1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to preventative health care and public health, including
1414 prohibited immunization and face-covering requirements, private
1515 business or school closures, and the ordering and administration of
1616 immunizations by a pharmacist.
1717 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1818 SECTION 1. Section 38.001, Education Code, is amended by
1919 amending Subsections (a) and (b-1) and adding Subsection (b-2) to
2020 read as follows:
2121 (a) Except as provided by Subsection (c), each [Each]
2222 student shall be fully immunized against the diseases listed in
2323 Section 161.004, Health and Safety Code [diphtheria, rubeola,
2424 rubella, mumps, tetanus, and poliomyelitis, except as provided by
2525 Subsection (c)].
2626 (b-1) Each year, the Department of State Health Services
2727 shall prepare a list of the immunizations required [under this
2828 section] for admission to public schools [and of any additional
2929 immunizations the department recommends for school-age children].
3030 The department shall prepare the list in English and Spanish and
3131 make the list available in a manner that permits a school district
3232 to easily post the list on the district's Internet website as
3333 required by Section 38.019.
3434 (b-2) An elementary or secondary school may not require a
3535 student, as a condition of the student's admission to or continued
3636 enrollment in the school, to be vaccinated against the 2019 novel
3737 coronavirus disease (COVID-19).
3838 SECTION 2. Section 38.019(a), Education Code, is amended to
3939 read as follows:
4040 (a) A school district that maintains an Internet website
4141 shall post prominently on the website:
4242 (1) a list, in English and Spanish, of:
4343 (A) the immunizations required for admission to
4444 public school in accordance with [by rules of the Department of
4545 State Health Services adopted under] Section 38.001; and
4646 (B) [any immunizations or vaccines recommended
4747 for public school students by the Department of State Health
4848 Services; and
4949 [(C)] health clinics in the district that offer
5050 the influenza vaccine, to the extent those clinics are known to the
5151 district; and
5252 (2) a link to the page on the Department of State
5353 Health Services Internet website that provides [where a person may
5454 obtain] information relating to the procedures for claiming an
5555 exemption from the immunization requirements of Section 38.001.
5656 SECTION 3. Subchapter Z, Chapter 51, Education Code, is
5757 amended by adding Section 51.91921 to read as follows:
5858 Sec. 51.91921. PROHIBITION ON PRIVATE OR INDEPENDENT
5959 INSTITUTIONS OF HIGHER EDUCATION MANDATING COVID-19 VACCINATION
6060 FOR STUDENTS. (a) In this section:
6161 (1) "COVID-19" means the 2019 novel coronavirus
6262 disease, including any variant.
6363 (2) "Private or independent institution of higher
6464 education" has the meaning assigned by Section 61.003.
6565 (b) A private or independent institution of higher
6666 education may not require a student, as a condition of the student's
6767 admission to or continued enrollment in the institution, to be
6868 vaccinated against COVID-19.
6969 SECTION 4. Section 51.933, Education Code, is amended by
7070 amending Subsections (b) and (b-1) and adding Subsection (b-2) to
7171 read as follows:
7272 (b) The executive commissioner of the Health and Human
7373 Services Commission may require a student at an institution of
7474 higher education who is pursuing a course of study in a human or
7575 animal health profession to be immunized [immunizations] against
7676 the diseases listed in Subsection (a) and against hepatitis B,
7777 measles, rabies, and varicella, as applicable. The [additional
7878 diseases for students at any institution of higher education who
7979 are pursuing a course of study in a human or animal health
8080 profession, and the] executive commissioner may require those
8181 immunizations for any students in times of an emergency or epidemic
8282 in a county where the commissioner of state health services has
8383 declared such an emergency or epidemic.
8484 (b-1) A requirement [rule adopted] under Subsection (b) for
8585 [that requires] a student to be immunized against hepatitis B
8686 [vaccination for students] may apply only to students enrolled in a
8787 course of study that involves potential exposure to human or animal
8888 blood or bodily fluids.
8989 (b-2) An institution of higher education may not require a
9090 student, as a condition of the student's admission to or continued
9191 enrollment in the institution, to be vaccinated against COVID-19 as
9292 defined by Section 51.91921.
9393 SECTION 5. Sections 81.023(a) and (c), Health and Safety
9494 Code, are amended to read as follows:
9595 (a) The executive commissioner may recommend to the
9696 legislature immunizations to include on the list of immunizations
9797 required [department shall develop immunization requirements] for
9898 children under Section 161.004.
