| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 201.051(b), Transportation Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (b) The members shall be appointed to reflect the diverse |
|---|
| 15 | 15 | | geographic regions and population groups of this state, including: |
|---|
| 16 | 16 | | (1) at least one [. One] member who must reside in a |
|---|
| 17 | 17 | | rural area and be a registered voter of a county with a population |
|---|
| 18 | 18 | | of less than 150,000; and |
|---|
| 19 | 19 | | (2) at least one member who: |
|---|
| 20 | 20 | | (A) must reside and be a registered voter in a |
|---|
| 21 | 21 | | county bordering the United Mexican States; and |
|---|
| 22 | 22 | | (B) may not be the same member as described by |
|---|
| 23 | 23 | | Subdivision (1). |
|---|
| 24 | 24 | | SECTION 2. The changes in law made by this Act in the |
|---|
| 25 | 25 | | qualifications of members of the Texas Transportation Commission do |
|---|
| 26 | 26 | | not affect the entitlement of a member serving on the commission |
|---|
| 27 | 27 | | immediately before the effective date of this Act to continue to |
|---|
| 28 | 28 | | serve for the remainder of the member's term. As the terms of |
|---|
| 29 | 29 | | commission members expire, the governor shall appoint or reappoint |
|---|
| 30 | 30 | | a member who has the qualifications required for a member under |
|---|
| 31 | 31 | | Section 201.051, Transportation Code, as amended by this Act. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2023. |
