44 SENATE RESOLUTION
55 BE IT RESOLVED, BY THE Senate of the State of Texas, That
66 Senate Rule 12.03 and 12.04, be suspended in part as provided by
77 Senate Rule 12.08 to enable consideration of, and action on, the
88 following specific matters which may be contained in the
99 Conference Committee Report on Senate Bill 8.
1010 A. Suspend Senate Rule 12.03 (4) to allow the Conference
1111 Committee to add text on any matter which is not included in
1212 either the House or Senate version of the bill to read as follows:
1313 SECTION 4. DEPARTMENT OF STATE HEALTH SERVICES:
1414 COVID-19 SERVICES. (a) The amount of $2,000,000,000 is
1515 appropriated to the Department of State Health Services from
1616 money received by this state from the Coronavirus State Fiscal
1717 Recovery Fund (42 U.S.C. Section 802) established under the
1818 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
1919 deposited to the credit of the Coronavirus Relief Fund No. 325
2020 during the period beginning on the effective date of this Act and
2121 ending January 1, 2023, for the following purposes related to
2222 costs incurred during the period beginning March 3, 2021, and
2323 ending January 1, 2023, due to the coronavirus disease pandemic:
2424 (1) providing funding for surge staffing at state
2525 and local hospitals, long-term care facilities, psychiatric
2626 hospitals, and nursing facilities;
2727 (2) purchasing therapeutic drugs, including drugs
2828 for monoclonal antibody treatments; and
2929 (3) providing funding for the operation of regional
3030 infusion centers.
3131 (b) Notwithstanding Section 13.05, page IX-64, Chapter
3232 1053 (S.B. 1), Acts of the 87th Legislature, Regular Session,
3333 2021 (the General Appropriations Act), the Department of State
3434 Health Services shall expend any Coronavirus State Fiscal
3535 Recovery Funds freed-up as a result of reimbursements received by
3636 the Department of State Health Services from the Federal
3737 Emergency Management Agency related to expenditures paid from
3838 money appropriated under Subsection (a) of this section only
3939 after prior approval of the Legislative Budget Board.
4040 B. Suspend Senate Rule 12.03 (4) to allow the Conference
4141 Committee to add text on any matter which is not included in
4242 either the House or Senate version of the bill to read as follows:
4343 SECTION 6. DEPARTMENT OF CRIMINAL JUSTICE:
4444 COMPENSATION. (a) The amount of $359,673,191 is appropriated to
4545 the Department of Criminal Justice from money received by this
4646 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
4747 Section 802) established under the American Rescue Plan Act of
4848 2021 (Pub. L. No. 117-2) and deposited to the credit of the
4949 Coronavirus Relief Fund No. 325 for the purpose of providing
5050 compensation for agency employees for the state fiscal year
5151 beginning September 1, 2021.
5252 (b) The Department of Criminal Justice shall:
5353 (1) in consultation with the comptroller of public
5454 accounts and the Legislative Budget Board, determine the proper
5555 allocation of benefits included in the appropriations made under
5656 Subsection (a) of this section; and
5757 (2) identify the strategies and objectives for
5858 which the appropriations made under Subsection (a) of this
5959 section are directed.
6060 (c) It is the intent of the legislature that the
6161 Department of Criminal Justice consider the appropriations as a
6262 change in the method of finance of the compensation to be paid to
6363 agency employees and not as an increase in total appropriations
6464 to the agency.
6565 C. Suspend Senate Rule 12.03 (4) to allow the Conference
6666 Committee to add text on any matter which is not included in
6767 either the House or Senate version of the bill to read as follows:
6868 SECTION 8. HIGHER EDUCATION COORDINATING BOARD: TEXAS
6969 CHILD MENTAL HEALTH CARE CONSORTIUM. (a) The amount of
7070 $113,082,887 is appropriated to the Higher Education
7171 Coordinating Board from money received by this state from the
7272 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
7373 established under the American Rescue Plan Act of 2021 (Pub. L.
