55 relating to the training of and the provision of acupuncture
66 services by an acudetox specialist.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 205.303, Occupations Code, is amended to
99 read as follows:
1010 Sec. 205.303. ACUDETOX SPECIALIST. (a) The medical board
1111 may certify a person as an acudetox specialist under this section if
1212 the person:
1313 (1) provides to the medical board documentation that
1414 the person:
1515 (A) is a licensed social worker, licensed
1616 professional counselor, including a person licensed under Section
1717 503.308, licensed psychologist, licensed chemical dependency
1818 counselor, licensed marriage and family therapist, licensed
1919 marriage and family therapist associate, licensed vocational
2020 nurse, [or] licensed registered nurse, licensed physician
2121 assistant, or other licensed or certified professional approved by
2222 the medical board; and
2323 (B) has successfully completed a training
2424 program in auricular acudetox [acupuncture detoxification] that
2525 meets or exceeds the training [guidelines] approved by the medical
2626 board; and
2727 (2) pays a certification fee in an amount set by the
2828 medical board.
2929 (b) An acudetox specialist may practice five-point
3030 auricular acupuncture only[:
3131 [(1)] to the extent allowed by rules adopted by the
3232 medical board for the treatment of addiction, trauma, or physical,
3333 emotional, or psychological stress [alcoholism, substance abuse,
3434 or chemical dependency; and
3535 [(2) under the supervision of a licensed acupuncturist
3636 or physician].
3737 (c) An [A program that includes the services of an] acudetox
3838 specialist shall:
3939 (1) obtain informed consent from each client and
4040 notify each client [participant in the program] of the
4141 qualifications of the acudetox specialist and of the procedure for
4242 registering a complaint regarding the acudetox specialist with the
4343 medical board; and
4444 (2) keep a record of each client's name and[,] the date
4545 the client received the acudetox specialist's services,
4646 accompanied by the signature and printed name [and the name,
4747 signature, and certification number] of the acudetox specialist.
4848 (d) The [medical board may annually renew the]
4949 certification of an acudetox specialist expires on the third
5050 anniversary of the date of issuance and may be renewed before the
5151 expiration of the certification [under this section] if the person:
5252 (1) provides to the medical board documentation that:
5353 (A) the certification or license required under
5454 Subsection (a)(1)(A) is in effect; and
5555 (B) the person has successfully met continuing
5656 education requirements established by the medical board under
5757 Subsection (e); and
5858 (2) pays a certification renewal fee in an amount set
5959 by the medical board.
6060 (e) The medical board by rule shall establish continuing
6161 education requirements for an acudetox specialist [that, at a
6262 minimum, include six hours of education in the practice of
6363 acupuncture and a course in either clean needle technique or
6464 universal infection control precaution procedures]. The board
6565 shall require in rules adopted under this subsection that the
6666 certification of an acudetox specialist may not be renewed unless
6767 the person completes at least three hours of continuing education
6868 in the licensing period before applying for the renewal.
6969 SECTION 2. Section 205.303(a), Occupations Code, as amended
7070 by this Act, applies only to an application for certification or
7171 renewal of certification as an acudetox specialist submitted on or
7272 after the effective date of this Act. An application submitted
7373 before the effective date of this Act is governed by the law in
7474 effect on the date the application was submitted, and the former law
7575 is continued in effect for that purpose.
7676 SECTION 3. This Act takes effect September 1, 2023.
