| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 418.173, Government Code, is repealed. |
|---|
| 11 | 11 | | SECTION 2. The change in law made by this Act applies to an |
|---|
| 12 | 12 | | offense committed on or after the effective date of this Act and to |
|---|
| 13 | 13 | | any criminal action pending on the effective date of this Act for an |
|---|
| 14 | 14 | | offense committed before that effective date. A final conviction |
|---|
| 15 | 15 | | for an offense under Section 418.173, Government Code, that exists |
|---|
| 16 | 16 | | on the effective date of this Act is unaffected by this Act. |
|---|
| 17 | 17 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 18 | 18 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 19 | 19 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 20 | 20 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 21 | 21 | | Act takes effect September 1, 2023. |
