5	5		BE IT RESOLVED, BY THE House of Representatives of the State
6	6		of Texas, that House Rule 13, Section 9, be suspended in part as
7	7		provided by House Rule 13, Section 9(f) to enable consideration of,
8	8		and action on, the following specific matters which may be
9	9		contained in the Conference Committee Report on Senate Bill 8.
10	10		A. Suspend House Rule 13, Section 9a (4) to allow the Conference
11	11		Committee to add text on any matter which is not included in either
12	12		the House or Senate version of the bill to read as follows:
13	13		SECTION 4. DEPARTMENT OF STATE HEALTH SERVICES: COVID-19
14	14		SERVICES. (a) The amount of $2,000,000,000 is appropriated to the
15	15		Department of State Health Services from money received by this
16	16		state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
17	17		Section 802) established under the American Rescue Plan Act of 2021
18	18		(Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
19	19		Relief Fund No. 325 during the period beginning on the effective
20	20		date of this Act and ending January 1, 2023, for the following
21	21		purposes related to costs incurred during the period beginning
22	22		March 3, 2021, and ending January 1, 2023, due to the coronavirus
23	23		disease pandemic:
24	24		(1) providing funding for surge staffing at state and
25	25		local hospitals, long-term care facilities, psychiatric hospitals,
26	26		and nursing facilities;
27	27		(2) purchasing therapeutic drugs, including drugs for
28	28		monoclonal antibody treatments; and
29	29		(3) providing funding for the operation of regional
30	30		infusion centers.
31	31		(b) Notwithstanding Section 13.05, page IX-64, Chapter 1053
32	32		(S.B. 1), Acts of the 87th Legislature, Regular Session, 2021 (the
33	33		General Appropriations Act), the Department of State Health
34	34		Services shall expend any Coronavirus State Fiscal Recovery Funds
35	35		freed-up as a result of reimbursements received by the Department
36	36		of State Health Services from the Federal Emergency Management
37	37		Agency related to expenditures paid from money appropriated under
38	38		Subsection (a) of this section only after prior approval of the
39	39		Legislative Budget Board.
40	40		B. Suspend House Rule 13, Section 9a (4) to allow the Conference
41	41		Committee to add text on any matter which is not included in either
42	42		the House or Senate version of the bill to read as follows:
43	43		SECTION 6. DEPARTMENT OF CRIMINAL JUSTICE: COMPENSATION.
44	44		(a) The amount of $359,673,191 is appropriated to the Department of
45	45		Criminal Justice from money received by this state from the
46	46		Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
47	47		established under the American Rescue Plan Act of 2021 (Pub. L.
48	48		No. 117-2) and deposited to the credit of the Coronavirus Relief
49	49		Fund No. 325 for the purpose of providing compensation for agency
50	50		employees for the state fiscal year beginning September 1, 2021.
51	51		(b) The Department of Criminal Justice shall:
52	52		(1) in consultation with the comptroller of public
53	53		accounts and the Legislative Budget Board, determine the proper
54	54		allocation of benefits included in the appropriations made under
55	55		Subsection (a) of this section; and
56	56		(2) identify the strategies and objectives for which
57	57		the appropriations made under Subsection (a) of this section are
58	58		directed.
59	59		(c) It is the intent of the legislature that the Department
60	60		of Criminal Justice consider the appropriations as a change in the
61	61		method of finance of the compensation to be paid to agency employees
62	62		and not as an increase in total appropriations to the agency.
63	63		C. Suspend House Rule 13, Section 9a (4) to allow the Conference
64	64		Committee to add text on any matter which is not included in either
65	65		the House or Senate version of the bill to read as follows:
66	66		SECTION 8. HIGHER EDUCATION COORDINATING BOARD: TEXAS
67	67		CHILD MENTAL HEALTH CARE CONSORTIUM. (a) The amount of
68	68		$113,082,887 is appropriated to the Higher Education Coordinating
69	69		Board from money received by this state from the Coronavirus State
70	70		Fiscal Recovery Fund (42 U.S.C. Section 802) established under the
71	71		American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
72	72		to the credit of the Coronavirus Relief Fund No. 325 for the purpose
73	73		of supporting the operations and expansion of the Texas Child
74	74		Mental Health Care Consortium to expand mental health initiatives
75	75		for children, pregnant women, and women who are up to one year
76	76		postpartum during the two-year period beginning on the effective
77	77		date of this Act. At the direction of the Texas Child Mental Health
78	78		Care Consortium, the Higher Education Coordinating Board shall
79	79		transfer appropriations through interagency contracts with
80	80		health-related institutions of higher education for the following
81	81		purposes:
82	82		(1) $20,578,442 for enhancements and expansion of the
83	83		Child Psychiatry Access Network;
84	84		(2) $56,218,976 for enhancements and expansion of the
85	85		Texas Child Access Through Telemedicine program;
86	86		(3) $32,991,791 for expansion of the child and
87	87		adolescent mental health workforce; and
88	88		(4) $3,293,676 for administrative expenses.