7474 No. 117-2) and deposited to the credit of the Coronavirus Relief
7575 Fund No. 325 for the purpose of supporting the operations and
7676 expansion of the Texas Child Mental Health Care Consortium to
7777 expand mental health initiatives for children, pregnant women,
7878 and women who are up to one year postpartum during the two-year
7979 period beginning on the effective date of this Act. At the
8080 direction of the Texas Child Mental Health Care Consortium, the
8181 Higher Education Coordinating Board shall transfer
8282 appropriations through interagency contracts with
8383 health-related institutions of higher education for the
8484 following purposes:
8585 (1) $20,578,442 for enhancements and expansion of
8686 the Child Psychiatry Access Network;
8787 (2) $56,218,976 for enhancements and expansion of
8888 the Texas Child Access Through Telemedicine program;
8989 (3) $32,991,791 for expansion of the child and
9090 adolescent mental health workforce; and
9191 (4) $3,293,676 for administrative expenses.
9292 (b) Not later than December 1, 2021, out of money
9393 appropriated by Subsection (a) of this section, the Higher
9494 Education Coordinating Board shall transfer $3,293,676 to an
9595 institution of higher education designated by the Texas Child
9696 Mental Health Care Consortium for oversight and evaluation of the
9797 outlined initiatives by means of interagency agreements or any
9898 other necessary contracts.
9999 (c) The Texas Child Mental Health Care Consortium may
100100 transfer up to 10 percent of money appropriated for the purposes
101101 described by Subsection (a)(1), (2), or (3) of this section to
102102 any of the other purposes described by those provisions. The
103103 Texas Child Mental Health Care Consortium may transfer more than
104104 10 percent of funds for those purposes only with the prior
105105 approval for the transfer and expenditure from the Legislative
106106 Budget Board. A request for approval of the transfer and
107107 expenditure by the consortium is considered approved unless the
108108 Legislative Budget Board issues a written disapproval within 10
109109 business days of the receipt and review of the request by the
110110 Legislative Budget Board.
111111 (d) Out of money appropriated by Subsection (a) of this
112112 section, the Texas Child Mental Health Care Consortium may
113113 enhance the Child Psychiatry Access Network to improve perinatal
114114 mental health services.
115115 D. Suspend Senate Rule 12.03 (4) to allow the Conference
116116 Committee to add text on any matter which is not included in
117117 either the House or Senate version of the bill to read as follows:
118118 SECTION 10. HIGHER EDUCATION COORDINATING BOARD:
119119 UNIVERSITY CONSTRUCTION. (a) Contingent on legislation by the
120120 87th Legislature, 3rd Called Session, 2021, relating to the
121121 issuance of tuition revenue bonds, becoming law, the amount of
122122 $325,000,000 is appropriated to the Higher Education
123123 Coordinating Board from money received by this state from the
124124 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
125125 established under the American Rescue Plan Act of 2021 (Pub. L.
126126 No. 117-2) and deposited to the credit of the Coronavirus Relief
127127 Fund No. 325 for the purpose of university construction during
128128 the two-year period beginning on the effective date of this Act.
129129 (b) If an appropriation made under Subsection (a) of this
130130 section for any reason is determined by the United States
131131 Department of the Treasury or any other qualified state or
132132 federal authority to have been made for an improper use:
133133 (1) the appropriated money may not be spent and
134134 shall be retained in the treasury and available for later
135135 legislative appropriation; and
136136 (2) an amount equal to the amount of the
137137 appropriation that was determined to have been made for an
138138 improper use is appropriated from the general revenue fund to the
139139 Higher Education Coordinating Board for the purpose and period
140140 described by Subsection (a) of this section.
