9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

12	14		Sec. 55.111. CERTAIN ALLOCATED FUNDS TO BE DESIGNATED AS

	15	+	CAPITAL IMPROVEMENT DEBT ASSISTANCE. For purposes of this
14	16		subchapter, funds allocated from the appropriation of general
15		-	revenue or federal funds to an institution of higher education to
16		-	supplement revenue funds of the institution described by Section
17		-	55.13(a) may be designated as "Capital Construction Assistance
18		-	Projects."

19	20		SECTION 2. Subchapter B, Chapter 55, Education Code, is

21	22		55.1795, 55.1796, 55.1797, 55.1798, 55.1799, and 55.17991 to read
22	23		as follows:
23	24		Sec. 55.1791. THE TEXAS A&M UNIVERSITY SYSTEM; ADDITIONAL
24	25		BONDS. (a) In addition to the other authority granted by this
25	26		subchapter, the board of regents of The Texas A&M University System
26	27		may acquire, purchase, construct, improve, renovate, enlarge, or
27	28		equip property and facilities, including roads and related
28	29		infrastructure, for projects to be financed through the issuance of
29	30		bonds in accordance with this subchapter and in accordance with a
30	31		systemwide revenue financing program adopted by the board for the
31	32		following institutions, not to exceed the following aggregate
32	33		principal amounts for the projects specified, as follows:
33	34		(1) The Texas A&M University System, $43,425,406 for
34	35		construction of a STEM education center at the RELLIS campus;
35	36		(2) Prairie View A&M University, $44,922,833 for
36	37		construction of a teaching and academic student support services
37	38		facility;
38		-	(3) Tarleton State University:
39		-	(A) $65 million for construction of a College of
40		-	Health Sciences and Human Services building on the Stephenville
41		-	campus; and
42		-	(B) $25 million for expansion of the Fort Worth
43		-	campus;

	40	+	construction of a College of Health Sciences and Human Services
	41	+	building on the Stephenville campus;

74	73		(b) The board may pledge irrevocably to the payment of bonds
75	74		authorized by this section all or any part of the revenue funds of
76	75		an institution, branch, or entity of The Texas A&M University
77	76		System, including student tuition charges. The amount of a pledge
78	77		made under this subsection may not be reduced or abrogated while the
79	78		bonds for which the pledge is made, or bonds issued to refund those
80	79		bonds, are outstanding.
81	80		(c) If sufficient funds are not available to the board to
82	81		meet its obligations under this section, the board may transfer
83	82		funds among institutions, branches, and entities of The Texas A&M
84	83		University System to ensure the most equitable and efficient
85	84		allocation of available resources for each institution, branch, or
86	85		entity to carry out its duties and purposes.
87	86		(d) In lieu of financing a project described by Subsection
88		-	(a) for an institution of higher education, entity, or university
89		-	system, the board may finance in the manner prescribed by that
90		-	subsection an alternative project for deferred maintenance,
91		-	infrastructure, or construction at the same institution, entity, or
92		-	system in an amount not to exceed the total of the amount authorized
93		-	for the project and any unspent amount from projects authorized for
94		-	the institution, entity, or system under this chapter. The board
95		-	shall notify the Texas Higher Education Coordinating Board of an
96		-	alternative project financed as provided by this subsection.
97		-	(e) For financing of an alternative project as provided by
98		-	Subsection (d) in an amount that exceeds $25 million, the board must
99		-	receive prior written approval from the governor and Legislative
100		-	Budget Board. A request for approval of financing of an alternative

116	107		renovation of the Microelectronics Research Center at the
117	108		J. J. Pickle Research Campus;

119	110		for renovation of the Life Science Building;
120	111		(3) The University of Texas at Austin, $56,153,542 for
121	112		renovation of the Physics, Math, and Astronomy Building;
122	113		(4) The University of Texas at Dallas, $52,409,972 for
123	114		construction of a student success center;
124	115		(5) The University of Texas at El Paso, $52,409,972
125	116		for construction of an advanced teaching and learning complex;
126	117		(6) The University of Texas of the Permian Basin,