89	89		(b) Not later than December 1, 2021, out of money
90	90		appropriated by Subsection (a) of this section, the Higher
91	91		Education Coordinating Board shall transfer $3,293,676 to an
92	92		institution of higher education designated by the Texas Child
93	93		Mental Health Care Consortium for oversight and evaluation of the
94	94		outlined initiatives by means of interagency agreements or any
95	95		other necessary contracts.
96	96		(c) The Texas Child Mental Health Care Consortium may
97	97		transfer up to 10 percent of money appropriated for the purposes
98	98		described by Subsection (a)(1), (2), or (3) of this section to any
99	99		of the other purposes described by those provisions. The Texas
100	100		Child Mental Health Care Consortium may transfer more than 10
101	101		percent of funds for those purposes only with the prior approval for
102	102		the transfer and expenditure from the Legislative Budget Board. A
103	103		request for approval of the transfer and expenditure by the
104	104		consortium is considered approved unless the Legislative Budget
105	105		Board issues a written disapproval within 10 business days of the
106	106		receipt and review of the request by the Legislative Budget Board.
107	107		(d) Out of money appropriated by Subsection (a) of this
108	108		section, the Texas Child Mental Health Care Consortium may enhance
109	109		the Child Psychiatry Access Network to improve perinatal mental
110	110		health services.
111	111		D. Suspend House Rule 13, Section 9a (4) to allow the Conference
112	112		Committee to add text on any matter which is not included in either
113	113		the House or Senate version of the bill to read as follows:
114	114		SECTION 10. HIGHER EDUCATION COORDINATING BOARD:
115	115		UNIVERSITY CONSTRUCTION. (a) Contingent on legislation by the
116	116		87th Legislature, 3rd Called Session, 2021, relating to the
117	117		issuance of tuition revenue bonds, becoming law, the amount of
118	118		$325,000,000 is appropriated to the Higher Education Coordinating
119	119		Board from money received by this state from the Coronavirus State
120	120		Fiscal Recovery Fund (42 U.S.C. Section 802) established under the
121	121		American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
122	122		to the credit of the Coronavirus Relief Fund No. 325 for the purpose
123	123		of university construction during the two-year period beginning on
124	124		the effective date of this Act.
125	125		(b) If an appropriation made under Subsection (a) of this
126	126		section for any reason is determined by the United States
127	127		Department of the Treasury or any other qualified state or federal
128	128		authority to have been made for an improper use:
129	129		(1) the appropriated money may not be spent and shall
130	130		be retained in the treasury and available for later legislative
131	131		appropriation; and
132	132		(2) an amount equal to the amount of the appropriation
133	133		that was determined to have been made for an improper use is
134	134		appropriated from the general revenue fund to the Higher Education
135	135		Coordinating Board for the purpose and period described by
136	136		Subsection (a) of this section.
137	137		E. Suspend House Rule 13, Section 9a (4) to allow the Conference
138	138		Committee to add text on any matter which is not included in either
139	139		the House or Senate version of the bill to read as follows:
140	140		SECTION 16. DEPARTMENT OF STATE HEALTH SERVICES: RIO
141	141		GRANDE VALLEY. The amount of $16,700,000 is appropriated to the
142	142		Department of State Health Services from money received by this
143	143		state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
144	144		Section 802) established under the American Rescue Plan Act of 2021
145	145		(Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
146	146		Relief Fund No. 325 for the purpose of upgrading existing
147	147		laboratory facilities associated with a level 1 trauma facility in
148	148		Hidalgo County and new laboratory infrastructure in Starr County
149	149		during the two-year period beginning on the effective date of this
150	150		Act.
