55 AN ACT
66 relating to prohibiting COVID-19 vaccine mandates by a governmental
77 entity.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 161, Health and Safety
1010 Code, is amended by adding Section 161.0015 to read as follows:
1111 Sec. 161.0015. COVID-19 VACCINE MANDATES PROHIBITED. (a)
1212 In this section, "governmental entity" means this state, a local
1313 government entity as defined by Section 418.004, Government Code,
1414 or an agency of this state or a local government entity.
1515 (b) A governmental entity may not implement, order, or
1616 otherwise impose a mandate requiring an individual to be vaccinated
1717 against COVID-19.
1818 (c) An individual who is the subject of a violation of
1919 Subsection (b) may bring an action in a district court in the county
2020 in which the violation occurred for injunctive relief to prevent
2121 further violation of that subsection.
2222 (d) A claimant may recover reasonable expenses incurred in
2323 bringing an action under Subsection (c), including court costs,
2424 attorney's fees, investigation costs, witness fees, and deposition
2525 expenses.
2626 SECTION 2. Section 161.0015, Health and Safety Code, as
2727 added by this Act, applies only to conduct that occurs on or after
2828 the effective date of this Act.
2929 SECTION 3. This Act takes effect January 1, 2022.
