5	5	relating to the training of and the provision of acupuncture
6	6	services by an acudetox specialist.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 205.303, Occupations Code, is amended to
9	9	read as follows:
10	10	Sec. 205.303. ACUDETOX SPECIALIST. (a) The medical board
11	11	may certify a person as an acudetox specialist under this section if
12	12	the person:
13	13	(1) provides to the medical board documentation that
14	14	the person:
15	15	(A) is a licensed social worker, licensed
16	16	professional counselor, including a person licensed under Section
17	17	503.308, licensed psychologist, licensed chemical dependency
18	18	counselor, licensed marriage and family therapist, licensed
19	19	marriage and family therapist associate, licensed vocational
20	20	nurse, [or] licensed registered nurse, licensed physician
21	21	assistant, or other licensed or certified professional approved by
22	22	the medical board; and
23	23	(B) has successfully completed a training
24	24	program in auricular acudetox [acupuncture detoxification] that
25	25	meets or exceeds the training [guidelines] approved by the medical
26	26	board; and
27	27	(2) pays a certification fee in an amount set by the
28	28	medical board.
29	29	(b) An acudetox specialist may practice five-point
30	30	auricular acupuncture only[:
31	31	[(1)] to the extent allowed by rules adopted by the
32	32	medical board for the treatment of addiction, trauma, or physical,
33	33	emotional, or psychological stress [alcoholism, substance abuse,
34	34	or chemical dependency; and
35	35	[(2) under the supervision of a licensed acupuncturist
36	36	or physician].
37	37	(c) An [A program that includes the services of an] acudetox
38	38	specialist shall:
39	39	(1) obtain informed consent from each client and
40	40	notify each client [participant in the program] of the
41	41	qualifications of the acudetox specialist and of the procedure for
42	42	registering a complaint regarding the acudetox specialist with the
43	43	medical board; and
44	44	(2) keep a record of each client's name and[,] the date
45	45	the client received the acudetox specialist's services,
46	46	accompanied by the signature and printed name [and the name,
47	47	signature, and certification number] of the acudetox specialist.
48	48	(d) The [medical board may annually renew the]
49	49	certification of an acudetox specialist expires on the third
50	50	anniversary of the date of issuance and may be renewed before the
51	51	expiration of the certification [under this section] if the person:
52	52	(1) provides to the medical board documentation that:
53	53	(A) the certification or license required under
54	54	Subsection (a)(1)(A) is in effect; and
55	55	(B) the person has successfully met continuing
56	56	education requirements established by the medical board under
57	57	Subsection (e); and
58	58	(2) pays a certification renewal fee in an amount set
59	59	by the medical board.
60	60	(e) The medical board by rule shall establish continuing
61	61	education requirements for an acudetox specialist [that, at a
62	62	minimum, include six hours of education in the practice of
63	63	acupuncture and a course in either clean needle technique or
64	64	universal infection control precaution procedures]. The board
65	65	shall require in rules adopted under this subsection that the
66	66	certification of an acudetox specialist may not be renewed unless
67	67	the person completes at least three hours of continuing education
68	68	in the licensing period before applying for the renewal.
69	69	SECTION 2. Section 205.303(a), Occupations Code, as amended
70	70	by this Act, applies only to an application for certification or
71	71	renewal of certification as an acudetox specialist submitted on or
72	72	after the effective date of this Act. An application submitted
73	73	before the effective date of this Act is governed by the law in
74	74	effect on the date the application was submitted, and the former law
75	75	is continued in effect for that purpose.
76	76	SECTION 3. This Act takes effect September 1, 2023.