141141 E. Suspend Senate Rule 12.03 (4) to allow the Conference
142142 Committee to add text on any matter which is not included in
143143 either the House or Senate version of the bill to read as follows:
144144 SECTION 16. DEPARTMENT OF STATE HEALTH SERVICES: RIO
145145 GRANDE VALLEY. The amount of $16,700,000 is appropriated to the
146146 Department of State Health Services from money received by this
147147 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
148148 Section 802) established under the American Rescue Plan Act of
149149 2021 (Pub. L. No. 117-2) and deposited to the credit of the
150150 Coronavirus Relief Fund No. 325 for the purpose of upgrading
151151 existing laboratory facilities associated with a level 1 trauma
152152 facility in Hidalgo County and new laboratory infrastructure in
153153 Starr County during the two-year period beginning on the
154154 effective date of this Act.
155155 F. Suspend Senate Rule 12.03 (4) to allow the Conference
156156 Committee to add text on any matter which is not included in
157157 either the House or Senate version of the bill to read as follows:
158158 SECTION 25. DEPARTMENT OF INFORMATION RESOURCES:
159159 CYBERSECURITY PROJECTS. (a) The amount of $200,000,000 is
160160 appropriated to the Department of Information Resources for
161161 deposit into the Technology Improvement and Modernization Fund
162162 No. 187 and for use during the two-year period beginning on the
163163 effective date of this Act for the purpose of cybersecurity
164164 projects from money received by this state from the Coronavirus
165165 State Fiscal Recovery Fund (42 U.S.C. Section 802) established
166166 under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2)
167167 and deposited to the credit of the Coronavirus Relief Fund
168168 No. 325. Before spending money appropriated under this
169169 subsection, the department must receive approval for the
170170 proposed cybersecurity projects from the Joint Oversight
171171 Committee on Investment in Information Technology Improvement
172172 and Modernization Projects established under Section 2054.578,
173173 Government Code.
174174 (b) The capital budget authority of the Department of
175175 Information Resources in Chapter 1053 (S.B. 1), Acts of the 87th
176176 Legislature, Regular Session, 2021 (the General Appropriations
177177 Act), is increased by $200,000,000 for the appropriation made
178178 under Subsection (a) of this section.
179179 G. Suspend Senate Rule 12.04 (4) to allow the Conference
180180 Committee to exceed the amount of an item of appropriation
181181 contained in one version of the bill to read as follows:
182182 SECTION 31. DEPARTMENT OF TRANSPORTATION: PRESIDIO
183183 CUSTOMS INSPECTION STATION. The amount of $15,500,000 is
184184 appropriated to the Department of Transportation from money
185185 received by this state from the Coronavirus State Fiscal Recovery
186186 Fund (42 U.S.C. Section 802) established under the American
187187 Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the
188188 credit of the Coronavirus Relief Fund No. 325 for the purpose of
189189 providing funding for a customs inspection station on the South
190190 Orient Rail Line in Presidio, Texas, during the two-year period
191191 beginning on the effective date of this Act.
192192 H. Suspend Senate Rule 12.03 (4) to allow the Conference
193193 Committee to add text on any matter which is not included in
194194 either the House or Senate version of the bill to read as follows:
195195 SECTION 32. TEACHER RETIREMENT SYSTEM: TRS-CARE AND
196196 TRS-ACTIVECARE. (a) The amount of $286,337,761 is appropriated
197197 to the Teacher Retirement System from money received by this
198198 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
199199 Section 802) established under the American Rescue Plan Act of
200200 2021 (Pub. L. No. 117-2) and deposited to the credit of the
201201 Coronavirus Relief Fund No. 325 for the purpose of providing
202202 funding during the two-year period beginning on the effective
203203 date of this Act for coronavirus-related claims in TRS-Care and
204204 TRS-ActiveCare.
205205 (b) It is the intent of the legislature that premiums for
206206 TRS-Care and TRS-ActiveCare insurance policies not increase as a
207207 result of coronavirus-related claims.
