| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife |
|---|
| 12 | 12 | | Code, is amended by adding Section 11.01645 to read as follows: |
|---|
| 13 | 13 | | Sec. 11.01645. STATUS NOTIFICATIONS REGARDING PETITION FOR |
|---|
| 14 | 14 | | ADOPTION OF RULES. (a) The department shall notify a person who |
|---|
| 15 | 15 | | submits a petition under Section 2001.021, Government Code, of the |
|---|
| 16 | 16 | | status of the petition at least once every 15 days until the |
|---|
| 17 | 17 | | commission initiates a rulemaking proceeding under Section |
|---|
| 18 | 18 | | 2001.021(c), Government Code, or the petition is denied. |
|---|
| 19 | 19 | | (b) If the commission initiates a rulemaking proceeding |
|---|
| 20 | 20 | | under Section 2001.021(c), Government Code, the department shall |
|---|
| 21 | 21 | | notify the person described by Subsection (a) of the status of the |
|---|
| 22 | 22 | | proceeding at least once every 15 days until a final rule is adopted |
|---|
| 23 | 23 | | or a proposed rule is withdrawn in the proceeding. |
|---|
| 24 | 24 | | (c) The notification requirements of this section are in |
|---|
| 25 | 25 | | addition to any other notice requirements prescribed by commission |
|---|
| 26 | 26 | | rules or other law. |

| 27 | 27 | | SECTION 2. The heading to Section 11.0165, Parks and |
|---|
| 28 | 28 | | Wildlife Code, is amended to read as follows: |
|---|
| 29 | 29 | | Sec. 11.0165. COMPLAINTS; STATUS NOTIFICATIONS. |
|---|
| 30 | 30 | | SECTION 3. Section 11.0165(c), Parks and Wildlife Code, is |
|---|
| 31 | 31 | | amended to read as follows: |
|---|
| 32 | 32 | | (c) Except as otherwise provided by this subsection, the |
|---|
| 33 | 33 | | [The] department shall periodically notify the complaint parties of |
|---|
| 34 | 34 | | the status of the complaint until final disposition unless the |
|---|
| 35 | 35 | | notice would jeopardize an investigation. The department shall |
|---|
| 36 | 36 | | notify a person who submits an accessibility complaint to the |
|---|
| 37 | 37 | | department pursuant to the Americans with Disabilities Act of 1990 |
|---|
| 38 | 38 | | (42 U.S.C. Section 12101 et seq.) of the status of the complaint at |
|---|
| 39 | 39 | | least once every 15 days until final disposition. |
|---|
| 40 | 40 | | SECTION 4. This Act takes effect September 1, 2023. |
