5	5	BE IT RESOLVED, BY THE Senate of the State of Texas, That
6	6	Senate Rule 12.03 and 12.04, be suspended in part as provided by
7	7	Senate Rule 12.08 to enable consideration of, and action on, the
8	8	following specific matters which may be contained in the
9	9	Conference Committee Report on Senate Bill 8.
10	10	A. Suspend Senate Rule 12.03 (4) to allow the Conference
11	11	Committee to add text on any matter which is not included in
12	12	either the House or Senate version of the bill to read as follows:
13	13	SECTION 4. DEPARTMENT OF STATE HEALTH SERVICES:
14	14	COVID-19 SERVICES. (a) The amount of $2,000,000,000 is
15	15	appropriated to the Department of State Health Services from
16	16	money received by this state from the Coronavirus State Fiscal
17	17	Recovery Fund (42 U.S.C. Section 802) established under the
18	18	American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
19	19	deposited to the credit of the Coronavirus Relief Fund No. 325
20	20	during the period beginning on the effective date of this Act and
21	21	ending January 1, 2023, for the following purposes related to
22	22	costs incurred during the period beginning March 3, 2021, and
23	23	ending January 1, 2023, due to the coronavirus disease pandemic:
24	24	(1) providing funding for surge staffing at state
25	25	and local hospitals, long-term care facilities, psychiatric
26	26	hospitals, and nursing facilities;
27	27	(2) purchasing therapeutic drugs, including drugs
28	28	for monoclonal antibody treatments; and
29	29	(3) providing funding for the operation of regional
30	30	infusion centers.
31	31	(b) Notwithstanding Section 13.05, page IX-64, Chapter
32	32	1053 (S.B. 1), Acts of the 87th Legislature, Regular Session,
33	33	2021 (the General Appropriations Act), the Department of State
34	34	Health Services shall expend any Coronavirus State Fiscal
35	35	Recovery Funds freed-up as a result of reimbursements received by
36	36	the Department of State Health Services from the Federal
37	37	Emergency Management Agency related to expenditures paid from
38	38	money appropriated under Subsection (a) of this section only
39	39	after prior approval of the Legislative Budget Board.
40	40	B. Suspend Senate Rule 12.03 (4) to allow the Conference
41	41	Committee to add text on any matter which is not included in
42	42	either the House or Senate version of the bill to read as follows:
43	43	SECTION 6. DEPARTMENT OF CRIMINAL JUSTICE:
44	44	COMPENSATION. (a) The amount of $359,673,191 is appropriated to
45	45	the Department of Criminal Justice from money received by this
46	46	state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
47	47	Section 802) established under the American Rescue Plan Act of
48	48	2021 (Pub. L. No. 117-2) and deposited to the credit of the
49	49	Coronavirus Relief Fund No. 325 for the purpose of providing
50	50	compensation for agency employees for the state fiscal year
51	51	beginning September 1, 2021.
52	52	(b) The Department of Criminal Justice shall:
53	53	(1) in consultation with the comptroller of public
54	54	accounts and the Legislative Budget Board, determine the proper
55	55	allocation of benefits included in the appropriations made under
56	56	Subsection (a) of this section; and
57	57	(2) identify the strategies and objectives for
58	58	which the appropriations made under Subsection (a) of this
59	59	section are directed.
60	60	(c) It is the intent of the legislature that the
61	61	Department of Criminal Justice consider the appropriations as a
62	62	change in the method of finance of the compensation to be paid to
63	63	agency employees and not as an increase in total appropriations
64	64	to the agency.
65	65	C. Suspend Senate Rule 12.03 (4) to allow the Conference
66	66	Committee to add text on any matter which is not included in
67	67	either the House or Senate version of the bill to read as follows:
68	68	SECTION 8. HIGHER EDUCATION COORDINATING BOARD: TEXAS
69	69	CHILD MENTAL HEALTH CARE CONSORTIUM. (a) The amount of
70	70	$113,082,887 is appropriated to the Higher Education
71	71	Coordinating Board from money received by this state from the
72	72	Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
73	73	established under the American Rescue Plan Act of 2021 (Pub. L.