157	148		(b) The board may pledge irrevocably to the payment of bonds

159	150		an institution, branch, or entity of The University of Texas

196	179		the board for the following institutions, not to exceed the
197	180		following aggregate principal amounts for the projects specified,
198	181		as follows:
199		-	(1) the University of Houston System, $59,897,111 for
200		-	construction of a medical research facility;

	183	+	(A) $52,409,972 for construction of the Katy
	184	+	Academic Building 2; and

218	201		(b) The board may pledge irrevocably to the payment of bonds

263	238		replacement of an academic building to house general academic

265	240		(3) Lamar State College--Port Arthur, $37,435,695 for
266	241		construction of an allied health and sciences building;
267	242		(4) Lamar Institute of Technology, $37,435,695 for
268	243		construction of a facility for workforce and allied health

287	267		bonds for which the pledge is made, or bonds issued to refund those
288	268		bonds, are outstanding.
289	269		(c) If sufficient funds are not available to the board to
290	270		meet its obligations under this section, the board may transfer
291	271		funds among institutions, branches, and entities of the Texas State
292	272		University System to ensure the most equitable and efficient
293	273		allocation of available resources for each institution, branch, or
294	274		entity to carry out its duties and purposes.

316	288		System may acquire, purchase, construct, improve, renovate,
317	289		enlarge, or equip property and facilities, including roads and
318	290		related infrastructure, for projects to be financed through the
319	291		issuance of bonds in accordance with this subchapter and in
320	292		accordance with a systemwide revenue financing program adopted by
321	293		the board for the following institutions, not to exceed the
322	294		following aggregate principal amounts for the projects specified,
323	295		as follows:
324		-	(1) the University of North Texas, $113,400,000 for
325		-	construction of a science and technology research building;
	296	+	(1) the University of North Texas:
	297	+	(A) $52,409,472 for construction of a science and
	298	+	technology research building; and
	299	+	(B) $52,409,472 for construction of a commerce,
	300	+	analytics, technology, and engineering building in Frisco, Texas;
326	301		(2) the University of North Texas at Dallas,
327	302		$100,000,000 for construction of a science building; and
328	303		(3) the University of North Texas Health Science
329		-	Center at Fort Worth, $59,~~897~~,111 for campus space optimization and
	304	+	Center at Fort Worth, $59,987,111 for campus space optimization and
330	305		realignment.
331	306		(b) The board may pledge irrevocably to the payment of bonds
332	307		authorized by this section all or any part of the revenue funds of
333	308		an institution, branch, or entity of the University of North Texas
334	309		System, including student tuition charges. The amount of a pledge
335	310		made under this subsection may not be reduced or abrogated while the
336	311		bonds for which the pledge is made, or bonds issued to refund those
337	312		bonds, are outstanding.
338	313		(c) If sufficient funds are not available to the board to

362	329		Sec. 55.1796. TEXAS WOMAN'S UNIVERSITY; ADDITIONAL BONDS.
363	330		(a) In addition to the other authority granted by this subchapter,
364	331		the board of regents of Texas Woman's University may acquire,
365	332		purchase, construct, improve, renovate, enlarge, or equip property
366	333		and facilities, including roads and related infrastructure, for a
367	334		health sciences center, to be financed through the issuance of
368	335		bonds in accordance with this subchapter, not to exceed the
369	336		aggregate principal amount of $100 million.
370	337		(b) The board may pledge irrevocably to the payment of bonds
371	338		authorized by this section all or any part of the revenue funds of
372	339		Texas Woman's University, including student tuition charges. The

377	344		(a) for Texas Woman's University, the board may finance in the
378	345		manner prescribed by that subsection an alternative project for
379		-	deferred maintenance, infrastructure, or construction at the
380		-	university in an amount not to exceed the total of the amount
381		-	authorized for the project and any unspent amount from projects
382		-	authorized for the university under this chapter. The board shall
383		-	notify the Texas Higher Education Coordinating Board of an
384		-	alternative project financed as provided by this subsection.
385		-	(d) For financing of an alternative project as provided by
386		-	Subsection (c) in an amount that exceeds $25 million, the board must
387		-	receive prior written approval from the governor and Legislative
388		-	Budget Board. A request for approval of financing of an alternative
389		-	project is considered approved unless the governor or the
390		-	Legislative Budget Board issues a written disapproval not later
391		-	than the 30th business day after the date of the receipt of the
392		-	request.