151	151		F. Suspend House Rule 13, Section 9a (4) to allow the Conference
152	152		Committee to add text on any matter which is not included in either
153	153		the House or Senate version of the bill to read as follows:
154	154		SECTION 25. DEPARTMENT OF INFORMATION RESOURCES:
155	155		CYBERSECURITY PROJECTS. (a) The amount of $200,000,000 is
156	156		appropriated to the Department of Information Resources for deposit
157	157		into the Technology Improvement and Modernization Fund No. 187 and
158	158		for use during the two-year period beginning on the effective date
159	159		of this Act for the purpose of cybersecurity projects from money
160	160		received by this state from the Coronavirus State Fiscal Recovery
161	161		Fund (42 U.S.C. Section 802) established under the American Rescue
162	162		Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
163	163		the Coronavirus Relief Fund No. 325. Before spending money
164	164		appropriated under this subsection, the department must receive
165	165		approval for the proposed cybersecurity projects from the Joint
166	166		Oversight Committee on Investment in Information Technology
167	167		Improvement and Modernization Projects established under Section
168	168		2054.578, Government Code.
169	169		(b) The capital budget authority of the Department of
170	170		Information Resources in Chapter 1053 (S.B. 1), Acts of the 87th
171	171		Legislature, Regular Session, 2021 (the General Appropriations
172	172		Act), is increased by $200,000,000 for the appropriation made under
173	173		Subsection (a) of this section.
174	174		G. Suspend House Rule 13, Section 9b (4) to allow the Conference
175	175		Committee to exceed the amount of an item of appropriation
176	176		contained in one version of the bill to read as follows:
177	177		SECTION 31. DEPARTMENT OF TRANSPORTATION: PRESIDIO CUSTOMS
178	178		INSPECTION STATION. The amount of $15,500,000 is appropriated to
179	179		the Department of Transportation from money received by this state
180	180		from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
181	181		802) established under the American Rescue Plan Act of 2021 (Pub. L.
182	182		No. 117-2) and deposited to the credit of the Coronavirus Relief
183	183		Fund No. 325 for the purpose of providing funding for a customs
184	184		inspection station on the South Orient Rail Line in Presidio,
185	185		Texas, during the two-year period beginning on the effective date
186	186		of this Act.
187	187		H. Suspend House Rule 13, Section 9a (4) to allow the Conference
188	188		Committee to add text on any matter which is not included in either
189	189		the House or Senate version of the bill to read as follows:
190	190		SECTION 32. TEACHER RETIREMENT SYSTEM: TRS-CARE AND
191	191		TRS-ACTIVECARE. (a) The amount of $286,337,761 is appropriated to
192	192		the Teacher Retirement System from money received by this state
193	193		from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
194	194		802) established under the American Rescue Plan Act of 2021 (Pub. L.
195	195		No. 117-2) and deposited to the credit of the Coronavirus Relief
196	196		Fund No. 325 for the purpose of providing funding during the
197	197		two-year period beginning on the effective date of this Act for
198	198		coronavirus-related claims in TRS-Care and TRS-ActiveCare.
199	199		(b) It is the intent of the legislature that premiums for
200	200		TRS-Care and TRS-ActiveCare insurance policies not increase as a
201	201		result of coronavirus-related claims.
202	202		(c) Notwithstanding Subsection (b) of this section, it is
203	203		the intent of the legislature that the premiums for TRS-Care and
204	204		TRS-ActiveCare programs be calculated and adjusted taking into
205	205		consideration the money appropriated under this section.
206	206		I. Suspend House Rule 13, Section 9a (4) to allow the Conference
207	207		Committee to add text on any matter which is not included in either
208	208		the House or Senate version of the bill to read as follows:
209	209		SECTION 33. HEALTH AND HUMAN SERVICES COMMISSION: STAFFING
210	210		NEEDS. (a) The amount of $378,300,000 is appropriated to the
211	211		Health and Human Services Commission from money received by this
212	212		state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
213	213		Section 802) established under the American Rescue Plan Act of 2021
214	214		(Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
215	215		Relief Fund No. 325 for the purpose of providing funding during the
216	216		two-year period beginning on the effective date of this Act for the
217	217		Health and Human Services Commission to administer one-time grants
218	218		related to providing critical staffing needs resulting from
219	219		frontline health care workers affected by COVID-19, including
220	220		recruitment and retention bonuses for staff:
221	221		(1) of nursing facilities, assisted living
222	222		facilities, home health agencies, and facilities that serve persons
223	223		with intellectual or developmental disabilities in an intermediate
224	224		care facility for individuals with intellectual disabilities or
225	225		related conditions (ICF/IID); or
226	226		(2) who provide community attendant services.
