55 AN ACT
66 relating to the provision of and professional liability insurance
77 coverage for gender transitioning or gender reassignment medical
88 procedures and treatments for certain children.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 161, Health and Safety Code, is amended
1111 by adding Subchapter X to read as follows:
1212 SUBCHAPTER X. GENDER TRANSITIONING AND GENDER REASSIGNMENT
1313 PROCEDURES AND TREATMENTS FOR CERTAIN CHILDREN
1414 Sec. 161.701. DEFINITIONS. In this subchapter:
1515 (1) "Child" means an individual who is younger than 18
1616 years of age.
1717 (2) "Health care provider" means a person other than a
1818 physician who is licensed, certified, or otherwise authorized by
1919 the laws of this state to provide or render health care or to
2020 dispense or prescribe a prescription drug in the ordinary course of
2121 business or practice of a profession.
2222 (3) "Physician" means a person licensed to practice
2323 medicine in this state.
2424 Sec. 161.702. PROHIBITED PROVISION OF GENDER TRANSITIONING
2525 OR GENDER REASSIGNMENT PROCEDURES AND TREATMENTS TO CERTAIN
2626 CHILDREN. For the purpose of transitioning a child's biological
2727 sex as determined by the sex organs, chromosomes, and endogenous
2828 profiles of the child or affirming the child's perception of the
2929 child's sex if that perception is inconsistent with the child's
3030 biological sex, a physician or other health care provider may not:
3131 (1) perform a surgery that sterilizes the child,
3232 including:
3333 (A) castration;
3434 (B) vasectomy;
3535 (C) hysterectomy;
3636 (D) oophorectomy;
3737 (E) metoidioplasty;
3838 (F) orchiectomy;
3939 (G) penectomy;
4040 (H) phalloplasty; and
4141 (I) vaginoplasty;
4242 (2) perform a mastectomy;
4343 (3) prescribe, administer, or supply any of the
4444 following medications that induce transient or permanent
4545 infertility:
4646 (A) puberty-blocking medication to stop or delay
4747 normal puberty;
4848 (B) supraphysiologic doses of testosterone to
4949 females; or
5050 (C) supraphysiologic doses of estrogen to males;
5151 or
5252 (4) remove any otherwise healthy or non-diseased body
5353 part or tissue.
5454 Sec. 161.703. EXCEPTIONS. The prohibitions under Section
5555 161.702 do not apply to the provision by a physician or other health
5656 care provider, with the consent of the child's parent or legal
5757 guardian, of appropriate and medically necessary gender
5858 transitioning or gender reassignment procedures or treatments to a
5959 child who:
6060 (1) is born with a medically verifiable genetic
6161 disorder of sex development, including:
6262 (A) 46, XX chromosomes with virilization;
6363 (B) 46, XY chromosomes with undervirilization;
6464 or
6565 (C) both ovarian and testicular tissue; or
6666 (2) does not have the normal sex chromosome structure
6767 for male or female as determined by a physician through genetic
6868 testing.
6969 Sec. 161.704. DISCIPLINARY ACTION. The Texas Medical Board
7070 or another state regulatory agency with jurisdiction over a health
7171 care provider subject to Section 161.702 shall revoke the license,
7272 certification, or authorization of a physician or health care
7373 provider who the board or agency determines has violated that
7474 section.
7575 SECTION 2. Subchapter F, Chapter 1901, Insurance Code, is
7676 amended by adding Section 1901.256 to read as follows:
7777 Sec. 1901.256. PROHIBITED COVERAGE FOR PROVISION OF CERTAIN
7878 GENDER-RELATED PROCEDURES AND TREATMENTS TO CERTAIN CHILDREN. A
7979 professional liability insurance policy issued to a physician or
8080 health care provider may not include coverage for damages assessed
8181 against the physician or health care provider who provides to a
8282 child gender transitioning or gender reassignment procedures or
8383 treatments that are prohibited by Section 161.702, Health and
8484 Safety Code.
8585 SECTION 3. Section 1901.256, Insurance Code, as added by
8686 this Act, applies only to a medical professional liability
8787 insurance policy that is delivered, issued for delivery, or renewed
8888 on or after January 1, 2022. An insurance policy that is delivered,
8989 issued for delivery, or renewed before January 1, 2022, is governed
9090 by the law in effect immediately before the effective date of this
9191 Act, and that law is continued in effect for that purpose.
9292 SECTION 4. This Act takes effect immediately if it receives
9393 a vote of two-thirds of all the members elected to each house, as
9494 provided by Section 39, Article III, Texas Constitution. If this
9595 Act does not receive the vote necessary for immediate effect, this
9696 Act takes effect on the 91st day after the last day of the
9797 legislative session.