208208 (c) Notwithstanding Subsection (b) of this section, it is
209209 the intent of the legislature that the premiums for TRS-Care and
210210 TRS-ActiveCare programs be calculated and adjusted taking into
211211 consideration the money appropriated under this section.
212212 I. Suspend Senate Rule 12.03 (4) to allow the Conference
213213 Committee to add text on any matter which is not included in
214214 either the House or Senate version of the bill to read as follows:
215215 SECTION 33. HEALTH AND HUMAN SERVICES COMMISSION:
216216 STAFFING NEEDS. (a) The amount of $378,300,000 is appropriated
217217 to the Health and Human Services Commission from money received
218218 by this state from the Coronavirus State Fiscal Recovery Fund (42
219219 U.S.C. Section 802) established under the American Rescue Plan
220220 Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
221221 Coronavirus Relief Fund No. 325 for the purpose of providing
222222 funding during the two-year period beginning on the effective
223223 date of this Act for the Health and Human Services Commission to
224224 administer one-time grants related to providing critical
225225 staffing needs resulting from frontline health care workers
226226 affected by COVID-19, including recruitment and retention
227227 bonuses for staff:
228228 (1) of nursing facilities, assisted living
229229 facilities, home health agencies, and facilities that serve
230230 persons with intellectual or developmental disabilities in an
231231 intermediate care facility for individuals with intellectual
232232 disabilities or related conditions (ICF/IID); or
233233 (2) who provide community attendant services.
234234 (b) It is the intent of the legislature that the Health
235235 and Human Services Commission prioritize grants to grantees that
236236 comply with the reporting requirements prescribed by Rider 143
237237 (Health and Human Services Commission), Chapter 1053 (S.B. 1),
238238 Acts of the 87th Legislature, Regular Session, 2021 (the General
239239 Appropriations Act), the reporting requirements established by
240240 Chapter 588 (S.B. 809), Acts of the 87th Legislature, Regular
241241 Session, 2021, or equivalent reporting requirements established
242242 by the Health and Human Services Commission.
243243 (c) Annually, the Health and Human Services Commission
244244 shall report to the Legislative Budget Board the grants awarded
245245 under this section. The report must include, for the year
246246 covered by the report, the amount of grants awarded, the award
247247 recipients, and the total amount of each grant used by the
248248 recipient. The report must be submitted to the Legislative
249249 Budget Board not later than December 1 of the year in which the
250250 report is due.
251251 (d) Of the amount appropriated under Subsection (a) of
252252 this section:
253253 (1) $200,000,000 shall be used only for grants for
254254 nursing facilities; and
255255 (2) $178,300,000 shall be used only for grants for
256256 assisted living facilities, home health agencies, community
257257 attendants, and facilities that serve persons with intellectual
258258 or developmental disabilities in an intermediate care facility
259259 for individuals with intellectual disabilities or related
260260 conditions (ICF/IID).
261261 (e) It is the intent of the legislature that the Health
262262 and Human Services Commission consider federal COVID-19 relief
263263 money received by providers when allocating the money described
264264 by Subsection (d)(2) of this section.
265265 J. Suspend Senate Rule 12.04 (4) to allow the Conference
266266 Committee to exceed the amount of an item of appropriation
267267 contained in one version of the bill to read as follows:
268268 SECTION 34. DEPARTMENT OF STATE HEALTH SERVICES:
269269 FEDERALLY QUALIFIED HEALTH CENTER INCUBATOR PROGRAM. The amount
270270 of $20,000,000 is appropriated to the Department of State Health
271271 Services from money received by this state from the Coronavirus
272272 State Fiscal Recovery Fund (42 U.S.C. Section 802) established
273273 under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2)
