66 AN ACT
77 relating to increasing the criminal penalty for committing certain
88 offenses relating to elections.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 64.012(b), Election Code, as effective
1111 December 2, 2021, is amended to read as follows:
1212 (b) An offense under this section is a felony of the second
1313 degree unless the person is convicted of an attempt. In that case,
1414 the offense is a state jail felony [Class A misdemeanor].
1515 SECTION 2. Section 276.013(b), Election Code, as effective
1616 December 2, 2021, is amended to read as follows:
1717 (b) An offense under this section is a Class A misdemeanor,
1818 unless[:
1919 [(1)] the person committed the offense while acting in
2020 the person's capacity as an elected official, in which case the
2121 offense is a state jail felony[; or
2222 [(2) the person is convicted of an attempt, in which
2323 case the offense is a Class B misdemeanor].
2424 SECTION 3. The changes in law made by this Act apply only to
2525 an offense committed on or after the effective date of this Act. An
2626 offense committed before the effective date of this Act is governed
2727 by the law in effect on the date the offense was committed, and the
2828 former law is continued in effect for that purpose. For purposes of
2929 this section, an offense was committed before the effective date of
3030 this Act if any element of the offense occurred before that date.
3131 SECTION 4. This Act takes effect on the 91st day after the
3232 last day of the legislative session.
