| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 51.9715, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsections (c), (d), and (e) to read as follows: |
|---|
| 13 | 13 | | (c) A postsecondary educational institution may not refuse |
|---|
| 14 | 14 | | to issue a transcript to a current or former student based solely on |
|---|
| 15 | 15 | | the student's default on a student loan administered by the |
|---|
| 16 | 16 | | coordinating board. |
|---|
| 17 | 17 | | (d) If a postsecondary educational institution charges a |
|---|
| 18 | 18 | | fee in connection with the issuance of a transcript under this |
|---|
| 19 | 19 | | section, the amount of the fee must be the same for each student |
|---|
| 20 | 20 | | regardless of whether the student is in default on a student loan |
|---|
| 21 | 21 | | administered by the coordinating board. |
|---|
| 22 | 22 | | (e) In this section: |
|---|
| 23 | 23 | | (1) "Coordinating board" means the Texas Higher |
|---|
| 24 | 24 | | Education Coordinating Board. |
|---|
| 25 | 25 | | (2) "Postsecondary educational institution" includes |
|---|
| 26 | 26 | | an institution of higher education and a private or independent |
|---|
| 27 | 27 | | institution of higher education as those terms are defined by |
|---|
| 28 | 28 | | Section 61.003. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
