44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to protected expression, intellectual freedom, and
77 viewpoint diversity at public institutions of higher education.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 51.354, Education Code, is amended to
1010 read as follows:
1111 Sec. 51.354. INSTITUTIONAL RESPONSIBILITY. In addition to
1212 specific responsibilities imposed by this code or other law, each
1313 institution of higher education has the general responsibility to
1414 [serve the public and, within the institution's role and mission,
1515 to]:
1616 (1) permit the diffusion of [transmit] culture through
1717 general education;
1818 (2) facilitate the discovery, improvement, and
1919 dissemination of [extend] knowledge;
2020 (3) teach and train students for professions;
2121 (4) provide for scientific, engineering, medical, and
2222 other academic research;
2323 (5) protect intellectual exploration and academic
2424 freedom;
2525 (6) strive for intellectual excellence;
2626 (7) provide educational opportunity through [for all
2727 who can benefit from] postsecondary education and training; [and]
2828 (8) provide continuing education opportunities;
2929 (9) foster a diversity of viewpoints; and
3030 (10) maintain political, social, and cultural
3131 neutrality.
3232 SECTION 2. Section 51.9315(a)(2), Education Code, is
3333 amended to read as follows:
3434 (2) "Expressive activities" means any speech or
3535 expressive conduct protected by the First Amendment to the United
3636 States Constitution or by Section 8, Article I, Texas Constitution,
3737 and includes assemblies, protests, speeches, the distribution of
3838 written material, the carrying of signs, [and] the circulation of
3939 petitions, and published or unpublished faculty research,
4040 lectures, writings, and commentary. The term does not include
4141 commercial speech.
4242 SECTION 3. Section 51.9315, Education Code, is amended by
4343 amending Subsection (f) and adding Subsection (k) to read as
4444 follows:
4545 (f) Each institution of higher education shall adopt a
4646 policy detailing students' rights and responsibilities regarding
4747 expressive activities at the institution. The policy must:
4848 (1) demonstrate a commitment to intellectual freedom
4949 and viewpoint diversity;
5050 (2) prohibit:
5151 (A) the funding, promotion, sponsorship, or
5252 support of:
5353 (i) any office of diversity, equity, and
5454 inclusion; and
5555 (ii) any office that funds, promotes,
5656 sponsors, or supports an initiative or formulation of diversity,
5757 equity, and inclusion beyond what is necessary to uphold the equal
5858 protection of the laws under the Fourteenth Amendment to the United
5959 States Constitution; and
6060 (B) the endorsement or dissuasion of, or
6161 interference with, any lifestyle, race, sex, religion, or culture.
6262 (3) allow:
6363 (A) any person to, subject to reasonable
6464 restrictions adopted under Subsection (d), engage in expressive
6565 activities on campus, including by responding to the expressive
6666 activities of others; and
6767 (B) student organizations and faculty to,
6868 subject to Subsection (h), invite speakers to speak on campus;
6969 (4) [(2)] establish disciplinary sanctions for
7070 students, student organizations, or faculty who unduly interfere
7171 with the expressive activities of others on campus;
7272 (5) [(3)] include a grievance procedure for
7373 addressing complaints of a violation of this section;
7474 (6) [(4)] be approved by a majority vote of the
7575 institution's governing board before final adoption; and
7676 (7) [(5)] be posted on the institution's Internet
7777 website.
7878 (k) A person may bring an action for injunctive relief
7979 against an institution of higher education to compel the
8080 institution to comply with this section. If the person prevails in
8181 the action, the court shall award reasonable attorney's fees and
8282 court costs to the person. The institution shall pay the fees and
8383 costs from the budget of the office of the chief executive officer
8484 of the institution or the institution's system, as applicable.
8585 SECTION 4. This Act takes effect September 1, 2023.
