55 BE IT RESOLVED, BY THE House of Representatives of the State
66 of Texas, that House Rule 13, Section 9, be suspended in part as
77 provided by House Rule 13, Section 9(f) to enable consideration of,
88 and action on, the following specific matters which may be
99 contained in the Conference Committee Report on Senate Bill 8.
1010 A. Suspend House Rule 13, Section 9a (4) to allow the Conference
1111 Committee to add text on any matter which is not included in either
1212 the House or Senate version of the bill to read as follows:
1313 SECTION 4. DEPARTMENT OF STATE HEALTH SERVICES: COVID-19
1414 SERVICES. (a) The amount of $2,000,000,000 is appropriated to the
1515 Department of State Health Services from money received by this
1616 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
1717 Section 802) established under the American Rescue Plan Act of 2021
1818 (Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
1919 Relief Fund No. 325 during the period beginning on the effective
2020 date of this Act and ending January 1, 2023, for the following
2121 purposes related to costs incurred during the period beginning
2222 March 3, 2021, and ending January 1, 2023, due to the coronavirus
2323 disease pandemic:
2424 (1) providing funding for surge staffing at state and
2525 local hospitals, long-term care facilities, psychiatric hospitals,
2626 and nursing facilities;
2727 (2) purchasing therapeutic drugs, including drugs for
2828 monoclonal antibody treatments; and
2929 (3) providing funding for the operation of regional
3030 infusion centers.
3131 (b) Notwithstanding Section 13.05, page IX-64, Chapter 1053
3232 (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021 (the
3333 General Appropriations Act), the Department of State Health
3434 Services shall expend any Coronavirus State Fiscal Recovery Funds
3535 freed-up as a result of reimbursements received by the Department
3636 of State Health Services from the Federal Emergency Management
3737 Agency related to expenditures paid from money appropriated under
3838 Subsection (a) of this section only after prior approval of the
3939 Legislative Budget Board.
4040 B. Suspend House Rule 13, Section 9a (4) to allow the Conference
4141 Committee to add text on any matter which is not included in either
4242 the House or Senate version of the bill to read as follows:
4343 SECTION 6. DEPARTMENT OF CRIMINAL JUSTICE: COMPENSATION.
4444 (a) The amount of $359,673,191 is appropriated to the Department of
4545 Criminal Justice from money received by this state from the
4646 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
4747 established under the American Rescue Plan Act of 2021 (Pub. L.
4848 No. 117-2) and deposited to the credit of the Coronavirus Relief
4949 Fund No. 325 for the purpose of providing compensation for agency
5050 employees for the state fiscal year beginning September 1, 2021.
5151 (b) The Department of Criminal Justice shall:
5252 (1) in consultation with the comptroller of public
5353 accounts and the Legislative Budget Board, determine the proper
5454 allocation of benefits included in the appropriations made under
5555 Subsection (a) of this section; and
5656 (2) identify the strategies and objectives for which
5757 the appropriations made under Subsection (a) of this section are
5858 directed.
5959 (c) It is the intent of the legislature that the Department
6060 of Criminal Justice consider the appropriations as a change in the
6161 method of finance of the compensation to be paid to agency employees
6262 and not as an increase in total appropriations to the agency.
6363 C. Suspend House Rule 13, Section 9a (4) to allow the Conference
6464 Committee to add text on any matter which is not included in either
6565 the House or Senate version of the bill to read as follows:
6666 SECTION 8. HIGHER EDUCATION COORDINATING BOARD: TEXAS
6767 CHILD MENTAL HEALTH CARE CONSORTIUM. (a) The amount of
6868 $113,082,887 is appropriated to the Higher Education Coordinating
6969 Board from money received by this state from the Coronavirus State
7070 Fiscal Recovery Fund (42 U.S.C. Section 802) established under the
7171 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
7272 to the credit of the Coronavirus Relief Fund No. 325 for the purpose
7373 of supporting the operations and expansion of the Texas Child
7474 Mental Health Care Consortium to expand mental health initiatives
7575 for children, pregnant women, and women who are up to one year
7676 postpartum during the two-year period beginning on the effective
7777 date of this Act. At the direction of the Texas Child Mental Health
7878 Care Consortium, the Higher Education Coordinating Board shall
7979 transfer appropriations through interagency contracts with
8080 health-related institutions of higher education for the following
8181 purposes:
8282 (1) $20,578,442 for enhancements and expansion of the
8383 Child Psychiatry Access Network;
8484 (2) $56,218,976 for enhancements and expansion of the
8585 Texas Child Access Through Telemedicine program;
8686 (3) $32,991,791 for expansion of the child and
8787 adolescent mental health workforce; and
8888 (4) $3,293,676 for administrative expenses.
