66 relating to a prohibition on funding for gender reassignment.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subtitle F, Title 10, Government Code, is
99 amended by adding Chapter 2275 to read as follows:
1010 Chapter 2275. Prohibition on Use of Taxpayer Resources
1111 Sec. 2275.001. DEFINITIONS. In this chapter:
1212 (1) "Gender reassignment" means a medical
1313 intervention, including surgery performed for the purpose of
1414 altering a person's primary or secondary sex characteristics or
1515 drugs or biologicals prescribed for the purpose of altering or
1616 maintaining alteration of a person's primary or secondary sex
1717 characteristics.
1818 (2) "Intersex person" means an person who:
1919 (A) has inborn chromosomal, gonadal, genital, or
2020 endocrine characteristics, or a combination of those
2121 characteristics, that are not suited to the typical definition of
2222 male or female or are atypical for the determined sex of the person;
2323 or
2424 (B) is considered by a medical professional to
2525 have inborn chromosomal, gonadal, genital, or endocrine
2626 characteristics that are ambiguous or atypical for the determined
2727 sex of the person.
2828 Sec. 2275.002. PROHIBITION ON USE OF TAXPAYER RESOURCES FOR
2929 GENDER REASSIGNMENT. (a) No funds authorized or appropriated by
3030 State law shall be expended for any gender reassignment.
3131 (b) No funds authorized or appropriated by State law shall
3232 be expended for health benefits that covers gender reassignment.
3333 (c) The prohibition in subsection (a) and (b) does not apply
3434 to gender reassignment to be performed on an intersex person.
3535 SECTION 2. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2023.