74	74	No. 117-2) and deposited to the credit of the Coronavirus Relief
75	75	Fund No. 325 for the purpose of supporting the operations and
76	76	expansion of the Texas Child Mental Health Care Consortium to
77	77	expand mental health initiatives for children, pregnant women,
78	78	and women who are up to one year postpartum during the two-year
79	79	period beginning on the effective date of this Act. At the
80	80	direction of the Texas Child Mental Health Care Consortium, the
81	81	Higher Education Coordinating Board shall transfer
82	82	appropriations through interagency contracts with
83	83	health-related institutions of higher education for the
84	84	following purposes:
85	85	(1) $20,578,442 for enhancements and expansion of
86	86	the Child Psychiatry Access Network;
87	87	(2) $56,218,976 for enhancements and expansion of
88	88	the Texas Child Access Through Telemedicine program;
89	89	(3) $32,991,791 for expansion of the child and
90	90	adolescent mental health workforce; and
91	91	(4) $3,293,676 for administrative expenses.
92	92	(b) Not later than December 1, 2021, out of money
93	93	appropriated by Subsection (a) of this section, the Higher
94	94	Education Coordinating Board shall transfer $3,293,676 to an
95	95	institution of higher education designated by the Texas Child
96	96	Mental Health Care Consortium for oversight and evaluation of the
97	97	outlined initiatives by means of interagency agreements or any
98	98	other necessary contracts.
99	99	(c) The Texas Child Mental Health Care Consortium may
100	100	transfer up to 10 percent of money appropriated for the purposes
101	101	described by Subsection (a)(1), (2), or (3) of this section to
102	102	any of the other purposes described by those provisions. The
103	103	Texas Child Mental Health Care Consortium may transfer more than
104	104	10 percent of funds for those purposes only with the prior
105	105	approval for the transfer and expenditure from the Legislative
106	106	Budget Board. A request for approval of the transfer and
107	107	expenditure by the consortium is considered approved unless the
108	108	Legislative Budget Board issues a written disapproval within 10
109	109	business days of the receipt and review of the request by the
110	110	Legislative Budget Board.
111	111	(d) Out of money appropriated by Subsection (a) of this
112	112	section, the Texas Child Mental Health Care Consortium may
113	113	enhance the Child Psychiatry Access Network to improve perinatal
114	114	mental health services.
115	115	D. Suspend Senate Rule 12.03 (4) to allow the Conference
116	116	Committee to add text on any matter which is not included in
117	117	either the House or Senate version of the bill to read as follows:
118	118	SECTION 10. HIGHER EDUCATION COORDINATING BOARD:
119	119	UNIVERSITY CONSTRUCTION. (a) Contingent on legislation by the
120	120	87th Legislature, 3rd Called Session, 2021, relating to the
121	121	issuance of tuition revenue bonds, becoming law, the amount of
122	122	$325,000,000 is appropriated to the Higher Education
123	123	Coordinating Board from money received by this state from the
124	124	Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
125	125	established under the American Rescue Plan Act of 2021 (Pub. L.
126	126	No. 117-2) and deposited to the credit of the Coronavirus Relief
127	127	Fund No. 325 for the purpose of university construction during
128	128	the two-year period beginning on the effective date of this Act.
129	129	(b) If an appropriation made under Subsection (a) of this
130	130	section for any reason is determined by the United States
131	131	Department of the Treasury or any other qualified state or
132	132	federal authority to have been made for an improper use:
133	133	(1) the appropriated money may not be spent and
134	134	shall be retained in the treasury and available for later
135	135	legislative appropriation; and
136	136	(2) an amount equal to the amount of the
137	137	appropriation that was determined to have been made for an
138	138	improper use is appropriated from the general revenue fund to the
139	139	Higher Education Coordinating Board for the purpose and period
140	140	described by Subsection (a) of this section.
