55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to criminal history record information obtained by certain
88 facilities and private agencies on behalf of facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.1387(b-1), Government Code, is
1111 amended to read as follows:
1212 (b-1) A facility or a private agency on behalf of a
1313 facility:
1414 (1) shall [is entitled to] obtain from the department
1515 criminal history record information maintained by the department or
1616 an equivalent or enhanced background check that relates to a person
1717 who is[:
1818 [(1)] an applicant for employment with, an employee
1919 of, or a volunteer with the facility; and
2020 (2) is entitled to obtain from the department criminal
2121 history record information maintained by the department that
2222 relates to a person who is:
2323 (A) an applicant for employment with or an
2424 employee of a person or business that contracts with the facility;
2525 or
2626 (B) [(3)] a student enrolled in an educational
2727 program or course of study who is at the facility for educational
2828 purposes.
2929 SECTION 2. Section 250.002(a-1), Health and Safety Code, is
3030 amended to read as follows:
3131 (a-1) A facility or a private agency on behalf of a
3232 facility:
3333 (1) shall [is entitled to] obtain from the Department
3434 of Public Safety of the State of Texas criminal history record
3535 information maintained by the Department of Public Safety or an
3636 equivalent or enhanced background check that relates to a person
3737 who is[:
3838 [(1)] an applicant for employment with, an employee
3939 of, or a volunteer with the facility; and
4040 (2) is entitled to obtain from the Department of
4141 Public Safety criminal history record information maintained by the
4242 Department of Public Safety that relates to a person who is:
4343 (A) an applicant for employment with or an
4444 employee of a person or business that contracts with the facility;
4545 (B) [(3)] an applicant for employment by or an
4646 employee of an individual employer; or
4747 (C) [(4)] a student enrolled in an educational
4848 program or course of study who is at the facility for educational
4949 purposes.
5050 SECTION 3. Section 411.1387(b-1), Government Code, and
5151 Section 250.002(a-1), Health and Safety Code, as amended by this
5252 Act, apply only to criminal history record information obtained on
5353 or after the effective date of this Act. Criminal history record
5454 information obtained before the effective date of this Act is
5555 governed by the law in effect when the criminal history record
5656 information was obtained, and the former law is continued in effect
5757 for that purpose.
5858 SECTION 4. This Act takes effect September 1, 2023.