9999 (c) The department shall cooperate with the State Board of
100100 Education in [formulating and] implementing immunization
101101 requirements for students admitted to public or private primary or
102102 secondary schools.
103103 SECTION 6. Subtitle D, Title 2, Health and Safety Code, is
104104 amended by adding Chapter 81B to read as follows:
105105 CHAPTER 81B. PROHIBITED CORONAVIRUS PREVENTATIVE MEASURES
106106 Sec. 81B.001. DEFINITIONS. In this chapter:
107107 (1) "COVID-19" means the 2019 novel coronavirus
108108 disease and any variants of the disease.
109109 (2) "Governmental entity" means this state, a local
110110 government entity as defined by Section 418.004, Government Code,
111111 or an agency of this state or a local government entity.
112112 Sec. 81B.002. PROHIBITED FACE-COVERING MANDATE.
113113 Notwithstanding any other law, including Chapter 81 of this code
114114 and Chapter 418, Government Code, a governmental entity may not
115115 implement, order, or otherwise impose a mandate requiring a person
116116 to wear a face mask or other face covering to prevent the spread of
117117 COVID-19.
118118 Sec. 81B.003. PROHIBITED VACCINE MANDATE. Notwithstanding
119119 any other law, including Chapter 81 of this code and Chapter 418,
120120 Government Code, a governmental entity may not implement, order, or
121121 otherwise impose a mandate requiring a person to be vaccinated
122122 against COVID-19.
123123 Sec. 81B.004. PROHIBITED CLOSURE MANDATE FOR PRIVATE
124124 BUSINESSES AND SCHOOLS. Notwithstanding any other law, including
125125 Chapter 81 of this code and Chapter 418, Government Code, a
126126 governmental entity may not implement, order, or otherwise impose a
127127 mandate requiring the closure of a private business, public school,
128128 open-enrollment charter school, or private school to prevent the
129129 spread of COVID-19.
130130 SECTION 7. Section 161.004(a), Health and Safety Code, is
131131 amended to read as follows:
132132 (a) Every child in the state shall be immunized against
133133 diphtheria, hepatitis A, hepatitis B, measles, meningococcal
134134 disease, mumps, pertussis, polio, rubella, tetanus, and varicella
135135 [vaccine preventable diseases caused by infectious agents] in
136136 accordance with the [immunization] schedule prescribed [adopted]
137137 in department rules. The executive commissioner may not require
138138 immunizations against any additional diseases for students
139139 admitted to a public or private primary or secondary school.
140140 SECTION 8. Subtitle H, Title 2, Health and Safety Code, is
141141 amended by adding Chapter 174 to read as follows:
142142 CHAPTER 174. PATIENT RIGHTS
143143 Sec. 174.001. DEFINITIONS. In this chapter:
144144 (1) "COVID-19" has the meaning assigned by Section
145145 81B.001.
146146 (2) "Health care facility" means a hospital,
147147 freestanding emergency medical care facility, urgent care or retail
148148 clinic, outpatient clinic, birthing center, ambulatory surgical
149149 center, or other facility that is licensed to provide health care
150150 services in this state.
151151 Sec. 174.002. PROHIBITED DISCRIMINATION BASED ON COVID-19
152152 VACCINATION STATUS. (a) Except as provided by Subsection (b), a
153153 health care facility may not refuse to provide health care services
154154 to an individual based on the individual's vaccination status or
155155 post-transmission recovery of COVID-19.
156156 (b) The prohibition under Subsection (a) does not apply to a
157157 hospital that requires a COVID-19 vaccination in relation to
158158 oncology or transplant care.
159159 Sec. 174.003. MEDICAID REIMBURSEMENT PROHIBITED. (a) The
160160 commission:
161161 (1) may not provide Medicaid reimbursement to a health
162162 care facility that violates this chapter; and
163163 (2) shall disenroll the facility from participation as
164164 a Medicaid provider.
165165 (b) The executive commissioner may adopt rules as necessary
166166 to implement this section.
167167 SECTION 9. Chapter 21, Labor Code, is amended by adding
168168 Subchapter H-1 to read as follows:
169169 SUBCHAPTER H-1. DISCRIMINATION BASED ON COVID-19 VACCINATION
170170 STATUS
171171 Sec. 21.421. DEFINITION. In this subchapter, "COVID-19"
172172 has the meaning assigned by Section 81B.001, Health and Safety
173173 Code.
174174 Sec. 21.422. PROHIBITED DISCRIMINATION BASED ON COVID-19
175175 VACCINATION STATUS. (a) Except as provided by Subsection (d), an
176176 employer commits an unlawful employment practice if the employer
177177 fails or refuses to hire, discharges, or otherwise discriminates
178178 against an individual with respect to the compensation or the
179179 terms, conditions, or privileges of employment because the
180180 individual has not been vaccinated against COVID-19.
