| 6 | 6 | | BE IT RESOLVED by the House of Representatives of the 87th |
|---|
| 7 | 7 | | Texas Legislature, That Sections 6 and 8 of Rule 5 of the permanent |
|---|
| 8 | 8 | | rules of the House of Representatives of the 87th Legislature are |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | Sec. 6. MOTIONS IN ORDER WHEN QUORUM NOT PRESENT. If a |
|---|
| 11 | 11 | | registration or record vote reveals that a quorum is not present, |
|---|
| 12 | 12 | | only a motion to adjourn or a motion for a call of the house and the |
|---|
| 13 | 13 | | motions incidental thereto, including motions to impose penalties |
|---|
| 14 | 14 | | on absent members, shall be in order. |
|---|
| 15 | 15 | | Sec. 8. SECURING A QUORUM. (a) When a call of the house is |
|---|
| 16 | 16 | | moved for one of the above purposes and seconded by 15 members (of |
|---|
| 17 | 17 | | whom the speaker may be one) and ordered by a majority vote, the |
|---|
| 18 | 18 | | main entrance to the hall and all other doors leading out of the |
|---|
| 19 | 19 | | hall shall be locked and no member permitted to leave the house |
|---|
| 20 | 20 | | without the written permission of the speaker. The names of members |
|---|
| 21 | 21 | | present shall be recorded. All absentees for whom no sufficient |
|---|
| 22 | 22 | | excuse is made may, by order of a majority of those present, be sent |
|---|
| 23 | 23 | | for and arrested, wherever they may be found, by the |
|---|
| 24 | 24 | | sergeant-at-arms or an officer appointed by the sergeant-at-arms |
|---|
| 25 | 25 | | for that purpose, and their attendance shall be secured and |
|---|
| 26 | 26 | | retained. The house shall determine on what conditions they shall |
|---|
| 27 | 27 | | be discharged. Members who voluntarily appear shall, unless the |
|---|
| 28 | 28 | | house otherwise directs, be immediately admitted to the hall of the |
|---|
| 29 | 29 | | house and shall report their names to the clerk to be entered in the |
|---|
| 30 | 30 | | journal as present. |
|---|
| 31 | 31 | | (b) Until a quorum appears, should the roll call fail to |
|---|
| 32 | 32 | | show one present, it shall not be in order to recess under a call of |
|---|
| 33 | 33 | | the house and no business shall be transacted, except to adjourn, |
|---|
| 34 | 34 | | compel the attendance of absent members, or, by a vote of a majority |
|---|
| 35 | 35 | | of all members, impose the following penalties on absent members: |

| 36 | 36 | | (1) removal of an absent member from any committee |
|---|
| 37 | 37 | | chairmanship; |
|---|
| 38 | 38 | | (2) removal of an absent member from any procedural |
|---|
| 39 | 39 | | committee; and |
|---|
| 40 | 40 | | (3) permanent removal of any privilege or advantage |
|---|
| 41 | 41 | | regularly due to an absent member on the basis of seniority [to |