141	141	E. Suspend Senate Rule 12.03 (4) to allow the Conference
142	142	Committee to add text on any matter which is not included in
143	143	either the House or Senate version of the bill to read as follows:
144	144	SECTION 16. DEPARTMENT OF STATE HEALTH SERVICES: RIO
145	145	GRANDE VALLEY. The amount of $16,700,000 is appropriated to the
146	146	Department of State Health Services from money received by this
147	147	state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
148	148	Section 802) established under the American Rescue Plan Act of
149	149	2021 (Pub. L. No. 117-2) and deposited to the credit of the
150	150	Coronavirus Relief Fund No. 325 for the purpose of upgrading
151	151	existing laboratory facilities associated with a level 1 trauma
152	152	facility in Hidalgo County and new laboratory infrastructure in
153	153	Starr County during the two-year period beginning on the
154	154	effective date of this Act.
155	155	F. Suspend Senate Rule 12.03 (4) to allow the Conference
156	156	Committee to add text on any matter which is not included in
157	157	either the House or Senate version of the bill to read as follows:
158	158	SECTION 25. DEPARTMENT OF INFORMATION RESOURCES:
159	159	CYBERSECURITY PROJECTS. (a) The amount of $200,000,000 is
160	160	appropriated to the Department of Information Resources for
161	161	deposit into the Technology Improvement and Modernization Fund
162	162	No. 187 and for use during the two-year period beginning on the
163	163	effective date of this Act for the purpose of cybersecurity
164	164	projects from money received by this state from the Coronavirus
165	165	State Fiscal Recovery Fund (42 U.S.C. Section 802) established
166	166	under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2)
167	167	and deposited to the credit of the Coronavirus Relief Fund
168	168	No. 325. Before spending money appropriated under this
169	169	subsection, the department must receive approval for the
170	170	proposed cybersecurity projects from the Joint Oversight
171	171	Committee on Investment in Information Technology Improvement
172	172	and Modernization Projects established under Section 2054.578,
173	173	Government Code.
174	174	(b) The capital budget authority of the Department of
175	175	Information Resources in Chapter 1053 (S.B. 1), Acts of the 87th
176	176	Legislature, Regular Session, 2021 (the General Appropriations
177	177	Act), is increased by $200,000,000 for the appropriation made
178	178	under Subsection (a) of this section.
179	179	G. Suspend Senate Rule 12.04 (4) to allow the Conference
180	180	Committee to exceed the amount of an item of appropriation
181	181	contained in one version of the bill to read as follows:
182	182	SECTION 31. DEPARTMENT OF TRANSPORTATION: PRESIDIO
183	183	CUSTOMS INSPECTION STATION. The amount of $15,500,000 is
184	184	appropriated to the Department of Transportation from money
185	185	received by this state from the Coronavirus State Fiscal Recovery
186	186	Fund (42 U.S.C. Section 802) established under the American
187	187	Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the
188	188	credit of the Coronavirus Relief Fund No. 325 for the purpose of
189	189	providing funding for a customs inspection station on the South
190	190	Orient Rail Line in Presidio, Texas, during the two-year period
191	191	beginning on the effective date of this Act.
192	192	H. Suspend Senate Rule 12.03 (4) to allow the Conference
193	193	Committee to add text on any matter which is not included in
194	194	either the House or Senate version of the bill to read as follows:
195	195	SECTION 32. TEACHER RETIREMENT SYSTEM: TRS-CARE AND
196	196	TRS-ACTIVECARE. (a) The amount of $286,337,761 is appropriated
197	197	to the Teacher Retirement System from money received by this
198	198	state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
199	199	Section 802) established under the American Rescue Plan Act of
200	200	2021 (Pub. L. No. 117-2) and deposited to the credit of the
201	201	Coronavirus Relief Fund No. 325 for the purpose of providing
202	202	funding during the two-year period beginning on the effective
203	203	date of this Act for coronavirus-related claims in TRS-Care and
204	204	TRS-ActiveCare.