8989 (b) Not later than December 1, 2021, out of money
9090 appropriated by Subsection (a) of this section, the Higher
9191 Education Coordinating Board shall transfer $3,293,676 to an
9292 institution of higher education designated by the Texas Child
9393 Mental Health Care Consortium for oversight and evaluation of the
9494 outlined initiatives by means of interagency agreements or any
9595 other necessary contracts.
9696 (c) The Texas Child Mental Health Care Consortium may
9797 transfer up to 10 percent of money appropriated for the purposes
9898 described by Subsection (a)(1), (2), or (3) of this section to any
9999 of the other purposes described by those provisions. The Texas
100100 Child Mental Health Care Consortium may transfer more than 10
101101 percent of funds for those purposes only with the prior approval for
102102 the transfer and expenditure from the Legislative Budget Board. A
103103 request for approval of the transfer and expenditure by the
104104 consortium is considered approved unless the Legislative Budget
105105 Board issues a written disapproval within 10 business days of the
106106 receipt and review of the request by the Legislative Budget Board.
107107 (d) Out of money appropriated by Subsection (a) of this
108108 section, the Texas Child Mental Health Care Consortium may enhance
109109 the Child Psychiatry Access Network to improve perinatal mental
110110 health services.
111111 D. Suspend House Rule 13, Section 9a (4) to allow the Conference
112112 Committee to add text on any matter which is not included in either
113113 the House or Senate version of the bill to read as follows:
114114 SECTION 10. HIGHER EDUCATION COORDINATING BOARD:
115115 UNIVERSITY CONSTRUCTION. (a) Contingent on legislation by the
116116 87th Legislature, 3rd Called Session, 2021, relating to the
117117 issuance of tuition revenue bonds, becoming law, the amount of
118118 $325,000,000 is appropriated to the Higher Education Coordinating
119119 Board from money received by this state from the Coronavirus State
120120 Fiscal Recovery Fund (42 U.S.C. Section 802) established under the
121121 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
122122 to the credit of the Coronavirus Relief Fund No. 325 for the purpose
123123 of university construction during the two-year period beginning on
124124 the effective date of this Act.
125125 (b) If an appropriation made under Subsection (a) of this
126126 section for any reason is determined by the United States
127127 Department of the Treasury or any other qualified state or federal
128128 authority to have been made for an improper use:
129129 (1) the appropriated money may not be spent and shall
130130 be retained in the treasury and available for later legislative
131131 appropriation; and
132132 (2) an amount equal to the amount of the appropriation
133133 that was determined to have been made for an improper use is
134134 appropriated from the general revenue fund to the Higher Education
135135 Coordinating Board for the purpose and period described by
136136 Subsection (a) of this section.
137137 E. Suspend House Rule 13, Section 9a (4) to allow the Conference
138138 Committee to add text on any matter which is not included in either
139139 the House or Senate version of the bill to read as follows:
140140 SECTION 16. DEPARTMENT OF STATE HEALTH SERVICES: RIO
141141 GRANDE VALLEY. The amount of $16,700,000 is appropriated to the
142142 Department of State Health Services from money received by this
143143 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
144144 Section 802) established under the American Rescue Plan Act of 2021
145145 (Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
146146 Relief Fund No. 325 for the purpose of upgrading existing
147147 laboratory facilities associated with a level 1 trauma facility in
148148 Hidalgo County and new laboratory infrastructure in Starr County
149149 during the two-year period beginning on the effective date of this
150150 Act.
151151 F. Suspend House Rule 13, Section 9a (4) to allow the Conference
152152 Committee to add text on any matter which is not included in either
153153 the House or Senate version of the bill to read as follows:
154154 SECTION 25. DEPARTMENT OF INFORMATION RESOURCES:
155155 CYBERSECURITY PROJECTS. (a) The amount of $200,000,000 is
156156 appropriated to the Department of Information Resources for deposit
157157 into the Technology Improvement and Modernization Fund No. 187 and
158158 for use during the two-year period beginning on the effective date
159159 of this Act for the purpose of cybersecurity projects from money
160160 received by this state from the Coronavirus State Fiscal Recovery
161161 Fund (42 U.S.C. Section 802) established under the American Rescue
162162 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
163163 the Coronavirus Relief Fund No. 325. Before spending money
164164 appropriated under this subsection, the department must receive
165165 approval for the proposed cybersecurity projects from the Joint
166166 Oversight Committee on Investment in Information Technology
167167 Improvement and Modernization Projects established under Section
168168 2054.578, Government Code.
