| 7 | 7 | | relating to a landlord's notice to residential tenants regarding |

| 8 | 8 | | rent increases. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 92, Property Code, is |
|---|
| 11 | 11 | | amended by adding Section 92.027 to read as follows: |
|---|
| 12 | 12 | | Sec. 92.027. NOTICE OF RENT INCREASES. (a) A landlord that |
|---|
| 13 | 13 | | proposes on renewal of a tenant's lease to increase the amount of |
|---|
| 14 | 14 | | rent the landlord charges the tenant shall provide written notice |
|---|
| 15 | 15 | | to the tenant in accordance with this section. |
|---|
| 16 | 16 | | (b) The notice required by Subsection (a) must state: |
|---|
| 17 | 17 | | (1) the amount of the tenant's rent after the increase; |
|---|
| 18 | 18 | | (2) the improvements to the tenant's rental unit or |
|---|
| 19 | 19 | | another part of the premises that have resulted in the rent |
|---|
| 20 | 20 | | increase, if any; and |
|---|
| 21 | 21 | | (3) the effective date of the rent increase. |
|---|
| 22 | 22 | | (c) The landlord shall provide the notice required by |
|---|
| 23 | 23 | | Subsection (a) not later than the seventh day before the date the |
|---|
| 24 | 24 | | tenant is required to provide notice to vacate at the end of the |
|---|
| 25 | 25 | | lease term. |
|---|
| 26 | 26 | | (d) If a landlord fails to provide notice as required by |
|---|
| 27 | 27 | | Subsection (c), the landlord may not: |
|---|
| 28 | 28 | | (1) before the seventh day after the date the landlord |
|---|
| 29 | 29 | | provides to the tenant a notice in compliance with Subsection (b), |
|---|
| 30 | 30 | | require the tenant to provide notice to vacate the premises; and |
|---|
| 31 | 31 | | (2) for a tenant who renews the lease, increase the |
|---|
| 32 | 32 | | rent before the seventh day after the effective date of the renewal |
|---|
| 33 | 33 | | lease term. |
|---|
| 34 | 34 | | (e) If a landlord fails to comply with this section, the |
|---|
| 35 | 35 | | tenant is entitled to recover from the landlord a penalty in the |
|---|
| 36 | 36 | | amount of $100. |
|---|
| 37 | 37 | | SECTION 2. Section 92.027, Property Code, as added by this |
|---|
| 38 | 38 | | Act, applies only to a lease agreement entered into or renewed on or |
|---|
| 39 | 39 | | after the effective date of this Act. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2023. |
|---|