205	205	(b) It is the intent of the legislature that premiums for
206	206	TRS-Care and TRS-ActiveCare insurance policies not increase as a
207	207	result of coronavirus-related claims.
208	208	(c) Notwithstanding Subsection (b) of this section, it is
209	209	the intent of the legislature that the premiums for TRS-Care and
210	210	TRS-ActiveCare programs be calculated and adjusted taking into
211	211	consideration the money appropriated under this section.
212	212	I. Suspend Senate Rule 12.03 (4) to allow the Conference
213	213	Committee to add text on any matter which is not included in
214	214	either the House or Senate version of the bill to read as follows:
215	215	SECTION 33. HEALTH AND HUMAN SERVICES COMMISSION:
216	216	STAFFING NEEDS. (a) The amount of $378,300,000 is appropriated
217	217	to the Health and Human Services Commission from money received
218	218	by this state from the Coronavirus State Fiscal Recovery Fund (42
219	219	U.S.C. Section 802) established under the American Rescue Plan
220	220	Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
221	221	Coronavirus Relief Fund No. 325 for the purpose of providing
222	222	funding during the two-year period beginning on the effective
223	223	date of this Act for the Health and Human Services Commission to
224	224	administer one-time grants related to providing critical
225	225	staffing needs resulting from frontline health care workers
226	226	affected by COVID-19, including recruitment and retention
227	227	bonuses for staff:
228	228	(1) of nursing facilities, assisted living
229	229	facilities, home health agencies, and facilities that serve
230	230	persons with intellectual or developmental disabilities in an
231	231	intermediate care facility for individuals with intellectual
232	232	disabilities or related conditions (ICF/IID); or
233	233	(2) who provide community attendant services.
234	234	(b) It is the intent of the legislature that the Health
235	235	and Human Services Commission prioritize grants to grantees that
236	236	comply with the reporting requirements prescribed by Rider 143
237	237	(Health and Human Services Commission), Chapter 1053 (S.B. 1),
238	238	Acts of the 87th Legislature, Regular Session, 2021 (the General
239	239	Appropriations Act), the reporting requirements established by
240	240	Chapter 588 (S.B. 809), Acts of the 87th Legislature, Regular
241	241	Session, 2021, or equivalent reporting requirements established
242	242	by the Health and Human Services Commission.
243	243	(c) Annually, the Health and Human Services Commission
244	244	shall report to the Legislative Budget Board the grants awarded
245	245	under this section. The report must include, for the year
246	246	covered by the report, the amount of grants awarded, the award
247	247	recipients, and the total amount of each grant used by the
248	248	recipient. The report must be submitted to the Legislative
249	249	Budget Board not later than December 1 of the year in which the
250	250	report is due.
251	251	(d) Of the amount appropriated under Subsection (a) of
252	252	this section:
253	253	(1) $200,000,000 shall be used only for grants for
254	254	nursing facilities; and
255	255	(2) $178,300,000 shall be used only for grants for
256	256	assisted living facilities, home health agencies, community
257	257	attendants, and facilities that serve persons with intellectual
258	258	or developmental disabilities in an intermediate care facility
259	259	for individuals with intellectual disabilities or related
260	260	conditions (ICF/IID).
261	261	(e) It is the intent of the legislature that the Health
262	262	and Human Services Commission consider federal COVID-19 relief
263	263	money received by providers when allocating the money described
264	264	by Subsection (d)(2) of this section.
265	265	J. Suspend Senate Rule 12.04 (4) to allow the Conference
266	266	Committee to exceed the amount of an item of appropriation
267	267	contained in one version of the bill to read as follows:
268	268	SECTION 34. DEPARTMENT OF STATE HEALTH SERVICES:
269	269	FEDERALLY QUALIFIED HEALTH CENTER INCUBATOR PROGRAM. The amount
270	270	of $20,000,000 is appropriated to the Department of State Health
271	271	Services from money received by this state from the Coronavirus
272	272	State Fiscal Recovery Fund (42 U.S.C. Section 802) established
273	273	under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2)
274	274	and deposited to the credit of the Coronavirus Relief Fund
275	275	No. 325 for use during the two-year period beginning on the
276	276	effective date of this Act for the Federally Qualified Health
277	277	Center Incubator Program.
