8 | 8 | | services to children with autism under Medicaid and other public |
---|
9 | 9 | | benefits programs. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. DEFINITIONS. In this Act: |
---|
12 | 12 | | (1) "Applied behavior analysis" means the practice |
---|
13 | 13 | | described by Section 506.003, Occupations Code. |
---|
14 | 14 | | (2) "Child health plan program" means the child health |
---|
15 | 15 | | plan program established under Chapters 62 and 63, Health and |
---|
16 | 16 | | Safety Code. |
---|
17 | 17 | | (3) "Commission" means the Health and Human Services |
---|
18 | 18 | | Commission. |
---|
19 | 19 | | (4) "Medicaid" means the medical assistance program |
---|
20 | 20 | | established under Chapter 32, Human Resources Code. |
---|
21 | 21 | | SECTION 2. STUDY: COST-BENEFIT ANALYSIS ON PROVISION OF |
---|
22 | 22 | | APPLIED BEHAVIOR ANALYSIS SERVICES UNDER MEDICAID AND OTHER |
---|
23 | 23 | | PROGRAMS. (a) The commission shall conduct a cost-benefit analysis |
---|
24 | 24 | | comparing the cost to this state of providing applied behavior |
---|
25 | 25 | | analysis services to children with autism compared with the |
---|
26 | 26 | | effectiveness of the services in treating children with autism. The |
---|
27 | 27 | | study must: |
---|
28 | 28 | | (1) determine the cost of applied behavior analysis |
---|
29 | 29 | | services across all public benefits programs, including Medicaid, |
---|
30 | 30 | | the child health plan program, and other health and human services |
---|
31 | 31 | | programs; and |
---|
32 | 32 | | (2) determine the efficacy of applied behavior |
---|
33 | 33 | | analysis services provided to children with autism. |
---|
34 | 34 | | (b) In conducting the study required by this section, the |
---|
35 | 35 | | commission shall consult with all relevant state agencies that |
---|
36 | 36 | | administer or operate a public benefits program to obtain all |
---|
37 | 37 | | information necessary to conduct the study. |
---|
38 | 38 | | SECTION 3. REPORT. Not later than September 1, 2024, the |
---|
39 | 39 | | commission shall prepare and submit a report on the findings of the |
---|
40 | 40 | | study conducted under Section 2 of this Act to the governor, the |
---|
41 | 41 | | lieutenant governor, the speaker of the house of representatives, |
---|
42 | 42 | | and the standing committees of the senate and house of |
---|
43 | 43 | | representatives having jurisdiction over health and human |
---|
44 | 44 | | services. |
---|
45 | 45 | | SECTION 4. EXPIRATION. This Act expires September 1, 2025. |
---|
46 | 46 | | SECTION 5. EFFECTIVE DATE. This Act takes effect September |
---|
47 | 47 | | 1, 2023. |
