66 BE IT RESOLVED by the House of Representatives of the 87th
77 Texas Legislature, That Sections 6 and 8 of Rule 5 of the permanent
88 rules of the House of Representatives of the 87th Legislature are
99 amended to read as follows:
1010 Sec. 6. MOTIONS IN ORDER WHEN QUORUM NOT PRESENT. If a
1111 registration or record vote reveals that a quorum is not present,
1212 only a motion to adjourn or a motion for a call of the house and the
1313 motions incidental thereto, including motions to impose penalties
1414 on absent members, shall be in order.
1515 Sec. 8. SECURING A QUORUM. (a) When a call of the house is
1616 moved for one of the above purposes and seconded by 15 members (of
1717 whom the speaker may be one) and ordered by a majority vote, the
1818 main entrance to the hall and all other doors leading out of the
1919 hall shall be locked and no member permitted to leave the house
2020 without the written permission of the speaker. The names of members
2121 present shall be recorded. All absentees for whom no sufficient
2222 excuse is made may, by order of a majority of those present, be sent
2323 for and arrested, wherever they may be found, by the
2424 sergeant-at-arms or an officer appointed by the sergeant-at-arms
2525 for that purpose, and their attendance shall be secured and
2626 retained. The house shall determine on what conditions they shall
2727 be discharged. Members who voluntarily appear shall, unless the
2828 house otherwise directs, be immediately admitted to the hall of the
2929 house and shall report their names to the clerk to be entered in the
3030 journal as present.
3131 (b) Until a quorum appears, should the roll call fail to
3232 show one present, it shall not be in order to recess under a call of
3333 the house and no business shall be transacted, except to adjourn,
3434 compel the attendance of absent members, or, by a vote of a majority
3535 of all members, impose the following penalties on absent members:
3636 (1) removal of an absent member from any committee
3737 chairmanship;
3838 (2) removal of an absent member from any procedural
3939 committee; and
4040 (3) permanent removal of any privilege or advantage
4141 regularly due to an absent member on the basis of seniority [to
4242 adjourn. It shall not be in order to recess under a call of the
4343 house].
