55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to establishment of an employee grievance procedure by the
88 Health and Human Services Commission and Department of Family and
99 Protective Services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 531, Government Code, is
1212 amended by adding Section 531.0095 to read as follows:
1313 Sec. 531.0095. EMPLOYEE GRIEVANCE PROCEDURE. (a) The
1414 executive commissioner by rule shall establish a grievance
1515 procedure for commission employees. The procedure must allow a
1616 commission employee to appeal an employment action taken by the
1717 commission regarding:
1818 (1) a disciplinary action imposed on the employee,
1919 including:
2020 (A) an oral or written reprimand;
2121 (B) a demotion;
2222 (C) a suspension;
2323 (D) a reduction in compensation; and
2424 (E) a termination for cause and at will; or
2525 (2) the employee's compensation or working conditions,
2626 including the hours the employee is required to work.
2727 (b) An appeal made under this section is considered to be a
2828 contested case under Chapter 2001.
2929 SECTION 2. Subchapter B, Chapter 40, Human Resources Code,
3030 is amended by adding Section 40.0335 to read as follows:
3131 Sec. 40.0335. EMPLOYEE GRIEVANCE PROCEDURE. (a) The
3232 commissioner by rule shall establish a grievance procedure for
3333 department employees. The procedure must allow a department
3434 employee to appeal an employment action taken by the department
3535 regarding:
3636 (1) a disciplinary action imposed on the employee,
3737 including:
3838 (A) an oral or written reprimand;
3939 (B) a demotion;
4040 (C) a suspension;
4141 (D) a reduction in compensation; and
4242 (E) a termination for cause and at will; or
4343 (2) the employee's compensation or working conditions,
4444 including the hours the employee is required to work.
4545 (b) An appeal made under this section is considered to be a
4646 contested case under Chapter 2001, Government Code.
4747 SECTION 3. Not later than January 1, 2024:
4848 (1) the executive commissioner of the Health and Human
4949 Services Commission shall adopt rules necessary to implement
5050 Section 531.0095, Government Code, as added by this Act; and
5151 (2) the commissioner of the Department of Family and
5252 Protective Services shall adopt rules necessary to implement
5353 Section 40.0335, Human Resources Code, as added by this Act.
5454 SECTION 4. This Act takes effect September 1, 2023.
