66 AN ACT
77 relating to annually adjusting for inflation the maximum amount of
88 a motor vehicle excluded in determining eligibility for the
99 supplemental nutrition assistance program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1212 is amended by adding Section 33.0215 to read as follows:
1313 Sec. 33.0215. ANNUAL INFLATION ADJUSTMENT OF MOTOR VEHICLE
1414 VALUE EXCLUDED IN DETERMINING SNAP ELIGIBILITY. (a) The executive
1515 commissioner by rule shall adjust for inflation in the manner
1616 specified by Subsection (b) the maximum amount of the fair market
1717 value of a motor vehicle that may be excluded from the resources of
1818 an applicant's household for purposes of determining the
1919 applicant's eligibility for supplemental nutrition assistance
2020 program benefits, including eligibility determined in accordance
2121 with 7 C.F.R. Section 273.2(j).
2222 (b) Not later than October 1 of each year, the maximum
2323 amount of the fair market value of a motor vehicle described by
2424 Subsection (a) that may be excluded from an applicant's resources
2525 must be increased or decreased to reflect the percentage difference
2626 between:
2727 (1) the average index level set by the Bureau of Labor
2828 Statistics; and
2929 (2) the new vehicles index of the Consumer Price Index
3030 for All Urban Consumers published by the Bureau of Labor Statistics
3131 or its successor index during the most recent 12-month period
3232 ending in June.
3333 (c) In calculating the maximum amount of the fair market
3434 value of a motor vehicle described by Subsection (a) that may be
3535 excluded and notwithstanding Subsection (b), the commission shall
3636 ensure that the maximum excluded amounts of the first household
3737 vehicle and each additional household vehicle remain proportionate
3838 to each other in the same proportion as the excluded amounts for
3939 those vehicles in effect on August 31, 2021.
4040 SECTION 2. The change in law made by this Act applies to an
4141 initial determination or recertification of eligibility of a person
4242 for the supplemental nutrition assistance program under Chapter 33,
4343 Human Resources Code, that is made on or after the effective date of
4444 this Act.
4545 SECTION 3. If before implementing any provision of this Act
4646 a state agency determines that a waiver or authorization from a
4747 federal agency is necessary for implementation of that provision,
4848 the agency affected by the provision shall request the waiver or
4949 authorization and may delay implementing that provision until the
5050 waiver or authorization is granted.
5151 SECTION 4. This Act takes effect September 1, 2023.
