10- SECTION 1. SECTION 1. Subchapter B, Chapter 55, Education
11- Code, is amended by adding Section 55.111 to read as follows:

2324 Sec. 55.1791. THE TEXAS A&M UNIVERSITY SYSTEM; ADDITIONAL
2425 BONDS. (a) In addition to the other authority granted by this
2526 subchapter, the board of regents of The Texas A&M University System
2627 may acquire, purchase, construct, improve, renovate, enlarge, or
2728 equip property and facilities, including roads and related
2829 infrastructure, for projects to be financed through the issuance of
2930 bonds in accordance with this subchapter and in accordance with a
3031 systemwide revenue financing program adopted by the board for the
3132 following institutions, not to exceed the following aggregate
3233 principal amounts for the projects specified, as follows:
3334 (1) The Texas A&M University System, $43,425,406 for
3435 construction of a STEM education center at the RELLIS campus;
3536 (2) Prairie View A&M University, $44,922,833 for
3637 construction of a teaching and academic student support services
3738 facility;

7473 (b) The board may pledge irrevocably to the payment of bonds
7574 authorized by this section all or any part of the revenue funds of
7675 an institution, branch, or entity of The Texas A&M University
7776 System, including student tuition charges. The amount of a pledge
7877 made under this subsection may not be reduced or abrogated while the
7978 bonds for which the pledge is made, or bonds issued to refund those
8079 bonds, are outstanding.
8180 (c) If sufficient funds are not available to the board to
8281 meet its obligations under this section, the board may transfer
8382 funds among institutions, branches, and entities of The Texas A&M
8483 University System to ensure the most equitable and efficient
8584 allocation of available resources for each institution, branch, or
8685 entity to carry out its duties and purposes.
8786 (d) In lieu of financing a project described by Subsection
88- (a) for an institution of higher education, entity, or university
89- system, the board may finance in the manner prescribed by that
90- subsection an alternative project for deferred maintenance,
91- infrastructure, or construction at the same institution, entity, or
92- system in an amount not to exceed the total of the amount authorized
93- for the project and any unspent amount from projects authorized for
94- the institution, entity, or system under this chapter. The board
95- shall notify the Texas Higher Education Coordinating Board of an
96- alternative project financed as provided by this subsection.
97- (e) For financing of an alternative project as provided by
98- Subsection (d) in an amount that exceeds $25 million, the board must
99- receive prior written approval from the governor and Legislative
100- Budget Board. A request for approval of financing of an alternative
101- project is considered approved unless the governor or the
102- Legislative Budget Board issues a written disapproval not later
103- than the 30th business day after the date of the receipt of the
104- request.

257232 the board for the following institutions, not to exceed the
258233 following aggregate principal amounts for the projects specified,
259234 as follows:
260235 (1) Texas State University System, $11,230,708 for
261236 construction of a field research station and dam repair;
262237 (2) Lamar State College--Orange, $37,435,695 for the
263238 replacement of an academic building to house general academic
264239 instruction and information technology services;
265240 (3) Lamar State College--Port Arthur, $37,435,695 for
266241 construction of an allied health and sciences building;
267242 (4) Lamar Institute of Technology, $37,435,695 for
268243 construction of a facility for workforce and allied health

315287 subchapter, the board of regents of the University of North Texas
316288 System may acquire, purchase, construct, improve, renovate,
317289 enlarge, or equip property and facilities, including roads and
318290 related infrastructure, for projects to be financed through the
319291 issuance of bonds in accordance with this subchapter and in
320292 accordance with a systemwide revenue financing program adopted by
321293 the board for the following institutions, not to exceed the
322294 following aggregate principal amounts for the projects specified,
323295 as follows:
324- (1) the University of North Texas, $113,400,000 for
325- construction of a science and technology research building;
296+ (1) the University of North Texas:
297+ (A) $52,409,472 for construction of a science and
298+ technology research building; and
299+ (B) $52,409,472 for construction of a commerce,
300+ analytics, technology, and engineering building in Frisco, Texas;
326301 (2) the University of North Texas at Dallas,
327302 $100,000,000 for construction of a science building; and
328303 (3) the University of North Texas Health Science
329- Center at Fort Worth, $59,897,111 for campus space optimization and
304+ Center at Fort Worth, $59,987,111 for campus space optimization and
330305 realignment.
331306 (b) The board may pledge irrevocably to the payment of bonds
332307 authorized by this section all or any part of the revenue funds of
333308 an institution, branch, or entity of the University of North Texas
334309 System, including student tuition charges. The amount of a pledge
335310 made under this subsection may not be reduced or abrogated while the
336311 bonds for which the pledge is made, or bonds issued to refund those
337312 bonds, are outstanding.
338313 (c) If sufficient funds are not available to the board to
339314 meet its obligations under this section, the board may transfer
340315 funds among institutions, branches, and entities of the University
341316 of North Texas System to ensure the most equitable and efficient
342317 allocation of available resources for each institution, branch, or
343318 entity to carry out its duties and purposes.
344319 (d) In lieu of financing a project described by Subsection
345- (a) for an institution of higher education, entity, or university
346- system, the board may finance in the manner prescribed by that
347- subsection an alternative project for deferred maintenance,
348- infrastructure, or construction at the same institution, entity, or