278	278	K. Suspend Senate Rule 12.04 (5) to allow the Conference
279	279	Committee to add an item of appropriation that is not in either
280	280	version of the bill to read as follows; Suspend Senate Rule 12.03

284	284	SECTION 35. DEPARTMENT OF STATE HEALTH SERVICES:
285	285	EMERGENCY MEDICAL SERVICES. (a) The amount of $21,700,000 is
286	286	appropriated to the Department of State Health Services from
287	287	money received by this state from the Coronavirus State Fiscal
288	288	Recovery Fund (42 U.S.C. Section 802) established under the
289	289	American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
290	290	deposited to the credit of the Coronavirus Relief Fund No. 325
291	291	for the purpose of providing funding for emergency medical
292	292	response service staffing, including:
293	293	(1) funding for programs to incentivize and
294	294	increase the number of Emergency Medical Technicians (EMTs) and
295	295	paramedics that provide care on an ambulance, including funding
296	296	for emergency medical services workforce development initiatives
297	297	at regional advisory councils; and
298	298	(2) funding for Emergency Medical Services (EMS)
299	299	education programs, including distance learning programs, to
300	300	increase the number of EMTs and paramedics graduating from EMS
301	301	education programs.
302	302	(b) It is the intent of the legislature that, consistent
303	303	with state law, the Department of State Health Services
304	304	prioritize funding appropriated under Subsection (a) of this
305	305	section for rural and underserved areas.
306	306	L. Suspend Senate Rule 12.03 (4) to allow the Conference
307	307	Committee to add text on any matter which is not included in
308	308	either the House or Senate version of the bill to read as follows:
309	309	SECTION 36. PARKS AND WILDLIFE DEPARTMENT: EDUCATION AND
310	310	OUTREACH GRANTS. The amount of $40,000,000 is appropriated to
311	311	the Parks and Wildlife Department from money received by this
312	312	state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
313	313	Section 802) established under the American Rescue Plan Act of
314	314	2021 (Pub. L. No. 117-2) and deposited to the credit of the
315	315	Coronavirus Relief Fund No. 325 to be used during the two-year
316	316	period beginning on the effective date of this Act for the
317	317	purpose of providing funding for grants throughout this state as
318	318	authorized by other law and consistent with Strategy C.2.1.,
319	319	Outreach and Education, as listed in Chapter 1053 (S.B. 1), Acts
320	320	of the 87th Legislature, Regular Session, 2021 (the General
321	321	Appropriations Act).
322	322	M. Suspend Senate Rule 12.04 (5) to allow the Conference
323	323	Committee to add an item of appropriation that is not in either
324	324	version of the bill to read as follows; Suspend Senate Rule 12.03
325	325	(4) to allow the Conference Committee to add text on any matter
326	326	which is not included in either the House or Senate version of the

328	328	SECTION 39. TEXAS A&M UNIVERSITY: INSTITUTE FOR A
329	329	DISASTER RESILIENT TEXAS. (a) The amount of $1,150,000 is
330	330	appropriated to Texas A&M University - Galveston from money
331	331	received by this state from the Coronavirus State Fiscal Recovery
332	332	Fund (42 U.S.C. Section 802) established under the American
333	333	Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the
334	334	credit of the Coronavirus Relief Fund No. 325 for the purpose of
335	335	providing funding to the Institute for a Disaster Resilient
336	336	Texas.
337	337	(b) Out of amounts appropriated by Subsection (a) of this
338	338	section:
339	339	(1) $1,000,000 may be used only for Digital Flood
340	340	Risk Infrastructure for Underserved Communities; and
341	341	(2) $150,000 may be used only for office space in
342	342	Houston.
