55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on the provision of applied behavior analysis
88 services to children with autism under Medicaid and other public
99 benefits programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. DEFINITIONS. In this Act:
1212 (1) "Applied behavior analysis" means the practice
1313 described by Section 506.003, Occupations Code.
1414 (2) "Child health plan program" means the child health
1515 plan program established under Chapters 62 and 63, Health and
1616 Safety Code.
1717 (3) "Commission" means the Health and Human Services
1818 Commission.
1919 (4) "Medicaid" means the medical assistance program
2020 established under Chapter 32, Human Resources Code.
2121 SECTION 2. STUDY: COST-BENEFIT ANALYSIS ON PROVISION OF
2222 APPLIED BEHAVIOR ANALYSIS SERVICES UNDER MEDICAID AND OTHER
2323 PROGRAMS. (a) The commission shall conduct a cost-benefit analysis
2424 comparing the cost to this state of providing applied behavior
2525 analysis services to children with autism compared with the
2626 effectiveness of the services in treating children with autism. The
2727 study must:
2828 (1) determine the cost of applied behavior analysis
2929 services across all public benefits programs, including Medicaid,
3030 the child health plan program, and other health and human services
3131 programs; and
3232 (2) determine the efficacy of applied behavior
3333 analysis services provided to children with autism.
3434 (b) In conducting the study required by this section, the
3535 commission shall consult with all relevant state agencies that
3636 administer or operate a public benefits program to obtain all
3737 information necessary to conduct the study.
3838 SECTION 3. REPORT. Not later than September 1, 2024, the
3939 commission shall prepare and submit a report on the findings of the
4040 study conducted under Section 2 of this Act to the governor, the
4141 lieutenant governor, the speaker of the house of representatives,
4242 and the standing committees of the senate and house of
4343 representatives having jurisdiction over health and human
4444 services.
4545 SECTION 4. EXPIRATION. This Act expires September 1, 2025.
4646 SECTION 5. EFFECTIVE DATE. This Act takes effect September
4747 1, 2023.