363330 (a) In addition to the other authority granted by this subchapter,
364331 the board of regents of Texas Woman's University may acquire,
365332 purchase, construct, improve, renovate, enlarge, or equip property
366333 and facilities, including roads and related infrastructure, for a
367334 health sciences center, to be financed through the issuance of
368335 bonds in accordance with this subchapter, not to exceed the
369336 aggregate principal amount of $100 million.
370337 (b) The board may pledge irrevocably to the payment of bonds
371338 authorized by this section all or any part of the revenue funds of
372339 Texas Woman's University, including student tuition charges. The
373340 amount of a pledge made under this subsection may not be reduced or
374341 abrogated while the bonds for which the pledge is made, or bonds
375342 issued to refund those bonds, are outstanding.
376343 (c) In lieu of financing a project described by Subsection
377344 (a) for Texas Woman's University, the board may finance in the
378345 manner prescribed by that subsection an alternative project for
379- deferred maintenance, infrastructure, or construction at the
380- university in an amount not to exceed the total of the amount
381- authorized for the project and any unspent amount from projects
382- authorized for the university under this chapter. The board shall
383- notify the Texas Higher Education Coordinating Board of an
384- alternative project financed as provided by this subsection.
385- (d) For financing of an alternative project as provided by
386- Subsection (c) in an amount that exceeds $25 million, the board must
387- receive prior written approval from the governor and Legislative
388- Budget Board. A request for approval of financing of an alternative
389- project is considered approved unless the governor or the
390- Legislative Budget Board issues a written disapproval not later

396355 University may acquire, purchase, construct, improve, renovate,
397356 enlarge, or equip property and facilities, including roads and
398357 related infrastructure, for construction of an interdisciplinary
399358 and applied sciences building, to be financed through the issuance
400359 of bonds in accordance with this subchapter, not to exceed the

427378 subchapter, the board of regents of the Texas Tech University
428379 System may acquire, purchase, construct, improve, renovate,
429380 enlarge, or equip property and facilities, including roads and
430381 related infrastructure, for projects to be financed through the
431382 issuance of bonds in accordance with this subchapter and in
432383 accordance with a systemwide revenue financing program adopted by
433384 the board for the following institutions, not to exceed the
434385 following aggregate principal amounts for the projects specified,
435386 as follows:
436387 (1) Angelo State University, $36 million for a central
437388 plant maintenance and renovation;
438- (2) Texas Tech University:
439- (A) $72 million for renovations to address
440- deferred maintenance for campus buildings; and
441- (B) $8 million for maintenance and program
442- enhancement construction in Junction, Texas;
389+ (2) Texas Tech University, $52,409,972 for
390+ renovations to address deferred maintenance for campus buildings;
443391 (3) Midwestern State University, $44,922,833 for
444392 renovations to an existing building and other campus infrastructure
445393 upgrades;
446394 (4) Texas Tech University Health Sciences Center:
447395 (A) $59,897,111 for maintenance and renovation
448396 of an existing facility; and
449397 (B) $18,717,847 for construction and equipment
450398 of the physician assistant facility in Midland, Texas; and
451399 (5) Texas Tech University Health Sciences Center at El
452400 Paso, $59,897,111 for construction of a dental school building.
453401 (b) The board may pledge irrevocably to the payment of bonds
454402 authorized by this section all or any part of the revenue funds of
455403 an institution, branch, or entity of the Texas Tech University
456404 System, including student tuition charges. The amount of a pledge
457405 made under this subsection may not be reduced or abrogated while the

460408 (c) If sufficient funds are not available to the board to
461409 meet its obligations under this section, the board may transfer
462410 funds among institutions, branches, and entities of the Texas Tech
463411 University System to ensure the most equitable and efficient
464412 allocation of available resources for each institution, branch, or
465413 entity to carry out its duties and purposes.
466414 (d) In lieu of financing a project described by Subsection
467- (a) for an institution of higher education, entity, or university
468- system, the board may finance in the manner prescribed by that
469- subsection an alternative project for deferred maintenance,
470- infrastructure, or construction at the same institution, entity, or
471- system in an amount not to exceed the total of the amount authorized
472- for the project and any unspent amount from projects authorized for
473- the institution, entity, or system under this chapter. The board
474- shall notify the Texas Higher Education Coordinating Board of an
475- alternative project financed as provided by this subsection.