169169 (b) The capital budget authority of the Department of
170170 Information Resources in Chapter 1053 (S.B. 1), Acts of the 87th
171171 Legislature, Regular Session, 2021 (the General Appropriations
172172 Act), is increased by $200,000,000 for the appropriation made under
173173 Subsection (a) of this section.
174174 G. Suspend House Rule 13, Section 9b (4) to allow the Conference
175175 Committee to exceed the amount of an item of appropriation
176176 contained in one version of the bill to read as follows:
177177 SECTION 31. DEPARTMENT OF TRANSPORTATION: PRESIDIO CUSTOMS
178178 INSPECTION STATION. The amount of $15,500,000 is appropriated to
179179 the Department of Transportation from money received by this state
180180 from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
181181 802) established under the American Rescue Plan Act of 2021 (Pub. L.
182182 No. 117-2) and deposited to the credit of the Coronavirus Relief
183183 Fund No. 325 for the purpose of providing funding for a customs
184184 inspection station on the South Orient Rail Line in Presidio,
185185 Texas, during the two-year period beginning on the effective date
186186 of this Act.
187187 H. Suspend House Rule 13, Section 9a (4) to allow the Conference
188188 Committee to add text on any matter which is not included in either
189189 the House or Senate version of the bill to read as follows:
190190 SECTION 32. TEACHER RETIREMENT SYSTEM: TRS-CARE AND
191191 TRS-ACTIVECARE. (a) The amount of $286,337,761 is appropriated to
192192 the Teacher Retirement System from money received by this state
193193 from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
194194 802) established under the American Rescue Plan Act of 2021 (Pub. L.
195195 No. 117-2) and deposited to the credit of the Coronavirus Relief
196196 Fund No. 325 for the purpose of providing funding during the
197197 two-year period beginning on the effective date of this Act for
198198 coronavirus-related claims in TRS-Care and TRS-ActiveCare.
199199 (b) It is the intent of the legislature that premiums for
200200 TRS-Care and TRS-ActiveCare insurance policies not increase as a
201201 result of coronavirus-related claims.
202202 (c) Notwithstanding Subsection (b) of this section, it is
203203 the intent of the legislature that the premiums for TRS-Care and
204204 TRS-ActiveCare programs be calculated and adjusted taking into
205205 consideration the money appropriated under this section.
206206 I. Suspend House Rule 13, Section 9a (4) to allow the Conference
207207 Committee to add text on any matter which is not included in either
208208 the House or Senate version of the bill to read as follows:
209209 SECTION 33. HEALTH AND HUMAN SERVICES COMMISSION: STAFFING
210210 NEEDS. (a) The amount of $378,300,000 is appropriated to the
211211 Health and Human Services Commission from money received by this
212212 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
213213 Section 802) established under the American Rescue Plan Act of 2021
214214 (Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
215215 Relief Fund No. 325 for the purpose of providing funding during the
216216 two-year period beginning on the effective date of this Act for the
217217 Health and Human Services Commission to administer one-time grants
218218 related to providing critical staffing needs resulting from
219219 frontline health care workers affected by COVID-19, including
220220 recruitment and retention bonuses for staff:
221221 (1) of nursing facilities, assisted living
222222 facilities, home health agencies, and facilities that serve persons
223223 with intellectual or developmental disabilities in an intermediate
224224 care facility for individuals with intellectual disabilities or
225225 related conditions (ICF/IID); or
226226 (2) who provide community attendant services.
