| 7 | 7 | | relating to the election of trustees of certain school districts. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 11.052(a), Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (a) Except as provided by Subsection (b) or Section 11.0521, |
|---|
| 12 | 12 | | the board of trustees of an independent school district, on its own |
|---|
| 13 | 13 | | motion, may order that trustees of the district are to be elected |
|---|
| 14 | 14 | | from single-member trustee districts or that not fewer than 70 |
|---|
| 15 | 15 | | percent of the members of the board of trustees are to be elected |
|---|
| 16 | 16 | | from single-member trustee districts with the remaining trustees to |
|---|
| 17 | 17 | | be elected from the district at large. |
|---|
| 18 | 18 | | SECTION 2. Subchapter C, Chapter 11, Education Code, is |
|---|
| 19 | 19 | | amended by adding Section 11.0521 to read as follows: |
|---|
| 20 | 20 | | Sec. 11.0521. MULTIMEMBER TRUSTEE DISTRICTS FOR CERTAIN |
|---|
| 21 | 21 | | SCHOOL DISTRICTS. (a) This section applies only to an independent |
|---|
| 22 | 22 | | school district with the largest student enrollment in a county |
|---|
| 23 | 23 | | with a population of 550,000 or more that is adjacent to a county |
|---|
| 24 | 24 | | with a population of 3.3 million or more. |
|---|
| 25 | 25 | | (b) The board of trustees of an independent school district |
|---|
| 26 | 26 | | to which this section applies shall: |
|---|
| 27 | 27 | | (1) order that trustees of the district are to be |
|---|
| 28 | 28 | | elected as follows: |
|---|
| 29 | 29 | | (A) one trustee elected from the district at |
|---|
| 30 | 30 | | large; and |
|---|
| 31 | 31 | | (B) six trustees elected by position from two |
|---|
| 32 | 32 | | multimember voting districts composed of three trustee positions |
|---|
| 33 | 33 | | each; |
|---|
| 34 | 34 | | (2) divide the school district as nearly as |
|---|
| 35 | 35 | | practicable into two multimember voting districts of equal |
|---|
| 36 | 36 | | population, with one voting district representing the west half of |
|---|
| 37 | 37 | | the school district and the other voting district representing the |
|---|
| 38 | 38 | | east half of the school district; and |
|---|
| 39 | 39 | | (3) designate by number each position on the board of |
|---|
| 40 | 40 | | trustees. |
|---|
| 41 | 41 | | (c) Residents of each multimember voting district are |
|---|
| 42 | 42 | | entitled to cast votes for each trustee position within the |
|---|
| 43 | 43 | | multimember voting district. |
|---|
| 44 | 44 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 45 | 45 | | of this Act, the board of trustees of a school district to which |
|---|
| 46 | 46 | | Section 11.0521, Education Code, as added by this Act, applies |
|---|
| 47 | 47 | | shall adopt an order as required by that section. |
|---|
| 48 | 48 | | SECTION 4. This Act takes effect September 1, 2023. |
