55 AN ACT
66 relating to prohibiting the use of political tests by governmental
77 entities and certain government contracts.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle A, Title 6, Government Code, is amended
1010 by adding Chapter 620 to read as follows:
1111 CHAPTER 620. PROHIBITION ON POLITICAL TESTS
1212 Sec. 620.001. DEFINITIONS. In this section, "governmental
1313 entity" means:
1414 (1) this state, a municipality, a county, or other
1515 political subdivision of this state; or
1616 (2) any agency of this state, of a county, of a
1717 municipality, or of any other political subdivision of this state,
1818 including a department, bureau, board, commission, office, agency,
1919 council, school district, open-enrollment charter school, and
2020 public institution of higher education.
2121 Sec. 620.002. POLITICAL TESTS PROHIBITED. (a) A
2222 governmental entity may not require any person to receive or
2323 participate in training, identify a commitment to, or make a
2424 statement of personal belief supporting any specific partisan,
2525 political, or ideological set of beliefs, including an ideology or
2626 movement that promotes the differential treatment of any individual
2727 or group based on race or ethnicity, such as:
2828 (1) an initiative or formulation of diversity, equity,
2929 and inclusion beyond what is necessary to uphold the equal
3030 protection of the laws under the Fourteenth Amendment to the United
3131 States Constitution; or
3232 (2) a theory or practice that asserts that systems or
3333 institutions upholding the equal protection of the laws under the
3434 Fourteenth Amendment to the United States Constitution are racist,
3535 oppressive, or otherwise unjust.
3636 SECTION 2. Subtitle F, Title 10, Government Code, is
3737 amended by adding Chapter 2275 to read as follows:
3838 CHAPTER 2275. PROHIBITION ON CONTRACTS REQUIRING POLITICAL TESTS
3939 Sec. 2275.001. DEFINITIONS. In this section, "governmental
4040 entity" means:
4141 (1) this state, a municipality, a county, or other
4242 political subdivision of this state; or
4343 (2) any agency of this state, of a county, of a
4444 municipality, or of any other political subdivision of this state,
4545 including a department, bureau, board, commission, office, agency,
4646 council, school district, open-enrollment charter school, and
4747 public institution of higher education.
4848 Sec. 2275.002. PROHIBITED CONTRACTS. (a) A governmental
4949 entity may not enter into a contract or other agreement with a
5050 company or organization that requires an employee or student of a
5151 governmental entity to receive or participate in training, identify
5252 a commitment to, or make a statement of personal belief supporting
5353 any specific partisan, political, or ideological set of beliefs,
5454 including an ideology or movement that promotes the differential
5555 treatment of any individual or group based on race or ethnicity,
5656 such as:
5757 (1) an initiative or formulation of diversity, equity,
5858 and inclusion beyond what is necessary to uphold the equal
5959 protection of the laws under the Fourteenth Amendment to the United
6060 States Constitution; or
6161 (2) a theory or practice that asserts that systems or
6262 institutions upholding the equal protection of the laws under the
6363 Fourteenth Amendment to the United States Constitution are racist,
6464 oppressive, or otherwise unjust.
6565 SECTION 3. Chapter 2275, Government Code, as added by this
6666 Act, applies to a contract or agreement entered into on or after the
6767 effective date of this Act.
6868 SECTION 4. This Act takes effect immediately if it receives
6969 a vote of two-thirds of all the members elected to each house, as
7070 provided by Section 39, Article III, Texas Constitution. If this
7171 Act does not receive the vote necessary for immediate effect, this
7272 Act takes effect September 1, 2023.