227	227		(b) It is the intent of the legislature that the Health and
228	228		Human Services Commission prioritize grants to grantees that comply
229	229		with the reporting requirements prescribed by Rider 143 (Health and
230	230		Human Services Commission), Chapter 1053 (S.B. 1), Acts of the 87th
231	231		Legislature, Regular Session, 2021 (the General Appropriations
232	232		Act), the reporting requirements established by Chapter 588 (S.B.
233	233		809), Acts of the 87th Legislature, 2021, or equivalent reporting
234	234		requirements established by the Health and Human Services
235	235		Commission.
236	236		(c) Annually, the Health and Human Services Commission
237	237		shall report to the Legislative Budget Board the grants awarded
238	238		under this section. The report must include, for the year covered
239	239		by the report, the amount of grants awarded, the award recipients,
240	240		and the total amount of each grant used by the recipient. The
241	241		report must be submitted to the Legislative Budget Board not later
242	242		than December 1 of the year in which the report is due.
243	243		(d) Of the amount appropriated under Subsection (a) of this
244	244		section:
245	245		(1) $200,000,000 shall be used only for grants for
246	246		nursing facilities; and
247	247		(2) $178,300,000 shall be used only for grants for
248	248		assisted living facilities, home health agencies, community
249	249		attendants, and facilities that serve persons with intellectual or
250	250		developmental disabilities in an intermediate care facility for
251	251		individuals with intellectual disabilities or related conditions
252	252		(ICF/IID).
253	253		(e) It is the intent of the legislature that the Health and
254	254		Human Services Commission consider federal COVID-19 relief money
255	255		received by providers when allocating the money described by
256	256		Subsection (d)(2) of this section.
257	257		J. Suspend House Rule 13, Section 9b (4) to allow the Conference
258	258		Committee to exceed the amount of an item of appropriation
259	259		contained in one version of the bill to read as follows:
260	260		SECTION 34. DEPARTMENT OF STATE HEALTH SERVICES: FEDERALLY
261	261		QUALIFIED HEALTH CENTER INCUBATOR PROGRAM. The amount of
262	262		$20,000,000 is appropriated to the Department of State Health
263	263		Services from money received by this state from the Coronavirus
264	264		State Fiscal Recovery Fund (42 U.S.C. Section 802) established
265	265		under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
266	266		deposited to the credit of the Coronavirus Relief Fund No. 325 for
267	267		use during the two-year period beginning on the effective date of
268	268		this Act for the Federally Qualified Health Center Incubator
269	269		Program.
270	270		K. Suspend House Rule 13, Section 9b (5) to allow the Conference
271	271		Committee to add an item of appropriation that is not in either
272	272		version of the bill to read as follows; Suspend House Rule 13,
273	273		Section 9a (4) to allow the Conference Committee to add text on any
274	274		matter which is not included in either the House or Senate version
275	275		of the bill to read as follows:
276	276		SECTION 35. DEPARTMENT OF STATE HEALTH SERVICES: EMERGENCY
277	277		MEDICAL SERVICES. (a) The amount of $21,700,000 is appropriated to
278	278		the Department of State Health Services from money received by this
279	279		state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
280	280		Section 802) established under the American Rescue Plan Act of 2021
281	281		(Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
282	282		Relief Fund No. 325 for the purpose of providing funding for
283	283		emergency medical response service staffing, including:
284	284		(1) funding for programs to incentivize and increase
285	285		the number of Emergency Medical Technicians (EMTs) and paramedics
286	286		that provide care on an ambulance, including funding for emergency
287	287		medical services workforce development initiatives at regional
288	288		advisory councils; and
289	289		(2) funding for Emergency Medical Services (EMS)
290	290		education programs, including distance learning programs, to
291	291		increase the number of EMTs and paramedics graduating from EMS
292	292		education programs.