484424 Sec. 55.1799. TEXAS SOUTHERN UNIVERSITY; ADDITIONAL BONDS.
485425 (a) In addition to the other authority granted by this subchapter,
486426 the board of regents of Texas Southern University may acquire,
487427 purchase, construct, improve, renovate, enlarge, or equip property
488428 and facilities, including roads and related infrastructure, for
489429 projects to be financed through the issuance of bonds in accordance
490430 with this subchapter, not to exceed the following aggregate
491431 principal amounts for the projects specified, as follows:
492432 (1) $22,800,000 for renovation of the Nabrit Building;
493433 (2) $2,400,000 for upgrades to signage and wayfinding;
494434 (3) $40 million for facility maintenance and
495435 renovation; and
496436 (4) $30 million for construction of a health and
497437 wellness center.
498438 (b) The board may pledge irrevocably to the payment of bonds
499439 authorized by this section all or any part of the revenue funds of
500440 Texas Southern University, including student tuition charges. The
501441 amount of a pledge made under this subsection may not be reduced or
502442 abrogated while the bonds for which the pledge is made, or bonds
503443 issued to refund those bonds, are outstanding.
504444 (c) In lieu of financing a project described by Subsection
505445 (a) for Texas Southern University, the board may finance in the

572- Legislative Budget Board issues a written disapproval not later
573- than the 30th business day after the date of the receipt of the

575- SECTION 3. Subchapter B, Chapter 55, Education Code, is
576- amended by adding Section 55.165 to read as follows:
577- Sec. 55.165. OVERSIGHT OF CERTAIN CAPITAL PROJECTS. (a)
578- This section applies only to a capital project for which the
579- issuance of bonds is specifically authorized under this chapter on
580- or after October 1, 2021.
581- (b) Notwithstanding Section 2262.002(a), Government Code,
582- or any other law, a project to which this section applies is subject
583- to oversight by the contract advisory team in accordance with
584- Subchapter C, Chapter 2262, Government Code, and the governing
585- board of the institution of higher education or university system
586- for which a project was authorized shall consult the contract
587- advisory team before expending any funds for purposes of the
588- project. The contract advisory team shall consider the model
589- guidelines for procurement and construction developed by the
590- capital project oversight advisory commission established by
591- S.B. 52, 87th Legislature, 3rd Called Session, 2021, when
592- consulting with a governing board for purposes of this subsection.
593- (c) Notwithstanding Section 322.020(f), Government Code, or
594- any other law, the governing board of an institution of higher
595- education or university system authorized to issue bonds for a
596- project to which this section applies shall report any major
597- contract as defined by Section 322.020(a), Government Code, that is
598- entered into for purposes of the project to the major contracts
599- database maintained by the Legislative Budget Board under Section
600- 322.020, Government Code, not later than the 30th day after the date
601- the contract is executed.
602- SECTION 4. CAPITAL PROJECT OVERSIGHT ADVISORY COMMISSION.
603- (a) The Capital Project Oversight Advisory Commission is composed
604- of nine members as follows:
605- (1) the chair of the Senate Committee on Higher
606- Education;
607- (2) one member of the senate appointed by the
608- lieutenant governor;
609- (3) the chair of the House Committee on Higher
610- Education;
611- (4) one member of the house of representatives
612- appointed by the speaker of the house of representatives;
613- (5) one member of the public appointed by the
614- lieutenant governor;
615- (6) one member of the public appointed by the speaker
616- of the house of representatives;
617- (7) the chair of the Texas Facilities Commission;
618- (8) the commissioner of higher education; and
619- (9) one member of the public appointed by the governor
620- to serve as chair of the commission.
621- (b) Appointments to the commission shall be made without
622- regard to the race, color, disability, sex, religion, age, or
623- national origin of the appointee.
624- (c) The commission, in consultation with the Legislative
625- Budget Board and Comptroller of Public Accounts, shall develop
626- model guidelines to be considered by public institutions of higher
627- education and university systems for procurement and construction
628- related to capital projects for which the issuance of bonds is
629- specifically authorized under Chapter 55, Education Code.
630- (d) The commission may request reports and other
631- information from the Texas Higher Education Coordinating Board
632- relating to capital projects described by Subsection (c) of this
633- section.
634- (e) Not later than March 31, 2022, the commission shall
635- develop the model guidelines required by Subsection (c) of this
636- section.
637- (f) Not later than December 1, 2022, the commission shall
638- prepare and submit a report to the governor, lieutenant governor,
639- and speaker of the house of representatives on the model guidelines
640- developed under Subsection (c) of this section and recommendations
641- for legislative or other action.
642- (g) The commission is abolished effective December 31,
643- 2022.
644- SECTION 5. This Act does not affect any authority or
