55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the acceptance of identification for voters who
88 identify as transgender.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 32, Election Code, is
1111 amended by adding Section 32.116 to read as follows:
1212 Sec. 32.116. REQUIRED TRAINING RELATED TO ACCEPTING VOTERS
1313 WHO IDENTIFY AS TRANSGENDER. Each program, standard, or material
1414 for any training developed under this subchapter must include:
1515 (1) guidance for election workers to accept photo
1616 identification that may not align with a person's presenting gender
1717 expression or identity; and
1818 (2) information about voters who identify as
1919 transgender and their historical disenfranchisement.
2020 SECTION 2. Section 63.0101, Election Code, is amended by
2121 adding Subsection (e) to read as follows:
2222 (e) An indication of gender on a form of identification
2323 described by this section that does not align with the gender
2424 expression or identity of the person seeking to vote does not
2525 invalidate the form of identification for the purpose of accepting
2626 a voter for voting.
2727 SECTION 3. This Act takes effect September 1, 2023.