293	293		(b) It is the intent of the legislature that, consistent
294	294		with state law, the Department of State Health Services prioritize
295	295		funding appropriated under Subsection (a) of this section for rural
296	296		and underserved areas.
297	297		L. Suspend House Rule 13, Section 9a (4) to allow the Conference
298	298		Committee to add text on any matter which is not included in either
299	299		the House or Senate version of the bill to read as follows:
300	300		SECTION 36. PARKS AND WILDLIFE DEPARTMENT: EDUCATION AND
301	301		OUTREACH GRANTS. The amount of $40,000,000 is appropriated to the
302	302		Parks and Wildlife Department from money received by this state
303	303		from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
304	304		802) established under the American Rescue Plan Act of 2021 (Pub. L.
305	305		No. 117-2) and deposited to the credit of the Coronavirus Relief
306	306		Fund No. 325 to be used during the two-year period beginning on the
307	307		effective date of this Act for the purpose of providing funding for
308	308		grants throughout this state as authorized by other law and
309	309		consistent with Strategy C.2.1., Outreach and Education, as listed
310	310		in Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
311	311		Session, 2021 (the General Appropriations Act).
312	312		M. Suspend House Rule 13, Section 9b (5) to allow the Conference
313	313		Committee to add an item of appropriation that is not in either
314	314		version of the bill to read as follows; Suspend House Rule 13,
315	315		Section 9a (4) to allow the Conference Committee to add text on any
316	316		matter which is not included in either the House or Senate version
317	317		of the bill to read as follows:
318	318		SECTION 39. TEXAS A&M UNIVERSITY: INSTITUTE FOR A DISASTER
319	319		RESILIENT TEXAS. (a) The amount of $1,150,000 is appropriated to
320	320		Texas A&M University - Galveston from money received by this state
321	321		from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
322	322		802) established under the American Rescue Plan Act of 2021 (Pub. L.
323	323		No. 117-2) and deposited to the credit of the Coronavirus Relief
324	324		Fund No. 325 for the purpose of providing funding to the Institute
325	325		for a Disaster Resilient Texas.
326	326		(b) Out of amounts appropriated by Subsection (a) of this
327	327		section:
328	328		(1) $1,000,000 may be used only for Digital Flood Risk
329	329		Infrastructure for Underserved Communities; and
330	330		(2) $150,000 may be used only for office space in
331	331		Houston.
332	332		N. Suspend House Rule 13, Section 9b (5) to allow the Conference
333	333		Committee to add an item of appropriation that is not in either
334	334		version of the bill to read as follows; Suspend House Rule 13,
335	335		Section 9a (4) to allow the Conference Committee to add text on any
336	336		matter which is not included in either the House or Senate version
337	337		of the bill to read as follows:
338	338		SECTION 40. TEXAS TECH UNIVERSITY AND UNIVERSITY OF
339	339		HOUSTON: INSTITUTIONAL ENHANCEMENTS. The amount of $100,000,000
340	340		is appropriated from money received by this state from the
341	341		Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
342	342		established under the American Rescue Plan Act of 2021 (Pub. L.
343	343		No. 117-2) and deposited to the credit of the Coronavirus Relief
344	344		Fund No. 325 for institutional enhancement during the two-year
345	345		period beginning on the effective date of this Act to the following
346	346		entities and in the following amounts:
347	347		(1) $50,000,000 to Texas Tech University; and
348	348		(2) $50,000,000 to the University of Houston.
349	349		O. Suspend House Rule 13, Section 9b (5) to allow the Conference
350	350		Committee to add an item of appropriation that is not in either
351	351		version of the bill to read as follows; Suspend House Rule 13,
352	352		Section 9a (4) to allow the Conference Committee to add text on any
353	353		matter which is not included in either the House or Senate version
354	354		of the bill to read as follows:
355	355		SECTION 41. COMPTROLLER OF PUBLIC ACCOUNTS: TEXAS SAFE
356	356		KEEPING TRUST FUND. (a) The amount of $100,000,000 is appropriated
357	357		to the comptroller of public accounts from money received by this
358	358		state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
359	359		Section 802) established under the American Rescue Plan Act of 2021
360	360		(Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
361	361		Relief Fund No. 325 for immediate deposit to an account or fund to
362	362		be managed by the Texas Treasury Safekeeping Trust Company as
363	363		trustee for the benefit of the State Preservation Board to maintain
364	364		the Bob Bullock State History Museum.