227227 (b) It is the intent of the legislature that the Health and
228228 Human Services Commission prioritize grants to grantees that comply
229229 with the reporting requirements prescribed by Rider 143 (Health and
230230 Human Services Commission), Chapter 1053 (S.B. 1), Acts of the 87th
231231 Legislature, Regular Session, 2021 (the General Appropriations
232232 Act), the reporting requirements established by Chapter 588 (S.B.
233233 809), Acts of the 87th Legislature, 2021, or equivalent reporting
234234 requirements established by the Health and Human Services
235235 Commission.
236236 (c) Annually, the Health and Human Services Commission
237237 shall report to the Legislative Budget Board the grants awarded
238238 under this section. The report must include, for the year covered
239239 by the report, the amount of grants awarded, the award recipients,
240240 and the total amount of each grant used by the recipient. The
241241 report must be submitted to the Legislative Budget Board not later
242242 than December 1 of the year in which the report is due.
243243 (d) Of the amount appropriated under Subsection (a) of this
244244 section:
245245 (1) $200,000,000 shall be used only for grants for
246246 nursing facilities; and
247247 (2) $178,300,000 shall be used only for grants for
248248 assisted living facilities, home health agencies, community
249249 attendants, and facilities that serve persons with intellectual or
250250 developmental disabilities in an intermediate care facility for
251251 individuals with intellectual disabilities or related conditions
252252 (ICF/IID).
253253 (e) It is the intent of the legislature that the Health and
254254 Human Services Commission consider federal COVID-19 relief money
255255 received by providers when allocating the money described by
256256 Subsection (d)(2) of this section.
257257 J. Suspend House Rule 13, Section 9b (4) to allow the Conference
258258 Committee to exceed the amount of an item of appropriation
259259 contained in one version of the bill to read as follows:
260260 SECTION 34. DEPARTMENT OF STATE HEALTH SERVICES: FEDERALLY
261261 QUALIFIED HEALTH CENTER INCUBATOR PROGRAM. The amount of
262262 $20,000,000 is appropriated to the Department of State Health
263263 Services from money received by this state from the Coronavirus
264264 State Fiscal Recovery Fund (42 U.S.C. Section 802) established
265265 under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
266266 deposited to the credit of the Coronavirus Relief Fund No. 325 for
267267 use during the two-year period beginning on the effective date of
268268 this Act for the Federally Qualified Health Center Incubator
269269 Program.
270270 K. Suspend House Rule 13, Section 9b (5) to allow the Conference
271271 Committee to add an item of appropriation that is not in either
272272 version of the bill to read as follows; Suspend House Rule 13,
273273 Section 9a (4) to allow the Conference Committee to add text on any
274274 matter which is not included in either the House or Senate version
275275 of the bill to read as follows:
276276 SECTION 35. DEPARTMENT OF STATE HEALTH SERVICES: EMERGENCY
277277 MEDICAL SERVICES. (a) The amount of $21,700,000 is appropriated to
278278 the Department of State Health Services from money received by this
279279 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
280280 Section 802) established under the American Rescue Plan Act of 2021
281281 (Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
282282 Relief Fund No. 325 for the purpose of providing funding for
283283 emergency medical response service staffing, including:
284284 (1) funding for programs to incentivize and increase
285285 the number of Emergency Medical Technicians (EMTs) and paramedics
286286 that provide care on an ambulance, including funding for emergency
287287 medical services workforce development initiatives at regional
288288 advisory councils; and
289289 (2) funding for Emergency Medical Services (EMS)
290290 education programs, including distance learning programs, to
291291 increase the number of EMTs and paramedics graduating from EMS
292292 education programs.
293293 (b) It is the intent of the legislature that, consistent
294294 with state law, the Department of State Health Services prioritize
295295 funding appropriated under Subsection (a) of this section for rural
296296 and underserved areas.
297297 L. Suspend House Rule 13, Section 9a (4) to allow the Conference
298298 Committee to add text on any matter which is not included in either
299299 the House or Senate version of the bill to read as follows:
300300 SECTION 36. PARKS AND WILDLIFE DEPARTMENT: EDUCATION AND
301301 OUTREACH GRANTS. The amount of $40,000,000 is appropriated to the
302302 Parks and Wildlife Department from money received by this state
303303 from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
304304 802) established under the American Rescue Plan Act of 2021 (Pub. L.