181181 (b) A labor organization commits an unlawful employment
182182 practice if the labor organization excludes or expels from
183183 membership or otherwise discriminates against an individual
184184 because the individual has not been vaccinated against COVID-19.
185185 (c) An employment agency commits an unlawful employment
186186 practice if the employment agency classifies or refers for
187187 employment, fails or refuses to refer for employment, or otherwise
188188 discriminates against an individual because the individual has not
189189 been vaccinated against COVID-19.
190190 (d) This section does not apply to:
191191 (1) a health care facility, as defined by Section
192192 224.001, Health and Safety Code, that:
193193 (A) implements a policy or procedure to exempt
194194 from a required vaccination an individual described by this section
195195 who has a medical condition identified as a contraindication or
196196 precaution to the vaccination by the Centers for Disease Control
197197 and Prevention;
198198 (B) establishes procedures that an exempt
199199 individual is required to follow to protect facility patients from
200200 exposure to disease, including the use of gloves, face masks, or
201201 other protective medical equipment, based on the level of risk the
202202 individual presents to patients by the individual's routine and
203203 direct exposure to patients; and
204204 (C) prohibits discrimination or retaliatory
205205 action against an exempt individual, except that the required use
206206 of protective medical equipment under Paragraph (B) is not
207207 considered a retaliatory action for purposes of this paragraph; or
208208 (2) a private employer that:
209209 (A) implements a policy or procedure to exempt
210210 from a required vaccination an individual described by this section
211211 based on reasons of conscience or because the individual has a
212212 medical condition identified as a contraindication or precaution to
213213 the vaccination by the Centers for Disease Control and Prevention;
214214 (B) establishes procedures that an exempt
215215 individual is required to follow to protect employees and other
216216 individuals from exposure to disease, including the use of gloves,
217217 face masks, or other protective medical equipment, based on the
218218 level of risk the individual presents to employees and other
219219 individuals by the individual's routine and direct exposure to
220220 employees and other individuals; and
221221 (C) prohibits discrimination or retaliatory
222222 action against an exempt individual, except that the required use
223223 of protective medical equipment under Paragraph (B) is not
224224 considered a retaliatory action for purposes of this paragraph.
225225 SECTION 10. Section 551.003(33), Occupations Code, is
226226 amended to read as follows:
227227 (33) "Practice of pharmacy" means:
228228 (A) providing an act or service necessary to
229229 provide pharmaceutical care;
230230 (B) interpreting or evaluating a prescription
231231 drug order or medication order;
232232 (C) participating in drug or device selection as
233233 authorized by law, and participating in drug administration, drug
234234 regimen review, or drug or drug-related research;
235235 (D) providing patient counseling;
236236 (E) being responsible for:
237237 (i) dispensing a prescription drug order or
238238 distributing a medication order;
239239 (ii) compounding or labeling a drug or
240240 device, other than labeling by a manufacturer, repackager, or
241241 distributor of a nonprescription drug or commercially packaged
242242 prescription drug or device;
243243 (iii) properly and safely storing a drug or
244244 device; or
245245 (iv) maintaining proper records for a drug
246246 or device;
247247 (F) performing for a patient a specific act of
248248 drug therapy management delegated to a pharmacist by a written
249249 protocol from a physician licensed in this state in compliance with
250250 Subtitle B; [or]
251251 (G) subject to Section 554.052(c-1), ordering or
252252 administering an immunization or vaccination to a patient who is at
253253 least three years of age; or
254254 (H) if the patient is younger than three years of
255255 age and is referred to a pharmacist by a physician, administering an
256256 immunization or vaccination to a patient under a physician's
257257 written protocol.
