88 relating to workplace violence prevention in certain health
99 facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Title 4, Health and Safety Code, is amended by
1212 adding Subtitle H to read as follows:
1313 SUBTITLE H. HEALTH FACILITY EMPLOYEES
1414 CHAPTER 331. WORKPLACE VIOLENCE PREVENTION
1515 Sec. 331.001. DEFINITIONS. In this chapter:
1616 (1) "Commission" means the Health and Human Services
1717 Commission.
1818 (2) "Committee" means the workplace violence
1919 prevention committee or other committee responsible for developing
2020 a facility's workplace violence prevention plan under Section
2121 331.002.
2222 (3) "Facility" means:
2323 (A) a home and community support services agency
2424 licensed or licensed and certified under Chapter 142 to provide
2525 home health services as defined by Section 142.001 that employs at
2626 least two registered nurses;
2727 (B) a hospital licensed under Chapter 241 and a
2828 hospital maintained or operated by an agency of this state that is
2929 exempt from licensing under that chapter;
3030 (C) a nursing facility licensed under Chapter 242
3131 that employs at least two registered nurses;
3232 (D) an ambulatory surgical center licensed under
3333 Chapter 243;
3434 (E) a freestanding emergency medical care
3535 facility as defined by Section 254.001; and
3636 (F) a mental hospital licensed under Chapter 577.
3737 Sec. 331.002. WORKPLACE VIOLENCE PREVENTION COMMITTEE. (a)
3838 Each facility shall establish a workplace violence prevention
3939 committee or authorize an existing facility committee to develop
4040 the workplace violence prevention plan required under Section
4141 331.004.
4242 (b) A committee must include at least:
4343 (1) one registered nurse who provides direct care to
4444 patients of the facility; and
4545 (2) one facility employee who provides security
4646 services for the facility if any and if practicable.
4747 (c) A health care system that owns or operates more than one
4848 facility may establish a single committee for all of the system's
4949 facilities if:
5050 (1) the committee develops a violence prevention plan
5151 for implementation at each facility in the system; and
5252 (2) data related to violence prevention remains
5353 distinctly identifiable for each facility in the system.
5454 Sec. 331.003. WORKPLACE VIOLENCE PREVENTION POLICY. (a) A
5555 facility shall adopt, implement, and enforce a written workplace
5656 violence prevention policy in accordance with this section to
5757 protect health care providers and employees from violent behavior
5858 and threats of violent behavior occurring at the facility.
5959 (b) The workplace violence prevention policy must:
6060 (1) require the facility to:
6161 (A) provide significant consideration of the
6262 violence prevention plan recommended by the facility's committee;
6363 and
6464 (B) evaluate any existing facility violence
6565 prevention plan;
6666 (2) encourage health care providers and employees of
6767 the facility to provide confidential information on workplace
6868 violence to the committee;
6969 (3) include a process to protect from retaliation
7070 facility health care providers or employees who provide information
7171 to the committee; and
7272 (4) comply with commission rules relating to workplace
7373 violence.
7474 Sec. 331.004. WORKPLACE VIOLENCE PREVENTION PLAN. (a) A
7575 facility shall adopt, implement, and enforce a written workplace
7676 violence prevention plan in accordance with this section to protect
7777 health care providers and employees from violent behavior and
7878 threats of violent behavior occurring at the facility.
7979 (b) A facility's workplace violence prevention plan must:
8080 (1) be based on the practice setting;
8181 (2) adopt a definition of "workplace violence" that
8282 includes:
8383 (A) an act or threat of physical force against a
8484 health care provider or employee that results in, or is likely to
8585 result in, physical injury or psychological trauma; and
8686 (B) an incident involving the use of a firearm or
8787 other dangerous weapon, regardless of whether a health care
8888 provider or employee is injured by the weapon;
8989 (3) require the facility to provide at least annually
9090 workplace violence prevention training or education that may be
9191 included in other required training or education provided to the
9292 facility's health care providers and employees, including
9393 temporary employees, who provide direct patient care;
9494 (4) prescribe a system for responding to and
9595 investigating violent incidents or potentially violent incidents
9696 at the facility;
9797 (5) address physical security and safety;
9898 (6) require the facility to solicit information from
9999 health care providers and employees when developing and
100100 implementing a workplace violence prevention plan;
101101 (7) require health care providers and employees to
102102 report incidents of workplace violence through the facility's
103103 existing occurrence reporting systems; and
104104 (8) require the facility to adjust patient care
105105 assignments, to the extent practicable, to prevent a health care
106106 provider or employee of the facility from treating or providing
107107 services to a patient who has intentionally physically abused or
108108 threatened the provider or employee.
109109 (c) The written workplace violence prevention plan may
110110 satisfy the requirements of Subsection (b) by referencing other
111111 internal facility policies and documents.
112112 (d) A committee at least annually shall:
113113 (1) review and evaluate the workplace violence
114114 prevention plan; and
115115 (2) report the results of the evaluation to the
116116 governing body of the facility.
117117 (e) Each facility shall make available on request an
118118 electronic or printed copy of the facility's workplace violence
119119 prevention plan to each health care provider or employee of the
120120 facility. If the committee determines the plan contains information
121121 that would pose a security threat if made public, the committee may
122122 redact that information before providing the plan.
123123 Sec. 331.005. RESPONDING TO INCIDENT OF WORKPLACE VIOLENCE.
124124 (a) Following an incident of workplace violence, a facility shall
125125 at a minimum offer immediate post-incident services, including any
126126 necessary acute medical treatment for each health care provider or
127127 employee of the facility who is directly involved in the incident.
128128 (b) A facility may not discourage a health care provider or
129129 employee from exercising the provider's or employee's right to
130130 contact or file a report with law enforcement regarding an incident
131131 of workplace violence.
132132 (c) A person may not discipline, including by suspension or
133133 termination of employment, discriminate against, or retaliate
134134 against another person who:
135135 (1) in good faith reports an incident of workplace
136136 violence; or
137137 (2) advises a health care provider or employee of the
138138 provider's or employee's right to report an incident of workplace
139139 violence.
140140 Sec. 331.006. ENFORCEMENT. An appropriate licensing agency
141141 may take disciplinary action against a person who violates this
142142 chapter as if the person violated an applicable licensing law.
143143 SECTION 2. Not later than September 1, 2024, a facility
144144 subject to Chapter 331, Health and Safety Code, as added by this
145145 Act, shall adopt a workplace violence prevention policy and adopt
146146 and implement a workplace violence prevention plan in accordance
147147 with Sections 331.003 and 331.004, Health and Safety Code, as added
148148 by this Act.
149149 SECTION 3. This Act takes effect September 1, 2023.