274274 and deposited to the credit of the Coronavirus Relief Fund
275275 No. 325 for use during the two-year period beginning on the
276276 effective date of this Act for the Federally Qualified Health
277277 Center Incubator Program.
278278 K. Suspend Senate Rule 12.04 (5) to allow the Conference
279279 Committee to add an item of appropriation that is not in either
280280 version of the bill to read as follows; Suspend Senate Rule 12.03
281281 (4) to allow the Conference Committee to add text on any matter
282282 which is not included in either the House or Senate version of the
283283 bill to read as follows:
284284 SECTION 35. DEPARTMENT OF STATE HEALTH SERVICES:
285285 EMERGENCY MEDICAL SERVICES. (a) The amount of $21,700,000 is
286286 appropriated to the Department of State Health Services from
287287 money received by this state from the Coronavirus State Fiscal
288288 Recovery Fund (42 U.S.C. Section 802) established under the
289289 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
290290 deposited to the credit of the Coronavirus Relief Fund No. 325
291291 for the purpose of providing funding for emergency medical
292292 response service staffing, including:
293293 (1) funding for programs to incentivize and
294294 increase the number of Emergency Medical Technicians (EMTs) and
295295 paramedics that provide care on an ambulance, including funding
296296 for emergency medical services workforce development initiatives
297297 at regional advisory councils; and
298298 (2) funding for Emergency Medical Services (EMS)
299299 education programs, including distance learning programs, to
300300 increase the number of EMTs and paramedics graduating from EMS
301301 education programs.
302302 (b) It is the intent of the legislature that, consistent
303303 with state law, the Department of State Health Services
304304 prioritize funding appropriated under Subsection (a) of this
305305 section for rural and underserved areas.
306306 L. Suspend Senate Rule 12.03 (4) to allow the Conference
307307 Committee to add text on any matter which is not included in
308308 either the House or Senate version of the bill to read as follows:
309309 SECTION 36. PARKS AND WILDLIFE DEPARTMENT: EDUCATION AND
310310 OUTREACH GRANTS. The amount of $40,000,000 is appropriated to
311311 the Parks and Wildlife Department from money received by this
312312 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
313313 Section 802) established under the American Rescue Plan Act of
314314 2021 (Pub. L. No. 117-2) and deposited to the credit of the
315315 Coronavirus Relief Fund No. 325 to be used during the two-year
316316 period beginning on the effective date of this Act for the
317317 purpose of providing funding for grants throughout this state as
318318 authorized by other law and consistent with Strategy C.2.1.,
319319 Outreach and Education, as listed in Chapter 1053 (S.B. 1), Acts
320320 of the 87th Legislature, Regular Session, 2021 (the General
321321 Appropriations Act).
322322 M. Suspend Senate Rule 12.04 (5) to allow the Conference
323323 Committee to add an item of appropriation that is not in either
324324 version of the bill to read as follows; Suspend Senate Rule 12.03
325325 (4) to allow the Conference Committee to add text on any matter
326326 which is not included in either the House or Senate version of the
327327 bill to read as follows:
328328 SECTION 39. TEXAS A&M UNIVERSITY: INSTITUTE FOR A
329329 DISASTER RESILIENT TEXAS. (a) The amount of $1,150,000 is
330330 appropriated to Texas A&M University - Galveston from money
331331 received by this state from the Coronavirus State Fiscal Recovery
332332 Fund (42 U.S.C. Section 802) established under the American
333333 Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the
334334 credit of the Coronavirus Relief Fund No. 325 for the purpose of
335335 providing funding to the Institute for a Disaster Resilient
336336 Texas.
337337 (b) Out of amounts appropriated by Subsection (a) of this
338338 section:
339339 (1) $1,000,000 may be used only for Digital Flood
340340 Risk Infrastructure for Underserved Communities; and
341341 (2) $150,000 may be used only for office space in
342342 Houston.
343343 N. Suspend Senate Rule 12.04 (5) to allow the Conference
344344 Committee to add an item of appropriation that is not in either
345345 version of the bill to read as follows; Suspend Senate Rule 12.03
346346 (4) to allow the Conference Committee to add text on any matter
347347 which is not included in either the House or Senate version of the
348348 bill to read as follows:
349349 SECTION 40. TEXAS TECH UNIVERSITY AND UNIVERSITY OF
350350 HOUSTON: INSTITUTIONAL ENHANCEMENTS. The amount of $100,000,000
351351 is appropriated from money received by this state from the
352352 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
353353 established under the American Rescue Plan Act of 2021 (Pub. L.
