66 AN ACT
77 relating to the creation of certain criminal offenses concerning
88 firearm sales at gun shows.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.01, Penal Code, is amended by adding
1111 Subdivisions (21) and (22) to read as follows:
1212 (21) "Gun show" means a place other than a permanent
1313 retail store, including a driveway, sidewalk or walkway, parking
1414 lot, or other parking area, or an event at which:
1515 (A) three or more individuals assemble to display
1616 firearms or firearm components to the public; and
1717 (B) a fee is charged for the privilege of
1818 displaying the firearms or firearm components or a fee is charged
1919 for admission to the area where the firearms or components are
2020 displayed.
2121 (22) "Gun show promoter" means a person who organizes,
2222 plans, promotes, or operates a gun show.
2323 SECTION 2. Chapter 46, Penal Code, is amended by adding
2424 Sections 46.065 and 46.066 to read as follows:
2525 Sec. 46.065. CERTAIN REQUIREMENTS RELATING TO SALES AT GUN
2626 SHOWS. (a) A person commits an offense if the person knowingly
2727 sells a firearm to another person in exchange for money or other
2828 consideration at a gun show without complying with the National
2929 Instant Criminal Background Check System in the manner required by
3030 18 U.S.C. Section 922 before completing the sale. A person who
3131 conducts a criminal background check as required by this subsection
3232 may charge a fee in an amount equal to the cost incurred by the
3333 person to obtain the background check.
3434 (b) A person commits an offense if the person knowingly
3535 sells a firearm to another person in exchange for money or other
3636 consideration at a gun show and the person does not maintain a
3737 record of the sale.
3838 (c) It is an exception to the application of Subsection (a)
3939 that the person to whom the firearm is sold is:
4040 (1) a peace officer; or
4141 (2) a person who is licensed to carry a handgun under
4242 Subchapter H, Chapter 411, Government Code.
4343 (d) An offense under this section is a Class A misdemeanor.
4444 Sec. 46.066. CERTAIN REQUIREMENTS RELATING TO GUN SHOW
4545 PROMOTER. (a) A gun show promoter commits an offense if the
4646 promoter, with criminal negligence, permits the sale of a firearm
4747 to a person at a gun show organized, planned, promoted, or operated
4848 by the promoter without complying with the National Instant
4949 Criminal Background Check System in the manner required by 18
5050 U.S.C. Section 922 before completion of the sale.
5151 (b) It is an exception to the application of Subsection (a)
5252 that the person to whom the firearm is sold is:
5353 (1) a peace officer; or
5454 (2) a person who is licensed to carry a handgun under
5555 Subchapter H, Chapter 411, Government Code.
5656 (c) Not later than the 30th day before the date on which a
5757 gun show is held, the gun show promoter shall provide written notice
5858 of the date, time, and place of the gun show to the local law
5959 enforcement agency of the county or municipality in which the gun
6060 show will be held.
6161 (d) A gun show promoter shall conduct, or arrange for a
6262 person who is a licensed firearms dealer under 18 U.S.C. Section 923
6363 to conduct, an instant criminal background check in the manner
6464 required by 18 U.S.C. Section 922 on any person who purchases a
6565 firearm at a gun show organized, planned, promoted, or operated by
6666 the promoter from another person who is not a licensed firearms
6767 dealer under 18 U.S.C. Section 923. A person who conducts a
6868 criminal background check as required by this subsection may charge
6969 a fee in an amount equal to the cost incurred by the person to obtain
7070 the background check.
7171 (e) A gun show promoter shall prominently post a notice in a
7272 form prescribed by the Department of Public Safety stating the
7373 requirements under this section and Section 46.065 relating to an
7474 instant criminal background check.
7575 (f) A gun show promoter commits an offense if the promoter
7676 violates Subsection (c), (d), or (e).
7777 (g) An offense under this section is a Class A misdemeanor.
7878 (h) If conduct constituting an offense under this section
7979 also constitutes an offense under Section 46.065, the actor may be
8080 prosecuted under either section or under both sections.
8181 SECTION 3. The change in law made by Section 46.066(c),
8282 Penal Code, as added by this Act, applies only to a gun show held on
8383 or after October 1, 2023.
8484 SECTION 4. This Act takes effect September 1, 2023.
