55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to establishing the Texas State Seal of Bilingualism and
88 Biliteracy for public high school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 28, Education Code, is
1111 amended by adding Section 28.028 to read as follows:
1212 Sec. 28.028. TEXAS STATE SEAL OF BILINGUALISM AND
1313 BILITERACY. (a) In this section, "seal" means the Texas State Seal
1414 of Bilingualism and Biliteracy established under Subsection (b).
1515 (b) The agency shall establish a seal to recognize high
1616 school graduates who have attained a high level of proficiency in
1717 comprehending, speaking, reading, and writing in both English and a
1818 language other than English.
1919 (c) The agency, in consultation with appropriate
2020 stakeholders, shall:
2121 (1) determine minimum requirements for earning the
2222 seal, which:
2323 (A) must be sufficiently rigorous to indicate to
2424 an employer or postsecondary institution that a student who has
2525 earned the seal is biliterate;
2626 (B) may include completion of a project,
2727 activity, or portfolio; and
2828 (C) may not condition receipt of the seal on an
2929 examination created for that purpose; and
3030 (2) prepare and deliver to each school district an
3131 insignia that can be affixed or stamped on the diploma of and adopt
3232 a designation to be included on the transcript of a student who has
3333 satisfied requirements for earning the seal.
3434 (d) Each school district shall:
3535 (1) maintain appropriate records to identify students
3636 who have earned the seal; and
3737 (2) for each student who has satisfied requirements
3838 for earning the seal:
3939 (A) affix the seal's insignia to the student's
4040 diploma; and
4141 (B) include in the student's transcript that the
4242 student earned the seal.
4343 (e) The commissioner shall adopt rules as necessary to
4444 administer this section.
4545 SECTION 2. This Act applies beginning with the 2023-2024
4646 school year.
4747 SECTION 3. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2023.
