8 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 14 | | SECTION 1. Section 64.012(b), Election Code, as effective |
---|
10 | 15 | | December 2, 2021, is amended to read as follows: |
---|
11 | 16 | | (b) An offense under this section is a felony of the second |
---|
12 | 17 | | degree unless the person is convicted of an attempt. In that case, |
---|
13 | 18 | | the offense is a state jail felony [Class A misdemeanor]. |
---|
14 | 19 | | SECTION 2. Section 276.013(b), Election Code, as effective |
---|
15 | 20 | | December 2, 2021, is amended to read as follows: |
---|
16 | 21 | | (b) An offense under this section is a Class A misdemeanor, |
---|
17 | 22 | | unless[: |
---|
18 | 23 | | [(1)] the person committed the offense while acting in |
---|
19 | 24 | | the person's capacity as an elected official, in which case the |
---|
20 | 25 | | offense is a state jail felony[; or |
---|
21 | 26 | | [(2) the person is convicted of an attempt, in which |
---|
22 | 27 | | case the offense is a Class B misdemeanor]. |
---|
23 | 28 | | SECTION 3. The changes in law made by this Act apply only to |
---|
24 | 29 | | an offense committed on or after the effective date of this Act. An |
---|
25 | 30 | | offense committed before the effective date of this Act is governed |
---|
26 | 31 | | by the law in effect on the date the offense was committed, and the |
---|
27 | 32 | | former law is continued in effect for that purpose. For purposes of |
---|
28 | 33 | | this section, an offense was committed before the effective date of |
---|
29 | 34 | | this Act if any element of the offense occurred before that date. |
---|
30 | 35 | | SECTION 4. This Act takes effect on the 91st day after the |
---|
31 | 36 | | last day of the legislative session. |
