55 AN ACT
66 relating to the minimum wage.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 62.051, Labor Code, is amended to read as
99 follows:
1010 Sec. 62.051. MINIMUM WAGE. (a) Except as provided by
1111 Section 62.057, an employer shall pay to each employee not less than
1212 the greater of:
1313 (1) $15 an hour; or
1414 (2) the federal minimum wage under Section 6, Fair
1515 Labor Standards Act of 1938 (29 U.S.C. Section 206).
1616 (b) This subsection applies to wages paid by an employer for
1717 the 2022, 2023, and 2024 calendar years. Subsection (a) does not
1818 apply in a year to which this subsection applies. Except as
1919 provided by Section 62.057:
2020 (1) for the 2022 calendar year, an employer shall pay
2121 to each employee not less than the greater of:
2222 (A) $10.00 an hour; or
2323 (B) the federal minimum wage under Section 6,
2424 Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and
2525 (2) for the 2023 calendar year, an employer shall pay
2626 to each employee not less than the greater of:
2727 (A) $12.50 an hour; or
2828 (B) the federal minimum wage under Section 6,
2929 Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and
3030 (3) for the 2024 calendar year, an employer shall pay
3131 to each employee not less than the greater of:
3232 (A) $14 an hour; or
3333 (B) the federal minimum wage under Section 6,
3434 Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and
3535 (c) Subsection (b) and this subsection expire January 1,
3636 2025.
3737 SECTION 3. Section 62.151, Labor Code, is repealed.
3838 SECTION 4. This Act takes effect January 1, 2024.
