55 relating to an exemption from the application of the Private
66 Security Act for volunteer security services provided at certain
77 places or events.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1702.333, Occupations Code, is amended
1010 to read as follows:
1111 Sec. 1702.333. [PLACE OF RELIGIOUS WORSHIP;] CERTAIN
1212 VOLUNTEERS. (a) In this section, "volunteer security services"
1313 means services or activities that are:
1414 (1) regulated under this chapter; and
1515 (2) provided without compensation or remuneration.
1616 (b) This chapter does not apply to a person who is providing
1717 volunteer security services on:
1818 (1) the premises of a church, synagogue, or other
1919 established place of religious worship; or
2020 (2) premises where an event sponsored or sanctioned by
2121 a public primary or secondary school is taking place.
2222 (c) Except as provided by Subsection (d), while [While]
2323 providing volunteer security services under Subsection (b), a
2424 person may not wear a uniform or badge that:
2525 (1) contains the word "security"; or
2626 (2) gives the person the appearance of being a peace
2727 officer, personal protection officer, or security officer.
2828 (d) A peace officer providing volunteer security services
2929 under Subsection (b) may:
3030 (1) with the consent of the head of the employing or
3131 appointing law enforcement agency, wear the uniform of the agency;
3232 or
3333 (2) wear another uniform or badge that gives the
3434 person the appearance of being a peace officer.
3535 (e) The reimbursement for or payment of an insurance policy
3636 insuring a peace officer who provides volunteer security services
3737 under Subsection (b) for civil liability arising from acts
3838 occurring while providing those services is not considered
3939 compensation or reimbursement.
4040 SECTION 2. This Act takes effect September 1, 2023.
