55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to status notifications provided by the Parks and Wildlife
88 Department to a person who submits a rulemaking petition or
99 accessibility complaint.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife
1212 Code, is amended by adding Section 11.01645 to read as follows:
1313 Sec. 11.01645. STATUS NOTIFICATIONS REGARDING PETITION FOR
1414 ADOPTION OF RULES. (a) The department shall notify a person who
1515 submits a petition under Section 2001.021, Government Code, of the
1616 status of the petition at least once every 15 days until the
1717 commission initiates a rulemaking proceeding under Section
1818 2001.021(c), Government Code, or the petition is denied.
1919 (b) If the commission initiates a rulemaking proceeding
2020 under Section 2001.021(c), Government Code, the department shall
2121 notify the person described by Subsection (a) of the status of the
2222 proceeding at least once every 15 days until a final rule is adopted
2323 or a proposed rule is withdrawn in the proceeding.
2424 (c) The notification requirements of this section are in
2525 addition to any other notice requirements prescribed by commission
2626 rules or other law.
2727 SECTION 2. The heading to Section 11.0165, Parks and
2828 Wildlife Code, is amended to read as follows:
2929 Sec. 11.0165. COMPLAINTS; STATUS NOTIFICATIONS.
3030 SECTION 3. Section 11.0165(c), Parks and Wildlife Code, is
3131 amended to read as follows:
3232 (c) Except as otherwise provided by this subsection, the
3333 [The] department shall periodically notify the complaint parties of
3434 the status of the complaint until final disposition unless the
3535 notice would jeopardize an investigation. The department shall
3636 notify a person who submits an accessibility complaint to the
3737 department pursuant to the Americans with Disabilities Act of 1990
3838 (42 U.S.C. Section 12101 et seq.) of the status of the complaint at
3939 least once every 15 days until final disposition.
4040 SECTION 4. This Act takes effect September 1, 2023.