305305 No. 117-2) and deposited to the credit of the Coronavirus Relief
306306 Fund No. 325 to be used during the two-year period beginning on the
307307 effective date of this Act for the purpose of providing funding for
308308 grants throughout this state as authorized by other law and
309309 consistent with Strategy C.2.1., Outreach and Education, as listed
310310 in Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
311311 Session, 2021 (the General Appropriations Act).
312312 M. Suspend House Rule 13, Section 9b (5) to allow the Conference
313313 Committee to add an item of appropriation that is not in either
314314 version of the bill to read as follows; Suspend House Rule 13,
315315 Section 9a (4) to allow the Conference Committee to add text on any
316316 matter which is not included in either the House or Senate version
317317 of the bill to read as follows:
318318 SECTION 39. TEXAS A&M UNIVERSITY: INSTITUTE FOR A DISASTER
319319 RESILIENT TEXAS. (a) The amount of $1,150,000 is appropriated to
320320 Texas A&M University - Galveston from money received by this state
321321 from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
322322 802) established under the American Rescue Plan Act of 2021 (Pub. L.
323323 No. 117-2) and deposited to the credit of the Coronavirus Relief
324324 Fund No. 325 for the purpose of providing funding to the Institute
325325 for a Disaster Resilient Texas.
326326 (b) Out of amounts appropriated by Subsection (a) of this
327327 section:
328328 (1) $1,000,000 may be used only for Digital Flood Risk
329329 Infrastructure for Underserved Communities; and
330330 (2) $150,000 may be used only for office space in
331331 Houston.
332332 N. Suspend House Rule 13, Section 9b (5) to allow the Conference
333333 Committee to add an item of appropriation that is not in either
334334 version of the bill to read as follows; Suspend House Rule 13,
335335 Section 9a (4) to allow the Conference Committee to add text on any
336336 matter which is not included in either the House or Senate version
337337 of the bill to read as follows:
338338 SECTION 40. TEXAS TECH UNIVERSITY AND UNIVERSITY OF
339339 HOUSTON: INSTITUTIONAL ENHANCEMENTS. The amount of $100,000,000
340340 is appropriated from money received by this state from the
341341 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
342342 established under the American Rescue Plan Act of 2021 (Pub. L.
343343 No. 117-2) and deposited to the credit of the Coronavirus Relief
344344 Fund No. 325 for institutional enhancement during the two-year
345345 period beginning on the effective date of this Act to the following
346346 entities and in the following amounts:
347347 (1) $50,000,000 to Texas Tech University; and
348348 (2) $50,000,000 to the University of Houston.
349349 O. Suspend House Rule 13, Section 9b (5) to allow the Conference
350350 Committee to add an item of appropriation that is not in either
351351 version of the bill to read as follows; Suspend House Rule 13,
352352 Section 9a (4) to allow the Conference Committee to add text on any
353353 matter which is not included in either the House or Senate version
354354 of the bill to read as follows:
355355 SECTION 41. COMPTROLLER OF PUBLIC ACCOUNTS: TEXAS SAFE
356356 KEEPING TRUST FUND. (a) The amount of $100,000,000 is appropriated
357357 to the comptroller of public accounts from money received by this
358358 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
359359 Section 802) established under the American Rescue Plan Act of 2021
360360 (Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
361361 Relief Fund No. 325 for immediate deposit to an account or fund to
362362 be managed by the Texas Treasury Safekeeping Trust Company as
363363 trustee for the benefit of the State Preservation Board to maintain
364364 the Bob Bullock State History Museum.
365365 (b) If an appropriation made under Subsection (a) of this
366366 section for any reason is determined by the United States
367367 Department of the Treasury or any other qualified state or federal
368368 authority to have been made for an improper use:
369369 (1) the appropriated money may not be spent and shall
370370 be retained in the treasury and available for later legislative
371371 appropriation; and

385385 Parks and Wildlife Department from money received by this state
386386 from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
387387 802) established under the American Rescue Plan Act of 2021 (Pub. L.
388388 No. 117-2) and deposited to the credit of the Coronavirus Relief
389389 Fund No. 325 for the purpose of providing funding to the Texas State
390390 Aquarium Center for wildlife research during the two-year period
391391 beginning on the effective date of this Act.