395	354		by this subchapter, the board of regents of Stephen F. Austin State
396	355		University may acquire, purchase, construct, improve, renovate,
397	356		enlarge, or equip property and facilities, including roads and
398	357		related infrastructure, for construction of an interdisciplinary
399	358		and applied sciences building, to be financed through the issuance
400	359		of bonds in accordance with this subchapter, not to exceed the
401	360		aggregate principal amount of $44,922,833.
402	361		(b) The board may pledge irrevocably to the payment of bonds
403	362		authorized by this section all or any part of the revenue funds of
404	363		Stephen F. Austin State University, including student tuition
405	364		charges. The amount of a pledge made under this subsection may not
406	365		be reduced or abrogated while the bonds for which the pledge is
407	366		made, or bonds issued to refund those bonds, are outstanding.
408	367		(c) In lieu of financing a project described by Subsection
409	368		(a) for Stephen F. Austin State University, the board may finance in
410	369		the manner prescribed by that subsection an alternative project for

426	377		BONDS. (a) In addition to the other authority granted by this
427	378		subchapter, the board of regents of the Texas Tech University
428	379		System may acquire, purchase, construct, improve, renovate,
429	380		enlarge, or equip property and facilities, including roads and
430	381		related infrastructure, for projects to be financed through the
431	382		issuance of bonds in accordance with this subchapter and in
432	383		accordance with a systemwide revenue financing program adopted by
433	384		the board for the following institutions, not to exceed the
434	385		following aggregate principal amounts for the projects specified,
435	386		as follows:
436	387		(1) Angelo State University, $36 million for a central
437	388		plant maintenance and renovation;
438		-	(2) Texas Tech University:
439		-	(A) $72 million for renovations to address
440		-	deferred maintenance for campus buildings; and
441		-	(B) $8 million for maintenance and program
442		-	enhancement construction in Junction, Texas;
	389	+	(2) Texas Tech University, $52,409,972 for
	390	+	renovations to address deferred maintenance for campus buildings;
443	391		(3) Midwestern State University, $44,922,833 for
444	392		renovations to an existing building and other campus infrastructure
445	393		upgrades;
446	394		(4) Texas Tech University Health Sciences Center:
447	395		(A) $59,897,111 for maintenance and renovation
448	396		of an existing facility; and
449	397		(B) $18,717,847 for construction and equipment
450	398		of the physician assistant facility in Midland, Texas; and
451	399		(5) Texas Tech University Health Sciences Center at El
452	400		Paso, $59,897,111 for construction of a dental school building.
453	401		(b) The board may pledge irrevocably to the payment of bonds
454	402		authorized by this section all or any part of the revenue funds of
455	403		an institution, branch, or entity of the Texas Tech University
456	404		System, including student tuition charges. The amount of a pledge
457	405		made under this subsection may not be reduced or abrogated while the
458	406		bonds for which the pledge is made, or bonds issued to refund those
459	407		bonds, are outstanding.
460	408		(c) If sufficient funds are not available to the board to
461	409		meet its obligations under this section, the board may transfer
462	410		funds among institutions, branches, and entities of the Texas Tech
463	411		University System to ensure the most equitable and efficient
464	412		allocation of available resources for each institution, branch, or
465	413		entity to carry out its duties and purposes.
466	414		(d) In lieu of financing a project described by Subsection
467		-	(a) for an institution of higher education, entity, or university
468		-	system, the board may finance in the manner prescribed by that
469		-	subsection an alternative project for deferred maintenance,
470		-	infrastructure, or construction at the same institution, entity, or
471		-	system in an amount not to exceed the total of the amount authorized
472		-	for the project and any unspent amount from projects authorized for
473		-	the institution, entity, or system under this chapter. The board
474		-	shall notify the Texas Higher Education Coordinating Board of an
475		-	alternative project financed as provided by this subsection.
476		-	(e) For financing of an alternative project as provided by
477		-	Subsection (d) in an amount that exceeds $25 million, the board must
478		-	receive prior written approval from the governor and Legislative
479		-	Budget Board. A request for approval of financing of an alternative
480		-	project is considered approved unless the governor or the
481		-	Legislative Budget Board issues a written disapproval not later
482		-	than the 30th business day after the date of the receipt of the

