15 | | (A) observing standard time year-round; or |
|---|
| 16 | 16 | | (B) observing daylight saving time year-round; |
|---|
| 17 | 17 | | and |
|---|
| 18 | 18 | | (2) enact a law based on the results of the referendum |
|---|
| 19 | 19 | | providing for the state to observe standard time year-round or to |
|---|
| 20 | 20 | | observe daylight saving time year-round. |
|---|
| 21 | 21 | | (b) A statewide referendum described by Subsection (a) of |
|---|
| 22 | 22 | | this section that is held on the same day as the election on the |
|---|
| 23 | 23 | | constitutional amendment to add this section to this article is |
|---|
| 24 | 24 | | hereby validated. |

| 25 | 25 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 26 | 26 | | submitted to the voters at an election to be held May 7, 2022. The |
|---|
| 27 | 27 | | ballot shall be printed to permit voting for or against the |
|---|
| 28 | 28 | | proposition: "The constitutional amendment authorizing the state |
|---|
| 29 | 29 | | to conduct a statewide referendum to allow the voters to choose |
|---|
| 30 | 30 | | between observing standard time year-round and observing daylight |
|---|
| 31 | 31 | | saving time year-round and authorizing the legislature to enact |
|---|
| 32 | 32 | | legislation that gives effect to the option preferred by a majority |
|---|
| 33 | 33 | | of the voters voting in the statewide referendum." |