354354 No. 117-2) and deposited to the credit of the Coronavirus Relief
355355 Fund No. 325 for institutional enhancement during the two-year
356356 period beginning on the effective date of this Act to the
357357 following entities and in the following amounts:
358358 (1) $50,000,000 to Texas Tech University; and
359359 (2) $50,000,000 to the University of Houston.
360360 O. Suspend Senate Rule 12.04 (5) to allow the Conference
361361 Committee to add an item of appropriation that is not in either
362362 version of the bill to read as follows; Suspend Senate Rule 12.03
363363 (4) to allow the Conference Committee to add text on any matter
364364 which is not included in either the House or Senate version of the
365365 bill to read as follows:
366366 SECTION 41. COMPTROLLER OF PUBLIC ACCOUNTS: TEXAS SAFE
367367 KEEPING TRUST FUND. (a) The amount of $100,000,000 is
368368 appropriated to the comptroller of public accounts from money
369369 received by this state from the Coronavirus State Fiscal Recovery
370370 Fund (42 U.S.C. Section 802) established under the American
371371 Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the
372372 credit of the Coronavirus Relief Fund No. 325 for immediate
373373 deposit to an account or fund to be managed by the Texas Treasury
374374 Safekeeping Trust Company as trustee for the benefit of the State
375375 Preservation Board to maintain the Bob Bullock State History
376376 Museum.
377377 (b) If an appropriation made under Subsection (a) of this
378378 section for any reason is determined by the United States
379379 Department of the Treasury or any other qualified state or
380380 federal authority to have been made for an improper use:
381381 (1) the appropriated money may not be spent and
382382 shall be retained in the treasury and available for later
383383 legislative appropriation; and
384384 (2) an amount equal to the amount of the
385385 appropriation that was determined to have been made for an
386386 improper use is appropriated from the general revenue fund to the
387387 comptroller of public accounts for the purpose described by

396396 AQUARIUM CENTER. The amount of $3,000,000 is appropriated to the
397397 Parks and Wildlife Department from money received by this state
398398 from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
399399 Section 802) established under the American Rescue Plan Act of
400400 2021 (Pub. L. No. 117-2) and deposited to the credit of the
401401 Coronavirus Relief Fund No. 325 for the purpose of providing
402402 funding to the Texas State Aquarium Center for wildlife research
403403 during the two-year period beginning on the effective date of
404404 this Act.
405405 Q. Suspend Senate Rule 12.04 (5) to allow the Conference
406406 Committee to add an item of appropriation that is not in either
407407 version of the bill to read as follows; Suspend Senate Rule 12.03
408408 (4) to allow the Conference Committee to add text on any matter
409409 which is not included in either the House or Senate version of the
410410 bill to read as follows:
411411 SECTION 43. UNIVERSITY OF TEXAS AT AUSTIN: MARINE
412412 SCIENCE INSTITUTE HOUSING REPLACEMENT. The amount of $3,000,000
413413 is appropriated to the University of Texas at Austin from money
414414 received by this state from the Coronavirus State Fiscal Recovery
415415 Fund (42 U.S.C. Section 802) established under the American
416416 Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the
417417 credit of the Coronavirus Relief Fund No. 325 for the purpose of
418418 providing funding for the Marine Science Institute student
419419 housing replacement for the two-year period beginning on the
420420 effective date of this Act.
421421 R. Suspend Senate Rule 12.04 (5) to allow the Conference
422422 Committee to add an item of appropriation that is not in either
423423 version of the bill to read as follows; Suspend Senate Rule 12.03

432432 No. 117-2) and deposited to the credit of the Coronavirus Relief
433433 Fund No. 325 for the purpose of providing funding for the big
434434 brothers and big sisters program technological staff
435435 enhancements for the two-year period beginning on the effective
436436 date of this Act.

