55 AN ACT
66 relating to the determination of resident status of students by
77 public institutions of higher education.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 54.052, Education Code, is amended to
1010 read as follows:
1111 Sec. 54.052. DETERMINATION OF RESIDENT STATUS. (a)
1212 Subject to the other applicable provisions of this subchapter
1313 governing the determination of resident status, the following
1414 persons are considered residents of this state for purposes of this
1515 title:
1616 (1) a person who:
1717 (A) established a domicile in this state not
1818 later than one year before the census date of the academic term in
1919 which the person is enrolled in an institution of higher education;
2020 and
2121 (B) maintained that domicile continuously for
2222 the year preceding that census date; and
2323 (2) a dependent whose parent:
2424 (A) established a domicile in this state not
2525 later than one year before the census date of the academic term in
2626 which the dependent is enrolled in an institution of higher
2727 education; and
2828 (B) maintained that domicile continuously for
2929 the year preceding that census date[; and
3030 [(3) a person who:
3131 [(A) graduated from a public or private high
3232 school in this state or received the equivalent of a high school
3333 diploma in this state; and
3434 [(B) maintained a residence continuously in this
3535 state for:
3636 [(i) the three years preceding the date of
3737 graduation or receipt of the diploma equivalent, as applicable; and
3838 [(ii) the year preceding the census date of
3939 the academic term in which the person is enrolled in an institution
4040 of higher education].
4141 (b) For purposes of this section, the domicile of a
4242 dependent's parent is presumed to be the domicile of the dependent
4343 [unless the person establishes eligibility for resident status
4444 under Subsection (a)(3)].
4545 (c) A person who is not authorized under federal statute to
4646 be present in the United States may not be considered a resident of
4747 this state for purposes of this title.
4848 SECTION 2. Section 54.053, Education Code, is amended to
4949 read as follows:
5050 Sec. 54.053. INFORMATION REQUIRED TO ESTABLISH RESIDENT
5151 STATUS. A person shall submit the following information to an
5252 institution of higher education to establish resident status under
5353 this subchapter:
5454 (1) if the person applies for resident status under
5555 Section 54.052(a)(1):
5656 (A) a statement of the dates and length of time
5757 the person has resided in this state, as relevant to establish
5858 resident status under this subchapter; and
5959 (B) a statement by the person that the person's
6060 presence in this state for that period was for a purpose of
6161 establishing and maintaining a domicile; or
6262 (2) if the person applies for resident status under
6363 Section 54.052(a)(2):
6464 (A) a statement of the dates and length of time
6565 any parent of the person has resided in this state, as relevant to
6666 establish resident status under this subchapter; and
6767 (B) a statement by the parent or, if the parent is
6868 unable or unwilling to provide the statement, a statement by the
6969 person that the parent's presence in this state for that period was
7070 for a purpose of establishing and maintaining a domicile[; or
7171 [(3) if the person applies for resident status under
7272 Section 54.052(a)(3):
7373 [(A) a statement of the dates and length of time
7474 the person has resided in this state, as relevant to establish
7575 resident status under this subchapter; and
7676 [(B) if the person is not a citizen or permanent
7777 resident of the United States, an affidavit stating that the person
7878 will apply to become a permanent resident of the United States as
7979 soon as the person becomes eligible to apply].
8080 SECTION 3. Notwithstanding Subchapter B, Chapter 54,
8181 Education Code, a public institution of higher education in this
8282 state may, for any semester or academic term, before the beginning
8383 of that semester or academic term, reclassify as a nonresident a
8484 student previously classified as a resident of this state by the
8585 institution or another public institution of higher education in
8686 this state:
8787 (1) under Section 54.052(a)(3), Education Code, as
8888 that section existed before amendment by this Act, if the student is
8989 not otherwise eligible to be classified as a resident of this state
9090 under Subchapter B, Chapter 54, Education Code; or
9191 (2) before the enactment of Section 54.052(c),
9292 Education Code, as added by this Act, if the student is not
9393 authorized under federal statute to be present in the United
9494 States.
9595 SECTION 4. This Act takes effect September 1, 2023.
