7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 62.051, Labor Code, is amended to read as |
---|
9 | 9 | | follows: |
---|
10 | 10 | | Sec. 62.051. MINIMUM WAGE. (a) Except as provided by |
---|
11 | 11 | | Section 62.057, an employer shall pay to each employee not less than |
---|
12 | 12 | | the greater of: |
---|
13 | 13 | | (1) $15 an hour; or |
---|
14 | 14 | | (2) the federal minimum wage under Section 6, Fair |
---|
15 | 15 | | Labor Standards Act of 1938 (29 U.S.C. Section 206). |
---|
16 | 16 | | (b) This subsection applies to wages paid by an employer for |
---|
17 | 17 | | the 2022, 2023, and 2024 calendar years. Subsection (a) does not |
---|
18 | 18 | | apply in a year to which this subsection applies. Except as |
---|
19 | 19 | | provided by Section 62.057: |
---|
20 | 20 | | (1) for the 2022 calendar year, an employer shall pay |
---|
21 | 21 | | to each employee not less than the greater of: |
---|
22 | 22 | | (A) $10.00 an hour; or |
---|
23 | 23 | | (B) the federal minimum wage under Section 6, |
---|
24 | 24 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and |
---|
25 | 25 | | (2) for the 2023 calendar year, an employer shall pay |
---|
26 | 26 | | to each employee not less than the greater of: |
---|
27 | 27 | | (A) $12.50 an hour; or |
---|
28 | 28 | | (B) the federal minimum wage under Section 6, |
---|
29 | 29 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and |
---|
30 | 30 | | (3) for the 2024 calendar year, an employer shall pay |
---|
31 | 31 | | to each employee not less than the greater of: |
---|
32 | 32 | | (A) $14 an hour; or |
---|
33 | 33 | | (B) the federal minimum wage under Section 6, |
---|
34 | 34 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and |
---|
35 | 35 | | (c) Subsection (b) and this subsection expire January 1, |
---|
36 | 36 | | 2025. |
---|
37 | 37 | | SECTION 3. Section 62.151, Labor Code, is repealed. |
---|
38 | 38 | | SECTION 4. This Act takes effect January 1, 2024. |
