| 7 | 7 | | relating to the means by which schools are compared in the Public |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39.053, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (c-4) to read as follows: |
|---|
| 12 | 12 | | (c-4) For purposes of Subsection (c)(2)(B), the |
|---|
| 13 | 13 | | commissioner may not compare the relative performance of a campus |
|---|
| 14 | 14 | | in a district in which student enrollment is based only on a |
|---|
| 15 | 15 | | student's residence and the relative performance of a campus in a |
|---|
| 16 | 16 | | district in which a student's parent or person standing in parental |
|---|
| 17 | 17 | | relation to the student is allowed to enroll the student at a campus |
|---|
| 18 | 18 | | other than the campus the student would attend based on the |
|---|
| 19 | 19 | | student's residence. |

| 20 | 20 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 21 | 21 | | school year. |
|---|
| 22 | 22 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2023. |