	416	+	finance in the manner prescribed by that subsection an alternative
	417	+	project for deferred maintenance or infrastructure at the same
	418	+	institution or entity in an amount not to exceed the total of the
	419	+	amount authorized for the project and any unspent amount from
	420	+	projects authorized for the institution or entity under this
	421	+	chapter. The board shall notify the Texas Higher Education
	422	+	Coordinating Board of an alternative project financed as provided
	423	+	by this subsection.
484	424		Sec. 55.1799. TEXAS SOUTHERN UNIVERSITY; ADDITIONAL BONDS.
485	425		(a) In addition to the other authority granted by this subchapter,
486	426		the board of regents of Texas Southern University may acquire,
487	427		purchase, construct, improve, renovate, enlarge, or equip property
488	428		and facilities, including roads and related infrastructure, for
489	429		projects to be financed through the issuance of bonds in accordance
490	430		with this subchapter, not to exceed the following aggregate
491	431		principal amounts for the projects specified, as follows:
492	432		(1) $22,800,000 for renovation of the Nabrit Building;
493	433		(2) $2,400,000 for upgrades to signage and wayfinding;
494	434		(3) $40 million for facility maintenance and
495	435		renovation; and
496	436		(4) $30 million for construction of a health and
497	437		wellness center.
498	438		(b) The board may pledge irrevocably to the payment of bonds
499	439		authorized by this section all or any part of the revenue funds of
500	440		Texas Southern University, including student tuition charges. The
501	441		amount of a pledge made under this subsection may not be reduced or
502	442		abrogated while the bonds for which the pledge is made, or bonds
503	443		issued to refund those bonds, are outstanding.
504	444		(c) In lieu of financing a project described by Subsection
505	445		(a) for Texas Southern University, the board may finance in the
506	446		manner prescribed by that subsection an alternative project for
507		-	deferred maintenance, infrastructure, or construction at the
508		-	university in an amount not to exceed the total of the amount

524	456		acquire, purchase, construct, improve, renovate, enlarge, or equip
525	457		property and facilities, including roads and related
526	458		infrastructure, for projects to be financed through the issuance of
527	459		bonds in accordance with this subchapter for the following entity
528	460		and institutions, not to exceed the following aggregate principal
529	461		amounts for the projects specified, as follows:
530		-	(1) Texas State Technical College System, $33,~~300~~,~~000~~

531	463		for the East Williamson County Higher Education Center expansion;
532	464		(2) Texas State Technical College--Fort Bend,

