55 AN ACT
66 relating to an interstate compact on border security and
77 immigration enforcement.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Title 7, Government Code, is amended by adding
1010 Chapter 794 to read as follows:
1111 CHAPTER 794. INTERSTATE COMPACT FOR BORDER SECURITY
1212 Sec. 794.001. DEFINITION. In this chapter, "illegal alien"
1313 means a person who:
1414 (1) is not a citizen or national of the United States;
1515 and
1616 (2) is unlawfully present in the United States
1717 according to the terms of 8 U.S.C. Section 1101 et seq.
1818 Sec. 794.002. AUTHORITY TO EXECUTE INTERSTATE COMPACT. On
1919 behalf of this state, the governor may:
2020 (1) coordinate, develop, and execute an interstate
2121 compact for border security among interested states; and
2222 (2) seek the approval of the United States Congress
2323 for the compact.
2424 Sec. 794.003. CONGRESSIONAL APPROVAL. The compact
2525 authorized by this chapter takes effect only if approved by the
2626 United States Congress not later than the 10th anniversary of the
2727 date the compact is executed by the governor under Section 794.002.
2828 Sec. 794.004. INTERSTATE COMPACT PROVISIONS. The compact
2929 authorized by this chapter must provide for joint action among
3030 compacting states on matters that include:
3131 (1) the operational control of this state's border
3232 with Mexico by the total detection and apprehension or deflection
3333 of illegal aliens attempting to cross the border into this state;
3434 and
3535 (2) any other enforcement of federal immigration laws,
3636 including the detecting, apprehending, detaining, prosecuting,
3737 releasing, and monitoring of illegal aliens.
3838 SECTION 2. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect on the 91st day after the last day of the
4343 legislative session.