447447 Section 802) established under the American Rescue Plan Act of
448448 2021 (Pub. L. No. 117-2) and deposited to the credit of the
449449 Coronavirus Relief Fund No. 325 to the University of Texas at
450450 Austin for the Briscoe Garner Museum for the two-year period
451451 beginning on the effective date of this Act.
452452 T. Suspend Senate Rule 12.04 (5) to allow the Conference
453453 Committee to add an item of appropriation that is not in either
454454 version of the bill to read as follows; Suspend Senate Rule 12.03
455455 (4) to allow the Conference Committee to add text on any matter
456456 which is not included in either the House or Senate version of the
457457 bill to read as follows:
458458 SECTION 46. HIGHER EDUCATION COORDINATING BOARD: RURAL
459459 VETERINARIANS GRANT PROGRAM. The amount of $1,000,000 is
460460 appropriated to the Higher Education Coordinating Board from
461461 money received by this state from the Coronavirus State Fiscal
462462 Recovery Fund (42 U.S.C. Section 802) established under the
463463 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
464464 deposited to the credit of the Coronavirus Relief Fund No. 325
465465 for the purpose of providing funding for the rural veterinarians
466466 grant program for the two-year period beginning on the effective
467467 date of this Act.
468468 U. Suspend Senate Rule 12.04 (5) to allow the Conference
469469 Committee to add an item of appropriation that is not in either
470470 version of the bill to read as follows; Suspend Senate Rule 12.03
471471 (4) to allow the Conference Committee to add text on any matter
472472 which is not included in either the House or Senate version of the
473473 bill to read as follows:
474474 SECTION 47. STATE PRESERVATION BOARD: MAINTENANCE AND
475475 CAPITAL IMPROVEMENT PROJECTS. (a) The amount of $25,000,000 is
476476 appropriated to the State Preservation Board from money received
477477 by this state from the Coronavirus State Fiscal Recovery Fund (42
478478 U.S.C. Section 802) established under the American Rescue Plan
479479 Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
480480 Coronavirus Relief Fund No. 325 for the purpose of maintenance
481481 and capital improvement projects during the state fiscal
482482 biennium beginning September 1, 2021.
483483 (b) The capital budget authority of the State
484484 Preservation Board in Chapter 1053 (S.B. 1), Acts of the 87th
485485 Legislature, Regular Session, 2021 (the General Appropriations
486486 Act), is increased by $25,000,000 for the appropriation made
487487 under Subsection (a) of this section.
488488 V. Suspend Senate Rule 12.03 (4) to allow the Conference
489489 Committee to add text on any matter which is not included in
490490 either the House or Senate version of the bill to read as follows:
491491 SECTION 48. DEPARTMENT OF STATE HEALTH SERVICES AND
492492 HEALTH AND HUMAN SERVICES COMMISSION: FEDERAL FUNDS FOR
493493 HOSPITALS. It is the intent of the Legislature that the
494494 Department of State Health Services and the Health and Human
495495 Services Commission, in distributing any money received from the
496496 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
497497 established under the American Rescue Plan Act of 2021 (Pub. L.
498498 No. 117-2) and deposited to the credit of the Coronavirus Relief
499499 Fund No. 325 distribute the money appropriated by this Act to
500500 entities that are subject to the hospital price transparency
501501 public disclosure requirements required by 45 C.F.R. Sections
502502 180.10 - 180.60 and, on implementation of rules adopted under the
503503 chapter, by Chapter 327, Health and Safety Code.