544	476		(b) The board may pledge irrevocably to the payment of bonds
545	477		authorized by this section all or any part of the revenue funds of
546	478		an institution, branch, or entity of the Texas State Technical
547	479		College System, including student tuition charges. The amount of a
548	480		pledge made under this subsection may not be reduced or abrogated
549	481		while the bonds for which the pledge is made, or bonds issued to
550	482		refund those bonds, are outstanding.
551	483		(c) If sufficient funds are not available to the board to
552	484		meet its obligations under this section, the board may transfer
553	485		funds among institutions, branches, and entities of the Texas State
554	486		Technical College System to ensure the most equitable and efficient
555	487		allocation of available resources for each institution, branch, or
556	488		entity to carry out its duties and purposes.
557	489		(d) In lieu of financing a project described by Subsection
558		-	(a) for an institution of higher education, entity, or system, the
559		-	board may finance in the manner prescribed by that subsection an
560		-	alternative project for deferred maintenance, infrastructure, or
561		-	construction at the same institution, entity, or system in an
562		-	amount not to exceed the total of the amount authorized for the
563		-	project and any unspent amount from projects authorized for the
564		-	institution, entity, or system under this chapter. The board shall
565		-	notify the Texas Higher Education Coordinating Board of an
566		-	alternative project financed as provided by this subsection.
567		-	(e) For financing of an alternative project as provided by
568		-	Subsection (d) in an amount that exceeds $25 million, the board must
569		-	receive prior written approval from the governor and Legislative
570		-	Budget Board. A request for approval of financing of an alternative
571		-	project is considered approved unless the governor or the
572		-	Legislative Budget Board issues a written disapproval not later
573		-	than the 30th business day after the date of the receipt of the
574		-	request.
575		-	SECTION 3. Subchapter B, Chapter 55, Education Code, is
576		-	amended by adding Section 55.165 to read as follows:
577		-	Sec. 55.165. OVERSIGHT OF CERTAIN CAPITAL PROJECTS. (a)
578		-	This section applies only to a capital project for which the
579		-	issuance of bonds is specifically authorized under this chapter on
580		-	or after October 1, 2021.
581		-	(b) Notwithstanding Section 2262.002(a), Government Code,
582		-	or any other law, a project to which this section applies is subject
583		-	to oversight by the contract advisory team in accordance with
584		-	Subchapter C, Chapter 2262, Government Code, and the governing
585		-	board of the institution of higher education or university system
586		-	for which a project was authorized shall consult the contract
587		-	advisory team before expending any funds for purposes of the
588		-	project. The contract advisory team shall consider the model
589		-	guidelines for procurement and construction developed by the
590		-	capital project oversight advisory commission established by
591		-	S.B. 52, 87th Legislature, 3rd Called Session, 2021, when
592		-	consulting with a governing board for purposes of this subsection.
593		-	(c) Notwithstanding Section 322.020(f), Government Code, or
594		-	any other law, the governing board of an institution of higher
595		-	education or university system authorized to issue bonds for a
596		-	project to which this section applies shall report any major
597		-	contract as defined by Section 322.020(a), Government Code, that is
598		-	entered into for purposes of the project to the major contracts
599		-	database maintained by the Legislative Budget Board under Section
600		-	322.020, Government Code, not later than the 30th day after the date
601		-	the contract is executed.
602		-	SECTION 4. CAPITAL PROJECT OVERSIGHT ADVISORY COMMISSION.
603		-	(a) The Capital Project Oversight Advisory Commission is composed
604		-	of nine members as follows:
605		-	(1) the chair of the Senate Committee on Higher
606		-	Education;
607		-	(2) one member of the senate appointed by the
608		-	lieutenant governor;
609		-	(3) the chair of the House Committee on Higher
610		-	Education;
611		-	(4) one member of the house of representatives
612		-	appointed by the speaker of the house of representatives;
613		-	(5) one member of the public appointed by the
614		-	lieutenant governor;
615		-	(6) one member of the public appointed by the speaker
616		-	of the house of representatives;
617		-	(7) the chair of the Texas Facilities Commission;
618		-	(8) the commissioner of higher education; and
619		-	(9) one member of the public appointed by the governor
620		-	to serve as chair of the commission.
621		-	(b) Appointments to the commission shall be made without
622		-	regard to the race, color, disability, sex, religion, age, or
623		-	national origin of the appointee.
624		-	(c) The commission, in consultation with the Legislative
625		-	Budget Board and Comptroller of Public Accounts, shall develop
626		-	model guidelines to be considered by public institutions of higher
627		-	education and university systems for procurement and construction
628		-	related to capital projects for which the issuance of bonds is
629		-	specifically authorized under Chapter 55, Education Code.
630		-	(d) The commission may request reports and other
631		-	information from the Texas Higher Education Coordinating Board
632		-	relating to capital projects described by Subsection (c) of this
633		-	section.
634		-	(e) Not later than March 31, 2022, the commission shall
635		-	develop the model guidelines required by Subsection (c) of this
636		-	section.
637		-	(f) Not later than December 1, 2022, the commission shall
638		-	prepare and submit a report to the governor, lieutenant governor,
639		-	and speaker of the house of representatives on the model guidelines
640		-	developed under Subsection (c) of this section and recommendations
641		-	for legislative or other action.
642		-	(g) The commission is abolished effective December 31,
643		-	2022.
644		-	SECTION 5. This Act does not affect any authority or