343	343	N. Suspend Senate Rule 12.04 (5) to allow the Conference
344	344	Committee to add an item of appropriation that is not in either
345	345	version of the bill to read as follows; Suspend Senate Rule 12.03
346	346	(4) to allow the Conference Committee to add text on any matter
347	347	which is not included in either the House or Senate version of the
348	348	bill to read as follows:
349	349	SECTION 40. TEXAS TECH UNIVERSITY AND UNIVERSITY OF
350	350	HOUSTON: INSTITUTIONAL ENHANCEMENTS. The amount of $100,000,000
351	351	is appropriated from money received by this state from the
352	352	Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
353	353	established under the American Rescue Plan Act of 2021 (Pub. L.
354	354	No. 117-2) and deposited to the credit of the Coronavirus Relief
355	355	Fund No. 325 for institutional enhancement during the two-year
356	356	period beginning on the effective date of this Act to the
357	357	following entities and in the following amounts:
358	358	(1) $50,000,000 to Texas Tech University; and
359	359	(2) $50,000,000 to the University of Houston.
360	360	O. Suspend Senate Rule 12.04 (5) to allow the Conference
361	361	Committee to add an item of appropriation that is not in either
362	362	version of the bill to read as follows; Suspend Senate Rule 12.03
363	363	(4) to allow the Conference Committee to add text on any matter

366	366	SECTION 41. COMPTROLLER OF PUBLIC ACCOUNTS: TEXAS SAFE
367	367	KEEPING TRUST FUND. (a) The amount of $100,000,000 is
368	368	appropriated to the comptroller of public accounts from money
369	369	received by this state from the Coronavirus State Fiscal Recovery
370	370	Fund (42 U.S.C. Section 802) established under the American
371	371	Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the
372	372	credit of the Coronavirus Relief Fund No. 325 for immediate
373	373	deposit to an account or fund to be managed by the Texas Treasury
374	374	Safekeeping Trust Company as trustee for the benefit of the State
375	375	Preservation Board to maintain the Bob Bullock State History
376	376	Museum.
377	377	(b) If an appropriation made under Subsection (a) of this
378	378	section for any reason is determined by the United States
379	379	Department of the Treasury or any other qualified state or
380	380	federal authority to have been made for an improper use:
381	381	(1) the appropriated money may not be spent and

398	398	from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
399	399	Section 802) established under the American Rescue Plan Act of
400	400	2021 (Pub. L. No. 117-2) and deposited to the credit of the
401	401	Coronavirus Relief Fund No. 325 for the purpose of providing
402	402	funding to the Texas State Aquarium Center for wildlife research
403	403	during the two-year period beginning on the effective date of
404	404	this Act.

478	478	U.S.C. Section 802) established under the American Rescue Plan
479	479	Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
480	480	Coronavirus Relief Fund No. 325 for the purpose of maintenance
481	481	and capital improvement projects during the state fiscal
482	482	biennium beginning September 1, 2021.
483	483	(b) The capital budget authority of the State
484	484	Preservation Board in Chapter 1053 (S.B. 1), Acts of the 87th
485	485	Legislature, Regular Session, 2021 (the General Appropriations
486	486	Act), is increased by $25,000,000 for the appropriation made
487	487	under Subsection (a) of this section.
488	488	V. Suspend Senate Rule 12.03 (4) to allow the Conference
489	489	Committee to add text on any matter which is not included in
490	490	either the House or Senate version of the bill to read as follows:
491	491	SECTION 48. DEPARTMENT OF STATE HEALTH SERVICES AND
492	492	HEALTH AND HUMAN SERVICES COMMISSION: FEDERAL FUNDS FOR
493	493	HOSPITALS. It is the intent of the Legislature that the
494	494	Department of State Health Services and the Health and Human
495	495	Services Commission, in distributing any money received from the
496	496	Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
497	497	established under the American Rescue Plan Act of 2021 (Pub. L.
498	498	No. 117-2) and deposited to the credit of the Coronavirus Relief
499	499	Fund No. 325 distribute the money appropriated by this Act to
500	500	entities that are subject to the hospital price transparency
501	501	public disclosure requirements required by 45 C.F.R. Sections
502	502	180.10 - 180.60 and, on implementation of rules adopted under the
503	503	chapter, by Chapter 327, Health and Safety Code.