392392 Q. Suspend House Rule 13, Section 9b (5) to allow the Conference
393393 Committee to add an item of appropriation that is not in either
394394 version of the bill to read as follows; Suspend House Rule 13,
395395 Section 9a (4) to allow the Conference Committee to add text on any
396396 matter which is not included in either the House or Senate version

398398 SECTION 43. UNIVERSITY OF TEXAS AT AUSTIN: MARINE SCIENCE
399399 INSTITUTE HOUSING REPLACEMENT. The amount of $3,000,000 is
400400 appropriated to the University of Texas at Austin from money
401401 received by this state from the Coronavirus State Fiscal Recovery
402402 Fund (42 U.S.C. Section 802) established under the American Rescue
403403 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
404404 the Coronavirus Relief Fund No. 325 for the purpose of providing
405405 funding for the Marine Science Institute student housing
406406 replacement for the two-year period beginning on the effective date
407407 of this Act.
408408 R. Suspend House Rule 13, Section 9b (5) to allow the Conference

414414 SECTION 44. TEXAS EDUCATION AGENCY: PROGRAM ENHANCEMENTS.
415415 The amount of $3,000,000 is appropriated to the Texas Education
416416 Agency from money received by this state from the Coronavirus State
417417 Fiscal Recovery Fund (42 U.S.C. Section 802) established under the

420420 of providing funding for the big brothers and big sisters program
421421 technological staff enhancements for the two-year period beginning
422422 on the effective date of this Act.

434434 No. 117-2) and deposited to the credit of the Coronavirus Relief
435435 Fund No. 325 to the University of Texas at Austin for the Briscoe
436436 Garner Museum for the two-year period beginning on the effective
437437 date of this Act.
438438 T. Suspend House Rule 13, Section 9b (5) to allow the Conference
439439 Committee to add an item of appropriation that is not in either
440440 version of the bill to read as follows; Suspend House Rule 13,
441441 Section 9a (4) to allow the Conference Committee to add text on any

444444 SECTION 46. HIGHER EDUCATION COORDINATING BOARD: RURAL
445445 VETERINARIANS GRANT PROGRAM. The amount of $1,000,000 is
446446 appropriated to the Higher Education Coordinating Board from money
447447 received by this state from the Coronavirus State Fiscal Recovery
448448 Fund (42 U.S.C. Section 802) established under the American Rescue
449449 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
450450 the Coronavirus Relief Fund No. 325 for the purpose of providing
451451 funding for the rural veterinarians grant program for the two-year
452452 period beginning on the effective date of this Act.
453453 U. Suspend House Rule 13, Section 9b (5) to allow the Conference
454454 Committee to add an item of appropriation that is not in either
455455 version of the bill to read as follows; Suspend House Rule 13,
456456 Section 9a (4) to allow the Conference Committee to add text on any
457457 matter which is not included in either the House or Senate version

459459 SECTION 47. STATE PRESERVATION BOARD: MAINTENANCE AND
460460 CAPITAL IMPROVEMENT PROJECTS. (a) The amount of $25,000,000 is
461461 appropriated to the State Preservation Board from money received by
462462 this state from the Coronavirus State Fiscal Recovery Fund (42
463463 U.S.C. Section 802) established under the American Rescue Plan Act
464464 of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
465465 Coronavirus Relief Fund No. 325 for the purpose of maintenance and
466466 capital improvement projects during the state fiscal biennium
467467 beginning September 1, 2021.
468468 (b) The capital budget authority of the State Preservation
469469 Board in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
470470 Regular Session, 2021 (the General Appropriations Act), is
471471 increased by $25,000,000 for the appropriation made under
472472 Subsection (a) of this section.
473473 V. Suspend House Rule 13, Section 9a (4) to allow the Conference
474474 Committee to add text on any matter which is not included in either
475475 the House or Senate version of the bill to read as follows:
476476 SECTION 48. DEPARTMENT OF STATE HEALTH SERVICES AND HEALTH
477477 AND HUMAN SERVICES COMMISSION: FEDERAL FUNDS FOR HOSPITALS. It is
478478 the intent of the Legislature that the Department of State Health
479479 Services and the Health and Human Services Commission, in
480480 distributing any money received from the Coronavirus State Fiscal
481481 Recovery Fund (42 U.S.C. Section 802) established under the
482482 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
483483 to the credit of the Coronavirus Relief Fund No. 325 distribute the
484484 money appropriated by this Act to entities that are subject to the
485485 hospital price transparency public disclosure requirements
486486 required by 45 C.F.R. Sections 180.10 - 180.60 and, on
487487 implementation of rules adopted under the chapter, by Chapter 327,
488488 Health and Safety Code.
489489 W. Suspend House Rule 13, Section 9a (4) to allow the Conference
490490 Committee to add text on any matter which is not included in either
491491 the House or Senate version of the bill to read as follows:
492492 SECTION 49. REPORT ON FEDERAL FUNDS BY LEGISLATIVE BUDGET
493493 BOARD. (a) The Legislative Budget Board, in consultation with the
494494 comptroller of public accounts, shall report on the board's
495495 Internet website:
496496 (1) for each political subdivision in this state, an
497497 informational listing of any money appropriated by this Act and
498498 received by the subdivision; and
499499 (2) for each state agency and each institution of
500500 higher education that receives money appropriated by this Act, an
501501 informational listing of the following:
502502 (A) the amount of money received by the agency or
503503 institution;
504504 (B) the federal legislation that authorized
505505 distribution of the money to the state, agency, or institution and
506506 the state legislation, if applicable, that appropriated the money
507507 to the agency or institution;
508508 (C) the amount of money spent by the agency or
509509 institution;
510510 (D) the allowable uses for which the agency or
511511 institution may spend money received by the agency or institution
512512 and the purposes for which the agency or institution has spent the
513513 money;
514514 (E) the amount of money received by the agency or
515515 institution:
516516 (i) that the agency or institution has not
517517 spent; and
518518 (ii) that the agency or institution may
519519 spend without further appropriation; and
520520 (F) the time during which money received by the
521521 agency or institution was spent by the agency or institution,
522522 including the remaining time in which the agency or institution may
523523 spend the money without further appropriation.
524524 (b) This section does not apply to a hospital licensed under
525525 Chapter 241, Health and Safety Code, or a hospital owned and
526526 operated by this state.
527527 (c) It is the intent of the legislature that information
528528 required to be provided in a report on the Legislative Budget
529529 Board's Internet website under Subsection (a) of this section must
530530 be updated not less than once during each fiscal quarter and once on
531531 the first day of each fiscal quarter that occurs on or after
532532 December 1, 2021, until at least December 1, 2028.
533533 X. Suspend House Rule 13, Section 9a (4) to allow the Conference
534534 Committee to add text on any matter which is not included in either
535535 the House or Senate version of the bill to read as follows:
536536 SECTION 50. LEGISLATIVE INTENT REGARDING APPROPRIATIONS.
537537 (a) It is the intent of the legislature that the appropriations
538538 made by this Act:
539539 (1) are one-time appropriations made for the purpose
540540 of addressing the needs of this state for the two-year period
541541 beginning on the effective date of this Act; and
542542 (2) be used:
543543 (A) only for purposes authorized by state and
544544 federal law, including guidance issued by the United States
545545 Department of the Treasury in 86 Fed. Reg. 26786 (May 17, 2021); and
546546 (B) before all other methods of finance, if more
547547 than one method of finance is available for the applicable purpose.
548548 (b) Except as specifically provided otherwise by this Act,
549549 it is the intent of the legislature that, if the United States
550550 Department of the Treasury or any other qualified state or federal
551551 authority determines that an appropriation made by this Act has
552552 been made for an improper use, the appropriated money not be spent
553553 and shall be retained in the treasury and available for later
554554 legislative appropriation.
555555 Y. Suspend House Rule 13, Section 9a (4) to allow the Conference

557557 the House or Senate version of the bill to read as follows:
558558 SECTION 51. APPROPRIATION AUTHORITY UNDER FEDERAL LAW. The
559559 appropriations made under Sections 2, 3, 6, 7, 8, 9, 10, 11, 12, 13,
560560 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30,
561561 31, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, and 47 of this
562562 Act using money received by this state from the Coronavirus State
563563 Fiscal Recovery Fund (42 U.S.C. Section 802) established under the
564564 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) are made in
565565 accordance with 42 U.S.C. Section 802(c)(1)(C), which allows money
566566 from the Coronavirus State Fiscal Recovery Fund to be used to
567567 provide government services to the extent of a reduction in the
568568 revenue of a state government caused by the COVID-19 public health
569569 emergency relative to revenues collected in the most recent full
570570 fiscal year of the state government that ended before that
571571 emergency.
