88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 411, Government Code, is amended by
1010 adding Subchapter H-1 to read as follows:
1111 SUBCHAPTER H-1. REQUIRED REPORTING FOR MULTIPLE RIFLE SALES
1212 Sec. 411.221. DEFINITION. In this subchapter:
1313 (a) "Licensed firearms dealer" means a person who is
1414 licensed as a firearms dealer under 18 U.S.C. Section 923.
1515 (b) "Rifle", as defined by 18 U.S.C. Section 921(9),
1616 includes a rifle with a caliber greater than .22, and a rifle with
1717 the ability to accept detachable magazines.
1818 (c) "Semiautomatic Rifle" has the meaning as defined by 18
1919 U.S.C. Section 921(29).
2020 Sec. 411.222. REQUIRED REPORTING BY A LICENSED FIREARMS
2121 DEALER. A licensed firearms dealer shall report the sale of more
2222 than one rifle or semiautomatic rifle to the same buyer, during a
2323 single transaction or multiple transactions in a five business day
2424 period, to the department and the police department of the
2525 municipality in which the licensed firearms dealer is located or,
2626 if the licensed firearms dealer is not located in a municipality,
2727 the sheriff of the county in which the licensed firearms dealer is
2828 located.
2929 Sec. 411.223. OFFENSE. A person who violates this
3030 subchapter commits an offense. An offense under this section is a
3131 Class A misdemeanor.
3232 SECTION 2. This Act takes effect September 1, 2023.