365	365		(b) If an appropriation made under Subsection (a) of this
366	366		section for any reason is determined by the United States
367	367		Department of the Treasury or any other qualified state or federal
368	368		authority to have been made for an improper use:
369	369		(1) the appropriated money may not be spent and shall
370	370		be retained in the treasury and available for later legislative
371	371		appropriation; and
372	372		(2) an amount equal to the amount of the appropriation

374	374		appropriated from the general revenue fund to the comptroller of

377	377		P. Suspend House Rule 13, Section 9b (5) to allow the Conference
378	378		Committee to add an item of appropriation that is not in either
379	379		version of the bill to read as follows; Suspend House Rule 13,
380	380		Section 9a (4) to allow the Conference Committee to add text on any
381	381		matter which is not included in either the House or Senate version
382	382		of the bill to read as follows:
383	383		SECTION 42. PARKS AND WILDLIFE DEPARTMENT: TEXAS STATE
384	384		AQUARIUM CENTER. The amount of $3,000,000 is appropriated to the
385	385		Parks and Wildlife Department from money received by this state
386	386		from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
387	387		802) established under the American Rescue Plan Act of 2021 (Pub. L.
388	388		No. 117-2) and deposited to the credit of the Coronavirus Relief
389	389		Fund No. 325 for the purpose of providing funding to the Texas State
390	390		Aquarium Center for wildlife research during the two-year period
391	391		beginning on the effective date of this Act.
392	392		Q. Suspend House Rule 13, Section 9b (5) to allow the Conference
393	393		Committee to add an item of appropriation that is not in either
394	394		version of the bill to read as follows; Suspend House Rule 13,
395	395		Section 9a (4) to allow the Conference Committee to add text on any
396	396		matter which is not included in either the House or Senate version
397	397		of the bill to read as follows:
398	398		SECTION 43. UNIVERSITY OF TEXAS AT AUSTIN: MARINE SCIENCE
399	399		INSTITUTE HOUSING REPLACEMENT. The amount of $3,000,000 is
400	400		appropriated to the University of Texas at Austin from money
401	401		received by this state from the Coronavirus State Fiscal Recovery

451	451		funding for the rural veterinarians grant program for the two-year
452	452		period beginning on the effective date of this Act.

459	459		SECTION 47. STATE PRESERVATION BOARD: MAINTENANCE AND
460	460		CAPITAL IMPROVEMENT PROJECTS. (a) The amount of $25,000,000 is
461	461		appropriated to the State Preservation Board from money received by
462	462		this state from the Coronavirus State Fiscal Recovery Fund (42
463	463		U.S.C. Section 802) established under the American Rescue Plan Act
464	464		of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
465	465		Coronavirus Relief Fund No. 325 for the purpose of maintenance and
466	466		capital improvement projects during the state fiscal biennium
467	467		beginning September 1, 2021.
468	468		(b) The capital budget authority of the State Preservation
469	469		Board in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
470	470		Regular Session, 2021 (the General Appropriations Act), is
471	471		increased by $25,000,000 for the appropriation made under
472	472		Subsection (a) of this section.
473	473		V. Suspend House Rule 13, Section 9a (4) to allow the Conference
474	474		Committee to add text on any matter which is not included in either
475	475		the House or Senate version of the bill to read as follows:
476	476		SECTION 48. DEPARTMENT OF STATE HEALTH SERVICES AND HEALTH
477	477		AND HUMAN SERVICES COMMISSION: FEDERAL FUNDS FOR HOSPITALS. It is
478	478		the intent of the Legislature that the Department of State Health
479	479		Services and the Health and Human Services Commission, in
480	480		distributing any money received from the Coronavirus State Fiscal
481	481		Recovery Fund (42 U.S.C. Section 802) established under the
482	482		American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
483	483		to the credit of the Coronavirus Relief Fund No. 325 distribute the
484	484		money appropriated by this Act to entities that are subject to the
485	485		hospital price transparency public disclosure requirements
486	486		required by 45 C.F.R. Sections 180.10 - 180.60 and, on
487	487		implementation of rules adopted under the chapter, by Chapter 327,
488	488		Health and Safety Code.