258258 SECTION 11. The heading to Section 554.004, Occupations
259259 Code, is amended to read as follows:
260260 Sec. 554.004. ADMINISTRATION OF MEDICATION; ORDERING AND
261261 ADMINISTRATION OF IMMUNIZATION OR VACCINATION.
262262 SECTION 12. Section 554.004(a), Occupations Code, is
263263 amended to read as follows:
264264 (a) The board shall specify conditions under which a
265265 pharmacist may administer medication and order or administer [,
266266 including] an immunization or [and] vaccination. The conditions
267267 for ordering or administering an immunization or vaccination must
268268 ensure that:
269269 (1) [a licensed health care provider authorized to
270270 administer the medication is not reasonably available to administer
271271 the medication;
272272 [(2) failure to administer the medication, other than
273273 an immunization or vaccination, might result in a significant delay
274274 or interruption of a critical phase of drug therapy;
275275 [(3)] the pharmacist possesses the necessary skill,
276276 education, and certification as specified by the board to order or
277277 administer the immunization or vaccination [medication];
278278 (2) [(4)] within a reasonable time after
279279 administering an immunization or vaccination that is prescribed by
280280 a licensed health care provider [medication], the pharmacist
281281 notifies the licensed health care provider responsible for the
282282 patient's care that the immunization or vaccination [medication]
283283 was administered;
284284 [(5) the pharmacist may not administer medication to a
285285 patient at the patient's residence, except at a licensed nursing
286286 home or hospital;
287287 [(6) the pharmacist administers an immunization or
288288 vaccination under a physician's written protocol and meets the
289289 standards established by the board;] and
290290 (3) [(7)] the authority of a pharmacist to administer
291291 an immunization or vaccination [medication] may [not] be delegated
292292 to a certified pharmacy technician.
293293 SECTION 13. Sections 554.052(a), (b), (c), and (c-1),
294294 Occupations Code, are amended to read as follows:
295295 (a) The board by rule shall require a pharmacist to notify a
296296 physician who prescribes an immunization or vaccination not later
297297 than the 14th day [within 24 hours] after the date the pharmacist
298298 administers the immunization or vaccination.
299299 (b) The board shall establish minimum education and
300300 continuing education standards for a pharmacist who orders or
301301 administers an immunization or vaccination. The standards must
302302 include federal Centers for Disease Control and Prevention
303303 training, basic life support training, and hands-on training in
304304 techniques for administering immunizations and vaccinations.
305305 (c) Supervision by a physician is adequate if the delegating
306306 physician:
307307 (1) is responsible for formulating or approving an
308308 order or protocol, including the physician's order, standing
309309 medical order, or standing delegation order, and periodically
310310 reviews the order or protocol and the services provided to a patient
311311 under the order or protocol;
312312 (2) [except as provided by Subsection (c-1),] has
313313 established a physician-patient relationship with each patient who
314314 is younger than three [under 14] years of age and referred the
315315 patient to the pharmacist;
316316 (3) is geographically located to be easily accessible
317317 to the pharmacy where an immunization or vaccination is
318318 administered;
319319 (4) receives, as appropriate, a periodic status report
320320 on the patient, including any problem or complication encountered;
321321 and
322322 (5) is available through direct telecommunication for
323323 consultation, assistance, and direction.
324324 (c-1) A pharmacist may order or administer an immunization
325325 or [influenza] vaccination to a patient who is at least three [over
326326 seven] years of age without an established physician-patient
327327 relationship if the immunization or vaccination is:
328328 (1) authorized or approved by the United States Food
329329 and Drug Administration or listed in the routine immunization
330330 schedule recommended by the federal Advisory Committee on
331331 Immunization Practices published by the federal Centers for Disease
332332 Control and Prevention; and
333333 (2) ordered or administered in accordance with the
334334 federal Advisory Committee on Immunization Practices
335335 vaccine-specific recommendations.
336336 SECTION 14. Section 38.001(b), Education Code, as amended
337337 by Chapters 43 (H.B. 1098) and 94 (H.B. 1059), Acts of the 80th
338338 Legislature, Regular Session, 2007, is repealed.
339339 SECTION 15. (a) The changes in law made by this Act to
340340 Title 2, Education Code, apply beginning with the 2023-2024 school
341341 year.
342342 (b) The changes in law made by this Act to Title 3, Education
343343 Code, apply beginning with the 2023-2024 academic year.
344344 SECTION 16. Subchapter H-1, Chapter 21, Labor Code, as
345345 added by this Act, applies only to an unlawful employment practice
346346 that occurs on or after the effective date of this Act.
347347 SECTION 17. If before implementing any provision of this
348348 Act a state agency determines that a waiver or authorization from a
349349 federal agency is necessary for implementation of that provision,
350350 the agency affected by the provision shall request the waiver or
351351 authorization and may delay implementing that provision until the
352352 waiver or authorization is granted.
353353 SECTION 18. This Act takes effect immediately if it
354354 receives a vote of two-thirds of all the members elected to each
355355 house, as provided by Section 39, Article III, Texas Constitution.
356356 If this Act does not receive the vote necessary for immediate
357357 effect, this Act takes effect September 1, 2023.
