8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 1702.333, Occupations Code, is amended |
---|
10 | 10 | | to read as follows: |
---|
11 | 11 | | Sec. 1702.333. [PLACE OF RELIGIOUS WORSHIP;] CERTAIN |
---|
12 | 12 | | VOLUNTEERS. (a) In this section, "volunteer security services" |
---|
13 | 13 | | means services or activities that are: |
---|
14 | 14 | | (1) regulated under this chapter; and |
---|
15 | 15 | | (2) provided without compensation or remuneration. |
---|
16 | 16 | | (b) This chapter does not apply to a person who is providing |
---|
17 | 17 | | volunteer security services on: |
---|
18 | 18 | | (1) the premises of a church, synagogue, or other |
---|
19 | 19 | | established place of religious worship; or |
---|
20 | 20 | | (2) premises where an event sponsored or sanctioned by |
---|
21 | 21 | | a public primary or secondary school is taking place. |
---|
22 | 22 | | (c) Except as provided by Subsection (d), while [While] |
---|
23 | 23 | | providing volunteer security services under Subsection (b), a |
---|
24 | 24 | | person may not wear a uniform or badge that: |
---|
25 | 25 | | (1) contains the word "security"; or |
---|
26 | 26 | | (2) gives the person the appearance of being a peace |
---|
27 | 27 | | officer, personal protection officer, or security officer. |
---|
28 | 28 | | (d) A peace officer providing volunteer security services |
---|
29 | 29 | | under Subsection (b) may: |
---|
30 | 30 | | (1) with the consent of the head of the employing or |
---|
31 | 31 | | appointing law enforcement agency, wear the uniform of the agency; |
---|
32 | 32 | | or |
---|
33 | 33 | | (2) wear another uniform or badge that gives the |
---|
34 | 34 | | person the appearance of being a peace officer. |
---|
35 | 35 | | (e) The reimbursement for or payment of an insurance policy |
---|
36 | 36 | | insuring a peace officer who provides volunteer security services |
---|
37 | 37 | | under Subsection (b) for civil liability arising from acts |
---|
38 | 38 | | occurring while providing those services is not considered |
---|
39 | 39 | | compensation or reimbursement. |
---|
40 | 40 | | SECTION 2. This Act takes effect September 1, 2023. |