489	489		W. Suspend House Rule 13, Section 9a (4) to allow the Conference
490	490		Committee to add text on any matter which is not included in either
491	491		the House or Senate version of the bill to read as follows:
492	492		SECTION 49. REPORT ON FEDERAL FUNDS BY LEGISLATIVE BUDGET
493	493		BOARD. (a) The Legislative Budget Board, in consultation with the
494	494		comptroller of public accounts, shall report on the board's
495	495		Internet website:
496	496		(1) for each political subdivision in this state, an
497	497		informational listing of any money appropriated by this Act and
498	498		received by the subdivision; and
499	499		(2) for each state agency and each institution of
500	500		higher education that receives money appropriated by this Act, an
501	501		informational listing of the following:
502	502		(A) the amount of money received by the agency or
503	503		institution;
504	504		(B) the federal legislation that authorized
505	505		distribution of the money to the state, agency, or institution and
506	506		the state legislation, if applicable, that appropriated the money
507	507		to the agency or institution;
508	508		(C) the amount of money spent by the agency or
509	509		institution;
510	510		(D) the allowable uses for which the agency or
511	511		institution may spend money received by the agency or institution
512	512		and the purposes for which the agency or institution has spent the
513	513		money;
514	514		(E) the amount of money received by the agency or
515	515		institution:
516	516		(i) that the agency or institution has not
517	517		spent; and
518	518		(ii) that the agency or institution may
519	519		spend without further appropriation; and
520	520		(F) the time during which money received by the
521	521		agency or institution was spent by the agency or institution,
522	522		including the remaining time in which the agency or institution may
523	523		spend the money without further appropriation.
524	524		(b) This section does not apply to a hospital licensed under
525	525		Chapter 241, Health and Safety Code, or a hospital owned and
526	526		operated by this state.
527	527		(c) It is the intent of the legislature that information
528	528		required to be provided in a report on the Legislative Budget
529	529		Board's Internet website under Subsection (a) of this section must
530	530		be updated not less than once during each fiscal quarter and once on
531	531		the first day of each fiscal quarter that occurs on or after
532	532		December 1, 2021, until at least December 1, 2028.
533	533		X. Suspend House Rule 13, Section 9a (4) to allow the Conference
534	534		Committee to add text on any matter which is not included in either
535	535		the House or Senate version of the bill to read as follows:
536	536		SECTION 50. LEGISLATIVE INTENT REGARDING APPROPRIATIONS.
537	537		(a) It is the intent of the legislature that the appropriations
538	538		made by this Act:
539	539		(1) are one-time appropriations made for the purpose
540	540		of addressing the needs of this state for the two-year period
541	541		beginning on the effective date of this Act; and
542	542		(2) be used:
543	543		(A) only for purposes authorized by state and
544	544		federal law, including guidance issued by the United States
545	545		Department of the Treasury in 86 Fed. Reg. 26786 (May 17, 2021); and
546	546		(B) before all other methods of finance, if more
547	547		than one method of finance is available for the applicable purpose.
548	548		(b) Except as specifically provided otherwise by this Act,
549	549		it is the intent of the legislature that, if the United States
550	550		Department of the Treasury or any other qualified state or federal
551	551		authority determines that an appropriation made by this Act has
552	552		been made for an improper use, the appropriated money not be spent
553	553		and shall be retained in the treasury and available for later
554	554		legislative appropriation.
555	555		Y. Suspend House Rule 13, Section 9a (4) to allow the Conference
556	556		Committee to add text on any matter which is not included in either
557	557		the House or Senate version of the bill to read as follows:
558	558		SECTION 51. APPROPRIATION AUTHORITY UNDER FEDERAL LAW. The
559	559		appropriations made under Sections 2, 3, 6, 7, 8, 9, 10, 11, 12, 13,
560	560		14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30,
561	561		31, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, and 47 of this
562	562		Act using money received by this state from the Coronavirus State
563	563		Fiscal Recovery Fund (42 U.S.C. Section 802) established under the

565	565		accordance with 42 U.S.C. Section 802(c)(1)(C), which allows money
566	566		from the Coronavirus State Fiscal Recovery Fund to be used to
567	567		provide government services to the extent of a reduction in the
568	568		revenue of a state government caused by the COVID-19 public health
569	569		emergency relative to revenues collected in the most recent full
570	570		fiscal year of the state government that ended before that
571	571		emergency.