504	504	W. Suspend Senate Rule 12.03 (4) to allow the Conference
505	505	Committee to add text on any matter which is not included in
506	506	either the House or Senate version of the bill to read as follows:
507	507	SECTION 49. REPORT ON FEDERAL FUNDS BY LEGISLATIVE
508	508	BUDGET BOARD. (a) The Legislative Budget Board, in consultation
509	509	with the comptroller of public accounts, shall report on the
510	510	board's Internet website:
511	511	(1) for each political subdivision in this state, an
512	512	informational listing of any money appropriated by this Act and
513	513	received by the subdivision; and
514	514	(2) for each state agency and each institution of
515	515	higher education that receives money appropriated by this Act, an
516	516	informational listing of the following:
517	517	(A) the amount of money received by the agency
518	518	or institution;
519	519	(B) the federal legislation that authorized
520	520	distribution of the money to the state, agency, or institution
521	521	and the state legislation, if applicable, that appropriated the
522	522	money to the agency or institution;
523	523	(C) the amount of money spent by the agency or
524	524	institution;
525	525	(D) the allowable uses for which the agency or
526	526	institution may spend money received by the agency or institution
527	527	and the purposes for which the agency or institution has spent
528	528	the money;
529	529	(E) the amount of money received by the agency
530	530	or institution:
531	531	(i) that the agency or institution has
532	532	not spent; and
533	533	(ii) that the agency or institution may
534	534	spend without further appropriation; and
535	535	(F) the time during which money received by
536	536	the agency or institution was spent by the agency or institution,
537	537	including the remaining time in which the agency or institution
538	538	may spend the money without further appropriation.
539	539	(b) This section does not apply to a hospital licensed
540	540	under Chapter 241, Health and Safety Code, or a hospital owned
541	541	and operated by this state.
542	542	(c) It is the intent of the legislature that information
543	543	required to be provided in a report on the Legislative Budget
544	544	Board's Internet website under Subsection (a) of this section
545	545	must be updated not less than once during each fiscal quarter and
546	546	once on the first day of each fiscal quarter that occurs on or
547	547	after December 1, 2021, until at least December 1, 2028.
548	548	X. Suspend Senate Rule 12.03 (4) to allow the Conference
549	549	Committee to add text on any matter which is not included in
550	550	either the House or Senate version of the bill to read as follows:
551	551	SECTION 50. LEGISLATIVE INTENT REGARDING
552	552	APPROPRIATIONS. (a) It is the intent of the legislature that the
553	553	appropriations made by this Act:
554	554	(1) are one-time appropriations made for the
555	555	purpose of addressing the needs of this state for the two-year
556	556	period beginning on the effective date of this Act; and
557	557	(2) be used:
558	558	(A) only for purposes authorized by state and
559	559	federal law, including guidance issued by the United States
560	560	Department of the Treasury in 86 Fed. Reg. 26786 (May 17, 2021);
561	561	and
562	562	(B) before all other methods of finance, if
563	563	more than one method of finance is available for the applicable
564	564	purpose.
565	565	(b) Except as specifically provided otherwise by this
566	566	Act, it is the intent of the legislature that, if the United
567	567	States Department of the Treasury or any other qualified state or
568	568	federal authority determines that an appropriation made by this
569	569	Act has been made for an improper use, the appropriated money not
570	570	be spent and shall be retained in the treasury and available for
571	571	later legislative appropriation.
572	572	Y. Suspend Senate Rule 12.03 (4) to allow the Conference

575	575	SECTION 51. APPROPRIATION AUTHORITY UNDER FEDERAL LAW.

585	585	the extent of a reduction in the revenue of a state government
586	586	caused by the COVID-19 public health emergency relative to
587	587	revenues collected in the most recent full fiscal year of the
588	588	state government that ended before that emergency.