504504 W. Suspend Senate Rule 12.03 (4) to allow the Conference
505505 Committee to add text on any matter which is not included in
506506 either the House or Senate version of the bill to read as follows:
507507 SECTION 49. REPORT ON FEDERAL FUNDS BY LEGISLATIVE
508508 BUDGET BOARD. (a) The Legislative Budget Board, in consultation
509509 with the comptroller of public accounts, shall report on the
510510 board's Internet website:
511511 (1) for each political subdivision in this state, an
512512 informational listing of any money appropriated by this Act and
513513 received by the subdivision; and
514514 (2) for each state agency and each institution of
515515 higher education that receives money appropriated by this Act, an
516516 informational listing of the following:
517517 (A) the amount of money received by the agency
518518 or institution;
519519 (B) the federal legislation that authorized
520520 distribution of the money to the state, agency, or institution
521521 and the state legislation, if applicable, that appropriated the
522522 money to the agency or institution;
523523 (C) the amount of money spent by the agency or
524524 institution;
525525 (D) the allowable uses for which the agency or
526526 institution may spend money received by the agency or institution
527527 and the purposes for which the agency or institution has spent
528528 the money;
529529 (E) the amount of money received by the agency
530530 or institution:
531531 (i) that the agency or institution has
532532 not spent; and
533533 (ii) that the agency or institution may
534534 spend without further appropriation; and
535535 (F) the time during which money received by
536536 the agency or institution was spent by the agency or institution,
537537 including the remaining time in which the agency or institution
538538 may spend the money without further appropriation.
539539 (b) This section does not apply to a hospital licensed
540540 under Chapter 241, Health and Safety Code, or a hospital owned
541541 and operated by this state.
542542 (c) It is the intent of the legislature that information
543543 required to be provided in a report on the Legislative Budget
544544 Board's Internet website under Subsection (a) of this section
545545 must be updated not less than once during each fiscal quarter and
546546 once on the first day of each fiscal quarter that occurs on or
547547 after December 1, 2021, until at least December 1, 2028.
548548 X. Suspend Senate Rule 12.03 (4) to allow the Conference
549549 Committee to add text on any matter which is not included in
550550 either the House or Senate version of the bill to read as follows:
551551 SECTION 50. LEGISLATIVE INTENT REGARDING
552552 APPROPRIATIONS. (a) It is the intent of the legislature that the
553553 appropriations made by this Act:
554554 (1) are one-time appropriations made for the
555555 purpose of addressing the needs of this state for the two-year
556556 period beginning on the effective date of this Act; and
557557 (2) be used:
558558 (A) only for purposes authorized by state and
559559 federal law, including guidance issued by the United States
560560 Department of the Treasury in 86 Fed. Reg. 26786 (May 17, 2021);
561561 and
562562 (B) before all other methods of finance, if
563563 more than one method of finance is available for the applicable
564564 purpose.
565565 (b) Except as specifically provided otherwise by this
566566 Act, it is the intent of the legislature that, if the United
567567 States Department of the Treasury or any other qualified state or
568568 federal authority determines that an appropriation made by this
569569 Act has been made for an improper use, the appropriated money not
570570 be spent and shall be retained in the treasury and available for
571571 later legislative appropriation.
572572 Y. Suspend Senate Rule 12.03 (4) to allow the Conference

575575 SECTION 51. APPROPRIATION AUTHORITY UNDER FEDERAL LAW.
576576 The appropriations made under Sections 2, 3, 6, 7, 8, 9, 10, 11,
577577 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28,
578578 29, 30, 31, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, and
579579 47 of this Act using money received by this state from the
580580 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
581581 established under the American Rescue Plan Act of 2021 (Pub. L.
582582 No. 117-2) are made in accordance with 42 U.S.C. Section
583583 802(c)(1)(C), which allows money from the Coronavirus State
584584 Fiscal Recovery Fund to be used to provide government services to
585585 the extent of a reduction in the revenue of a state government
586586 caused by the COVID-19 public health emergency relative to
587587 revenues collected in the most recent full fiscal year of the
588588 state government that ended before that emergency.
